Book excerpt: “… volviendo a reflexiones y confesiones hechas en la presentación del primer tomo de este Tratado, he de insistir en mi empeño de difusión del pensamiento universal en torno del derecho de obligaciones y sus fuentes, ansioso de descubrir veneros y compartirlos, en aras de disfrutar imaginariamente su degustación por otros, suscitar en ellos inquietudes, perplejidades, perturbar la pasividad de tantos, estimular la emulación, soñar con el surgimiento y el arraigo de un derecho genuino en su heterogeneidad cronológica y geográfica, en su compromiso solidarista y en su correspondencia con el ser nacional; en evolución continua, a la vez que estable; paradoja cuya conciliación moral y práctica incumbe a la jurisprudencia. Rescatar el derecho civil mostrando su perenne vitalidad y, sobre todo, reafirmando la universalidad de sus principios basilares, que, en lo que hace al contrato, pueden sintetizarse en la ‘racionalidad jurídica’: ética de la colaboración, sentido de la buena fe, preservación de la conmutatividad –no solo económica– a lo largo de íntegro el desarrollo de la operación, respeto del interés público y su prevalencia sobre el de las partes, y más aún sobre el de una sola de ellas. Son muchos, profundos y vertiginosos, los cambios que se han operado, no digo en las últimas décadas, sino en lo que va corrido del siglo XXI, dentro de un ‘mercado planetario’ y un ‘tsunami digital’, para hacer referencia a aspectos sobresalientes de ese fenómeno, que exigen reconocer que nos hallamos frente a un ‘derecho de la contemporaneidad’, que nos impone tomar conciencia de dónde y en qué tiempo estamos y avizorar hacia dónde vamos, sin abdicar de la identidad cultural, que es preciso preservar a todo trance, de manera que podamos mirar lo universal con nuestros propios ojos y apropiarnos de lo útil y valioso que hay en él, empleando nuestra lengua y moldeándolo a nuestra idiosincrasia. Adaptación a la realidad circundante, innovación, pero sin renunciar a ser nosotros mismos, lejos de la soberbia, pero con alto sentido de la dignidad y el valor propios, a la vez que sin impulsividad ni improvisaciones, salvaguardando el patrimonio jurídico de la especie”.
