And yet the role of government lawyers in Australia, and specifically the Solicitor-General as the most senior of government lawyers, is under-theorised and under-studied. The Role of the Solicitor-General: Negotiating Law, Politics and the Public Interest goes behind the scenes of government – drawing from interviews with over 45 government and judicial officials – to uncover the history, theory and practice of the Australian Solicitor-General. The analysis reveals a role that is of fundamental constitutional importance to ensuring both the legality and the integrity of government action, thus contributing to the achievement of rule-of-law ideals. The Solicitor-General also works to defend government action and prosecute government policies in the court, and thus performs an important role as messenger between the political and judicial branches of government. But the Solicitor-General's position, as both an internal integrity check on government and an external warrior for government, gives rise to competing pressures: between the law, politics and the public interest. The office of the Solicitor-General in Australia has evolved many characteristics across the almost two centuries of its history in an attempt to navigate these tensions. These pressures are not unique to the Australian context. The understanding of the Australian position provided by this book is informed by, and will inform, comparative analysis of the role of government lawyers across the world.

Book excerpt: The Ministry of Justice has made progress in improving its financial management, but it falls short of best practice in the consistency of its financial management approach, its understanding of its costs and the integration of its financial management systems and processes. The Ministry has made an important step forward in establishing a Value for Money Improvement Committee. This will assist the Ministry in delivering its future efficiency programme; integrating its financial systems; improving its cost data; and enhancing its internal financial management reporting. However, the Ministry is yet to produce a clear action plan to deliver its financial management initiatives and needs to do so over the next four months to demonstrate its commitment to continuing to improve its financial management. The Ministry does not yet understand, in sufficient detail, the costs of its activities within its prisons, the probation service and the courts. Procurement systems have been overhauled but this still leaves the 40 per cent of the Ministry's cost base relating to staff time. To address this, the Ministry has introduced major programmes to understand the costs of its activities in the National Offender Management Service and HM Courts Service but they are not due to be completed until at least 2012. The National Audit Office also notes that the Ministry's Finance Directorate does not have sufficient visibility of the costs of its policy proposals, reducing the effectiveness of the Ministry's financial control of its forward policy agenda.

Book excerpt: Annually, central government spends some £558 billion, and this is forecast to increase to £678 billion by 2010-11. Strong and competent financial resources management is central to departments meeting their objectives cost effectively and delivering public services which represent value for money. Since the Committee's last report on this topic (HC 181, 25th report of session 2003-04, ISBN 9780215023636) the number of qualified finance directors with a seat on the departmental board has increased, enhancing the focus on financial performance at senior management level, but the lack of financial skills and awareness amongst non-finance staff remains a barrier to improving financial management more generally across government. Accruals-based accounting and budgeting systems are helping some departments identify under-utilised assets and dispose of those no longer required. Departments need to improve their forecasting capabilities to strengthen budgetary control and to avoid underspends not being identified early enough to reallocate resources to other priorities. Departments are continuing to spend less money than they forecast, particularly on capital projects, increasing the risk that resources are not being allocated across government in the most effective way. Few departmental boards are presented with accurate, timely and integrated financial and operational performance information to enable them to take sufficiently informed decisions on the use of resources and to review performance. Although the Treasury and Cabinet Office have a number of initiative to improve resource management, there is some way to go before financial management is fully embedded within departmental cultures.
