Book excerpt: En esta investigación se desarrolla el tratamiento penal y procesal penal del tráfico de drogas, la delincuencia organizada y el blanqueo de capitales, con la finalidad de comprender el gran daño que la producción, el tráfico y el consumo de drogas ilícitas están causando al mundo, donde ha dejado de ser un simple problema de orden público o de contención judicial, sino que además se ha convertido en un fenómeno económico que trasciende las fronteras nacionales, condiciona e influye en las políticas internas de los países afectados y en las relaciones internacionales entre los países en desarrollo y los países industrializados. Tanto España, como país de Europa, y Venezuela, como país de América Latina, sufren en la actualidad, las consecuencias históricas del nacimiento, desarrollo y propagación del fenómeno de las drogas. De acuerdo con numerosas investigaciones ambos países constituyen puentes del narcotráfico internacional en sus regiones, básicamente la ubicación geográfica de ambos los convierte en territorios apetecibles para las organizaciones que se dedican al tráfico internacional ilícito de drogas. Debido a esta problemática, se analizó la tipicidad del delito de tráfico de drogas y su aplicación procesal en España y Venezuela, donde por su connotación organizativa y transnacional, se dirigió el estudio al terreno de la delincuencia organizada, siendo este tipo de delincuencia la evolución de una criminalidad asociada a la marginalidad del individuo, hacia una criminalidad desarrollada por estructuras de corte empresarial. Dentro de esta evolución, la criminalidad organizada obtiene importantes beneficios económicos, y habitualmente un gran poder económico cuando se vincula al tráfico ilícito de drogas. El delito organizado es un fenómeno complejo que se nutre de las discontinuidades culturales propiciadas por la globalidad. Por este motivo, para su investigación penal es necesaria la utilización de técnicas especiales como: el agente encubierto y la entrega vigilada. La cooperación internacional es fundamental para poder combatir la delincuencia organizada entre los distintos países y sus diferentes ordenamientos jurídicos, ya que este tipo de criminalidad comienza a tomar mayor poder económico, donde la transnacionalización es parte de su evolución y crecimiento que le permite traspasar todo tipo de fronteras, sujeta a desenvolverse en diferentes territorios y jurisdicciones. El blanqueo de capitales se estudió en el marco de la lucha contra el narcotráfico internacional, dado que la delincuencia organizada necesita limpiar el dinero ilícito para colocarlo en un mercado y sistema lícito, que les permita disfrutar de las grandes ganancias que les generaron los negocios delictivos como organización. Este modelo de criminalidad organizada ha contado con la ventaja, casi la complicidad se podría decir, de sistemas legales que, por su ineficacia, por su complejidad, por su inadecuación, dejan de constituir una amenaza y, en ocasiones, se convierten inclusive en aliado de estos criminales. Solamente cuando exista una estrategia multilateral real, dotada de recursos económicos y humanos apropiados y que cuente con el sistema legal adecuado, se podrá luchar con igualdad y claridad. Mientras tanto, existen acciones meritorias, útiles, valiosas y hasta indispensables, pero no hay una estrategia global eficaz. Inmer Francisco Puerta Mijares. Sus líneas de investigación son: Derecho penal y procesal penal internacional; Delincuencia organizada; Tráfico ilícito de drogas; Cooperación internacional y Blanqueo de capitales. Participa como árbitro en artículos de investigación en Derecho Procesal Penal, desarrollados en la Universidad de los Andes (Venezuela). Fue profesor de Derecho Penal General en la Escuela Nacional de Fiscales del Ministerio Público (Venezuela), dónde obtuvo una evaluación certificada de “Excelente” con puntuación 96.5/100 (2016-2017). Realizó una publicación en la Revista Científica Internacional de la Red de Capacitación del Ministerio Público Iberoamericano RECAMPI, titulada: Necesidad de una amplia cooperación policial y judicial entre los órganos de persecución penal internacional de la Unión Europea (01/2017). Ha dirigido diversas investigaciones, así como trabajos finales de grado y de máster. Ha dictado ponencias, conferencias, cursos, congresos y seminarios. Realizó numerosos talleres contra La Violencia de Género y Prevención del delito, en instituciones públicas y planteles educativos de Fe y Alegría (Venezuela) con la participación conjunta de las comunidades (03/2012-01/2018). Creó un programa de justicia y paz, dirigiendo abogados y trabajadoras sociales, para dar soluciones a las problemáticas legales existentes en las comunidades sin recursos económicos, durante su gestión como director del departamento de Consultoría Jurídica de la Alcaldía del Municipio Sucre (Venezuela, 01/2009-12/2010). Ha recibido reconocimientos por parte del Ministerio Fiscal, La Sociedad Anticancerosa, Colegio de Abogados, Alcaldía de Cagua y Alcaldía de San Casimiro por su destacada labor como jurista, y por su gran desempeño profesional y académico (Venezuela).

As population mobility grows in an ever more crowded world, the Global Forum on Migration and Development (GFMD) has emerged as the most important global mechanism to deal with the urgent challenges it presents. This book explores fresh strategies proposed by the GFMD in its fourth year of operation in Mexico and beyond. Interrogating the relationship between migration and development, the papers advance the Global Forum’s aims of reducing poverty and empowering low-income families everywhere. In 2010, there were 214 million international migrants worldwide, nearly two and a half times the number in 1965. By 2050, international migration is likely to expand sharply in scale, reach and complexity, due to growing demographic disparities, environmental change, shifting global political and economic dynamics, technological innovations and social networks. Migration can bring substantial gains to families in less-developed countries, and mobile labor is an axiomatic feature of the global economy. Yet outward migration of skilled workers can seriously retard development at home, and exert pressure on wages in host nations. Balancing these and other conflicting concerns requires the substantive and expert discourse offered in this book. Contributors discuss, and propose concrete solutions to, vital issues such as the debilitating costs of cross-border labor recruitment and the provision of social and income protection for foreign contract workers. With suggestions on how to facilitate connections between transnational families, and gender- and family-sensitive immigration regimes, this book aims to foster collaborative intergovernmental links as well as partnerships between governments, civil society and international organizations. It shows how the GFMD can positively influence policy and institutional behavior while addressing wider systemic factors in protecting mobile workers.
