Book Traveller Vulnerability in the Context of Travel and Tourism Contracts

Download or read book Traveller Vulnerability in the Context of Travel and Tourism Contracts written by Maria Goretti Sanches Lima and published by Springer. This book was released on 2018-11-03 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book highlights the link between consumers and travellers, identifying the meaning of vulnerability in Brazil and the EU. It also covers different types of contracts for tourism and travel services, including online booking processes. Only after 2015, as a result of the directive on package travel and linked travel arrangements, did the EU begin viewing travellers as consumers in the sense of Union Consumer Law; conversely, in Brazil, the traveller has no legal status whatsoever and is considered solely a consumer. As the traveller is implicitly a consumer he/she is subject to vulnerability. However, the definition of vulnerability differs considerably between Brazil and the EU: while in Brazil it is a principle stemming from the Consumer Defence Code, covering all consumers, in the EU vulnerability is not an established principle. In the EU, although the average consumer is assumed to be reasonably well informed, observant and circumspect, they are also recognised as the weaker party in the contract. That recognition does not fit with the notion of "confident consumer". Vulnerable consumers in the EU are those whose individual characteristics, such as their age, physical or mental infirmity, or credulity, make them particularly susceptible to unfair commercial practices. Conversely, in Brazil these consumers are seen as being hyper-vulnerable, rather than solely vulnerable. In this context, travellers are in a weaker position than regular consumers buying goods or services, because they are outside of their domicile or jurisdiction for a brief or extended period of time. This book examines two types of traveller vulnerability that make travellers, particularly international ones, a special type of consumers: 1. External and 2. Legal (jurisdiction). Travellers’ vulnerability mainly stems from consumers travelling to different markets and different cultures. As such, they are subject to different laws that require special global attention. While both the EU and Brazilian system have their respective advantages and disadvantages, the goal of both must be to further increase protection for travellers, including business travellers. In consumer societies, the traveller is indeed a consumer by logical causation and hence a “special consumer”.

Book Overbooked

  • Author : Elizabeth Becker
  • Publisher : Simon and Schuster
  • Release : 2013-04-16
  • ISBN : 1439167508
  • Pages : 513 pages

Download or read book Overbooked written by Elizabeth Becker and published by Simon and Schuster. This book was released on 2013-04-16 with total page 513 pages. Available in PDF, EPUB and Kindle. Book excerpt: Tourism, fast becoming the largest global business, employs one out of twelve persons and produces $6.5 trillion of the world’s economy. In a groundbreaking book, Elizabeth Becker uncovers how what was once a hobby has become a colossal enterprise with profound impact on countries, the environment, and cultural heritage. This invisible industry exploded at the end of the Cold War. In 2012 the number of tourists traveling the world reached one billion. Now everything can be packaged as a tour: with the high cost of medical care in the U.S., Americans are booking a vacation and an operation in countries like Turkey for a fraction of the cost at home. Becker travels the world to take the measure of the business: France invented the travel business and is still its leader; Venice is expiring of over-tourism. In Cambodia, tourists crawl over the temples of Angkor, jeopardizing precious cultural sites. Costa Rica rejected raising cattle for American fast-food restaurants to protect their wilderness for the more lucrative field of eco-tourism. Dubai has transformed a patch of desert in the Arabian Gulf into a mammoth shopping mall. Africa’s safaris are thriving, even as its wildlife is threatened by foreign poachers. Large cruise ships are spoiling the oceans and ruining city ports as their American-based companies reap handsome profits through tax loopholes. China, the giant, is at last inviting tourists and sending its own out in droves. The United States, which invented some of the best of tourism, has lost its edge due to political battles. Becker reveals travel as product. Seeing the tourism industry from the inside out, through her eyes and ears, we experience a dizzying range of travel options though very few quiet getaways. Her investigation is a first examination of one of the largest and potentially most destructive enterprises in the world.

Book An Analysis of Consumer Issues and Fraud in the Travel and Tourism Industry

Download or read book An Analysis of Consumer Issues and Fraud in the Travel and Tourism Industry written by L. Hall and published by . This book was released on 1997 with total page 180 pages. Available in PDF, EPUB and Kindle. Book excerpt: Summarizes results of research and analysis in the area of consumer problems, including fraud, in the travel industry, and identifies possible methods to mitigate those problems. The focus was on three areas of the industry: travel products and product providers including airline flights, hotels, recreational activities, and attractions; travel packages; and time-sharing or vacation sharing. An overview is presented of the nature of travel transactions, the regulatory environment, the size of travel-related problems, and the nature of the tourism industry in Canada. Problems are discussed at the pre-contractual, contractual, and post-contractual stages of the travel transaction and include telemarketing issues, the use of travel certificates, issues arising from technological advances, and issues covered under existing regulations such as misrepresentation, business failures, and licensing of agents. This is followed by a review of the federal and provincial laws governing the travel industry and of regulatory approaches used in other jurisdictions such as the United States and Britain. Finally, remediation of consumer problems and fraud is discussed, including co-ordinated law enforcement, inter- jurisdictional co-operation, self-regulation, and consumer education.

Download or read book European Travel Law written by Zahd Yaqub and published by Wiley. This book was released on 1997-05-07 with total page 794 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Whether one encounters legal problems in Belgium, Ireland, Spain, England or Germany, this reference book will certainly become the touchstone of the tourism and travel industry. ? As a North American, I envy the practitioners of European travel and tourism law, who now have available this powerful tool to assist them in guiding representatives of the industry through the complex web of law which governs the ever expanding European travel industry." From the Foreword by Michael Lipton QC, Past-Chairman of the Tourism, Travel and Hospitality Law Committee (Committee Y), Section on Business Law, International Bar Association European Travel Law provides an in-depth and up-to-date guide to European tourism and travel law and the structure of the European travel industry. Each country chapter is written by a recognised local expert and examines the law affecting tourism and related consumer protection issues on two levels: first at the EC level, providing in particular an explanation of the implementation of the vitally important Package Travel Directive and secondly at the national level, with chapters detailing the domestic practice and provisions on tourism law throughout Europe. In addition to the country-by-country analysis, European Travel Law gathers together and examines in detail the increasing amount of European Community provisions on travel and tourism, including an examination of the only judgment to be heard to date on the Package Travel Directive (Dillenkofer), the relevant GATT provisions and the World Travel Organisation regulations and codes of conduct relating to tourism. "To the layperson, any book written by lawyers about the law, usually presents a daunting challenge, not only in reading, but also in comprehension. It was, therefore, a pleasant surprise to find European Travel Law to be very readable and more especially, very informative. The book gives clear, concise and comprehensible information and advice. It is not only regular travellers who would be wise to get their hands on a copy of this book, but anyone involved in, or connected with, the travel industry in Europe will need a copy." Clive Parish, Managing Director, Association of European Travel Agents (AETA)
