Por tanto, el primer presupuesto para su incoación es la declaración de firmeza de la sentencia respectiva. Dicha firmeza se producirá porque hayan transcurrido los plazos para ser recurrida, o bien porque haya recaído sentencia resolviendo los recursos de apelación o casación admitidos. Dándose cualquiera de estos dos supuestos el Juez o Tribunal encargado de la ejecución dictará auto por el que declarará la firmeza y se ordenará la apertura de la ejecutoria, que se encabezará con testimonio de la sentencia firme.
