Estudió en Alcalá y en París. En 1520 regresó a la Universidad de Alcalá y se encargó de la cátedra de Metafísica. En 1525 ingresó en la Orden de Predicadores y en 1532 ocupó la cátedra de Teología en la Universidad de Salamanca. En 1548 es nombrado confesor del emperador Carlos I, pero renuncia tras dos años para continuar su trabajo en Salamanca. La justicia, según Domingo Soto, cofundador de la Escuela de Salamanca, es el eje que vincula ley y derecho, los dos núcleos de su De iustitia et iure. Y la justicia, cuyo tratamiento último lo proporciona la filosofía y la teología, es una virtud humana que busca la justa relación de dos elementos, y que tiene por objeto la equidad, que se mide no tanto por la intención del agente, sino por su contenido objetivo En De iustitia et iure, la virtud de la justicia ocupa un papel central en dos sentidos. En primer lugar, la justicia es uno de los dos grandes temas elegidos para esta obra, titulada Sobre la justicia y el derecho (tomando el nombre del primer libro de los Digesta del emperador Justiniano, el cual comienza con el capítulo del mismo nombre). En segundo lugar, la justicia desempeña un papel particular porque es la noción central a la cual se confía la tarea de coordinar los dos grandes temas de la obra, que, en efecto, no son la justicia y el derecho, sino la ley y el derecho. Por eso se puede afirmar que Soto se vale de la justicia para pasar de la ley al derecho. Así abandona en su obra el método tradicional, seguido también por Francisco de Vitoria en sus lecciones, que consistía en comentar la SummaTheologiae recorriendo fielmente la secuencia de las dos cuestiones —tal y como fue distribuido por Tomás de Aquino—.

Book excerpt: In the centuries before Europeans crossed the Atlantic, social and material relations among the indigenous Guaraní people of present-day Paraguay were based on reciprocal gift-giving. But the Spanish and Portuguese newcomers who arrived in the sixteenth century seemed interested in the Guaraní only to advance their own interests, either through material exchange or by getting the Guaraní to serve them. This book tells the story of how Europeans felt empowered to pursue individual gain in the New World, and how the Guaraní people confronted this challenge to their very way of being. Although neither Guaraní nor Europeans were positioned to grasp the larger meaning of the moment, their meeting was part of a global sea change in human relations and the nature of economic exchange. Brian P. Owensby uses the centuries-long encounter between Europeans and the indigenous people of South America to reframe the notion of economic gain as a historical development rather than a matter of human nature. Owensby argues that gain—the pursuit of individual, material self-interest—must be understood as a global development that transformed the lives of Europeans and non-Europeans, wherever these two encountered each other in the great European expansion spanning the sixteenth to nineteenth centuries.
