Book excerpt: This volume consists of a carefully edited version of the General Course on Public International Law delivered at the Hague Academy of International Law to commemorate the fiftieth anniversary of the foundation of the United Nations. The author brings to them not only his background of academic distinction, but his experience as a practitioner concerned with major international legal issues. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.

Sylvia Washington Bâ analyzes Senghor's poetry to show how the concept of negritude infuses it at every level. A biographical sketch describes his childhood in Senegal, his distinguished academic career in France, and his election as President of Senegal. Themes of alienation and exile pervade Senghor's poetry, but it was by the opposition of his sensitivity and values to those of Europe that he was able to formulate his credo. Its key theme, and the supreme value of black African civilization, is the concept of life forces, which are not attributes or accidents of being, but the very essence of being. Life is an essentially dynamic mode of being for the black African, and it has been Senghor's achievement to communicate African intensity and vitality through his use of the nuances, subtleties, and sonorities of the French language. In the final chapter Sylvia Washington Bâ discusses the future of Senghor's belief that the black man's culture should be recognized as valid not simply as a matter of human justice, but because the values of negritude could be instrumental in the reintegration of positive values into western civilization and the reorientation of contemporary man toward life and love. Hessen was born a Jewish subject of the Russian Czar in the Ukraine, participated in the October Revolution and was executed in the Soviet Union at the beginning of the purges. Grossmann was born a Jewish subject of the Austro-Hungarian Kaiser in Poland and served as an Austrian of?cer in the First World War; afterwards he was forced to return to Poland and then because of his revolutionary political activities to emigrate to Germany; with the rise to power of the Nazis he had to ?ee to France and then Americawhilehisfamily,whichremainedinEurope,perishedinNaziconcentration camps. Our own acquaintance with the work of these two authors is also indebted to historical context (under incomparably more fortunate circumstances): the revival of Marxist scholarship in Europe in the wake of the student movement and the p- fessionalization of history of science on the Continent. We hope that under the again very different conditions of the early twenty-?rst century these texts will contribute to the further development of a philosophically informed socio-historical approach to the study of science.

Book excerpt: Statehood in the early 21st century remains as much a central problem now as it was in 1979 when the first edition of The Creation of States in International Law was published. As Rhodesia, Namibia, the South African Homelands and Taiwan then were subjects of acute concern, today governments, international organizations, and other institutions are seized of such matters as the membership of Cyprus in the European Union, application of the Geneva Conventions to Afghanistan, a final settlement for Kosovo, and, still, relations between China and Taiwan. All of these, and many other disputed situations, are inseparable from the nature of statehood and its application in practice. The remarkable increase in the number of States in the 20th century did not abate in the twenty five years following publication of James Crawford's landmark study, which was awarded the American Society of International Law Prize for Creative Scholarship in 1981. The independence of many small territories comprising the 'residue' of the European colonial empires alone accounts for a major increase in States since 1979; while the disintegration of Yugoslavia and the USSR in the early 1990s further augmented the ranks. With these developments, the practice of States and international organizations has developed by substantial measure in respect of self-determination, secession, succession, recognition, de-colonization, and several other fields. Addressing such questions as the unification of Germany, the status of Israel and Palestine, and the continuing pressure from non-State groups to attain statehood, even, in cases like Chechnya or Tibet, against the presumptive rights of existing States, James Crawford discusses the relation between statehood and recognition; the criteria for statehood, especially in view of evolving standards of democracy and human rights; and the application of such criteria in international organizations and between states. Also discussed are the mechanisms by which states have been created, including devolution and secession, international disposition by major powers or international organizations and the institutions established for Mandated, Trust, and Non-Self-Governing Territories. Combining a general argument as to the normative significance of statehood with analysis of numerous specific cases, this fully revised and expanded second edition gives a comprehensive account of the developments which have led to the birth of so many new states.
