Book excerpt: Treaties in Force is prepared by the Department of State for the purpose of providing information on treaties and other international agreements to which the United States has become a party and which are carried on the records of the Department of State as being in force as of its stated publication date, January 1, 2013. With respect to treaties and agreements in force as of January 1, 2013, information regarding status is up to date as of the date indicated as authoritative. The term “treaty” as a matter of U.S. constitutional law denotes international agreements made by the President with the advice and consent of the Senate in accordance with Article II, section 2 of the Constitution of the United States. In addition to such “treaties”, this publication covers international agreements in force that have been concluded by the Executive (a) pursuant to or in accordance with existing legislation or a prior treaty; (b) subject to congressional approval or implementation, and/or (c) under and in accordance with the President’s constitutional powers. Treaties in Force is arranged in two sections. Section 1 includes bilateral treaties and other international agreements listed by country or other international entity with subject headings under each entry. Arrangements with territorial possessions of a country appear at the end of the entry for that country. In some cases, treaties and international agreements applicable to a territory prior to its independence are included in the entry for that country on the basis of its assumption of treaty obligations upon becoming independent, as noted at the beginning of the entry for that country. For convenience, some treaties and agreements concluded with countries whose name or statehood status has changed continue to be listed under the name in use at the time the agreement was concluded, if the title of the treaty or agreement has not been formally amended. Section 2 lists multilateral treaties and other international agreements to which the United States is a party, arranged by subject. The depositary is the authoritative source for a current list of parties and information on other matters concerning the status of the agreement, and status information often changes. Information is provided on the depositary for the agreement in question, and contact information, including an Internet site is provided for the depositary where available.

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Book excerpt: The “Joint Declaration of Twenty-two States,” signed in Paris on November 19, 1990 by the Chiefs of State or Government of all the countries which participated in World War Two in Europe, is the closest document we will ever have to a true “peace treaty” concluding World War II in Europe. In his new book, retired United States Ambassador John Maresca, who led the American participation in the negotiations, explains how this document was quietly negotiated following the reunification of Germany and in view of Soviet interest in normalizing their relations with Europe. With the reunification of Germany which had just taken place it was, for the first time since the end of the war, possible to have a formal agreement that the war was over, and the countries concerned were all gathering for a summit-level signing ceremony in Paris. With Gorbachev interested in more positive relations with Europe, and with the formal reunification of Germany, such an agreement was — for the first time — possible. All the leaders coming to the Paris summit had an interest in a formal conclusion to the War, and this gave impetus for the negotiators in Vienna to draft a document intended to normalize relations among them. The Joint Declaration was negotiated carefully, and privately, among the Ambassadors representing the countries which had participated, in one way or another, in World War Two in Europe, and the resulting document -- the “Joint Declaration” — was signed, at the summit level, at the Elysée Palace in Paris. But it was overshadowed at the time by the Treaty on Conventional Forces in Europe — signed at the same signature event — and has remained un-noticed since then. No one could possibly have foreseen that the USSR would be dissolved about one year later, making it impossible to negotiate a more formal treaty to close World War II in Europe. The “Joint Declaration” thus remains the closest document the world will ever see to a formal “Peace Treaty” concluding World War Two in Europe. It was signed by all the Chiefs of State or Government of all the countries which participated in World War II in Europe.

It analyses the obligations governing energy transit through pipelines in multilateral and bilateral treaties, looking at the WTO Agreement, the Energy Charter Treaty, and sixteen bespoke pipeline treaties. It argues that a number of transit obligations under these treaties are indivisible, reflecting the collective interests of states parties. The analysis is placed in the historical and normative landscape of freedom of transit in international law. After setting out the content and scope of obligations concerning transit of energy, it distinguishes countermeasures from treaty law responses, and examines the dispute settlement and compliance supervision provisions in these treaties. Building on these findings, the work discusses the availability and lawfulness of countermeasures as, on the one hand, a means of implementing the transit states responsibility for interruptions of energy transit via pipelines; and, on the other hand, circumstances that preclude the wrongfulness of the transit states interruptions of transit.
