(Parsons ES) at Truax Field Air National Guard Base, Wisconsin to evaluate the use of intrinsic remediation (natural attenuation) with long-term monitoring (LTM) as a remedial option for dissolved benzene, toluene, ethylbenzene, and xylene (BTEX) contamination in the shallow saturated zone in the vicinity of the former jet fuel transfer line southwest of Building 412 and the petroleum, oils, and lubricants (POL) yard (the site). Soil and ground water contamination is documented for the site, with contamination being present in the aqueous (i.e., dissolved) and gaseous phases and as residual light nonaqueous-phase liquid (LNAPL) within the aquifer matrix. There is no evidence of mobile LNAPL (free product) at this site. This study focused on the impact of dissolved BTEX on the shallow ground water system at the site. Site history and the results of soil and ground water investigations conducted previously are also summarized in this report.

Book excerpt: Intrinsic remediation is an innovative remedial approach that relies on natural attenuation to remediate contaminants dissolved in groundwater. Mechanisms for natural attenuation of benzene, toluene, ethylbenzene, and xylenes (BTEX) include biodegradation, advection, dispersion, dilution froin recharge, sorption, and volatilization. Of these processes, biodegradation is the only mechanism working to transform contaminants into innocuous byproducts. Intrinsic bioremediation occurs when indigenous microorganisms work to bring about a reduction in the total mass of contamination in the subsurface without the addition of nutrients. Patterns and rates of intrinsic remediation can vary markedly from site to site depending on governing physical and chemical processes. The main emphasis of the work described herein was to evaluate if natural attenuation mechanisms would be sufficient to reduce concentrations of dissolved fuel- related compounds in groundwater to levels that meet federal and state groundwater protection standards. The potential for these mechanisms to effectively reduce the concentrations of chlorinated solvents at the site, which is ancillary to the scope of this program, also was qualitatively considered. This study is not intended to be contaminant assessment report, a remedial action options evaluation, or a remedial action plan; rather, it is provided for the use of the Base and its prime environmental contractor(s) as information to be used for future decision making regarding this site.

Book excerpt: One of the reasons why lawyers try and raise numerous subclassifications of Tort up to the main level of Tort and Contract (as they grope and search in the dark the way they do), is because they do not see the invisible contracts that are often quietly in effect, correctly overruling Tort Law intervention, since an examination of the factual setting seems void of any contract. By the end of this Letter, you will see many invisible contracts for what they really are, and you will see how to identify the indicia that create invisible contracts. You may not understand the deeper significance of the distinction in effect between Tort and Contract right now, but after reading this through a few times, the semantic differential in meaning should become very apparent to you, as I will give many examples of Contract Law and Tort Law reasonings and arguments, as applied across many different factual settings; as whenever there is a judgment of some type, there is always in effect some rules and an exclusion of some evidence in the mind of the judge as to what arguments will and will not be allowed to be heard -- (even though this process goes on unmentioned orally by the judge); and the real reason why there is an important significance here that you might be interested in taking Personal Notice of [just like Judges take Judicial Notice of special items], in Tort and Contract rule differentials in judgment settings, is because we all have an impending Judgment with Heavenly Father -- where arguments then presented will be judged under similar Tort and Contract rules; a judgment setting where the pure magnitude of the consequences renders unprepared incorrect reasoning injudicious and lacking in foresight.
