Updated as of May 29, 2018 The Federal Energy Regulatory Commission is amending the transmission planning and cost allocation requirements established in Order No. 890 to ensure that Commission-jurisdictional services are provided at just and reasonable rates and on a basis that is just and reasonable and not unduly discriminatory or preferential. With respect to transmission planning, this Final Rule requires that each public utility transmission provider participate in a regional transmission planning process that produces a regional transmission plan; requires that each public utility transmission provider amend its OATT to describe procedures that provide for the consideration of transmission needs driven by public policy requirements in the local and regional transmission planning processes; removes from Commission-approved tariffs and agreements a federal right of first refusal for certain new transmission facilities; and improves coordination between neighboring transmission planning regions for new interregional transmission facilities. Also, this Final Rule requires that each public utility transmission provider must participate in a regional transmission planning process that has: A regional cost allocation method for the cost of new transmission facilities selected in a regional transmission plan for purposes of cost allocation; and an interregional cost allocation method for the cost of certain new transmission facilities that are located in two or more neighboring transmission planning regions and are jointly evaluated by the regions in the interregional transmission coordination procedures required by this Final Rule. Each cost allocation method must satisfy six cost allocation principles. These clarifications and refinements will be implemented within the Commission's existing four-factor analysis used to evaluate requests for negotiated rate authority for transmission service. The Commission will apply this policy statement on a prospective basis to filings received after this issuance. This Final Rule will improve price formation by reducing the likelihood that offer caps will suppress LMPs below the marginal cost of production, while compensating resources for the costs they incur to serve load, by enabling RTOs/ISOs to dispatch the most efficient set of resources when short-run marginal costs exceed $1,000/MWh, by encouraging resources to offer supply to the market when it is most needed, and by reducing the potential for seams issues. Book excerpt: This article examines the latest attempt of the United States' regulatory agency, the Federal Energy Regulatory Commission (FERC), to promote transmission expansion through the transmission planning and cost allocation principles contained in its recently issued Order No. 1000. It finds the level of detail contained in the order's cost allocation principles to be insufficient to achieve FERC's goals. It argues that the order does provide important principles for both transmission planning and expansion, though. It thus presents a cost allocation methodology which channels the order's strengths. Specifically, the methodology obtains an estimate of the benefits of a project and aligns the costs and benefits of the project accordingly.

Book excerpt: Following the Federal government's requirement that electric utilities allow other power generators to use their transmission lines, investment in the U.S. electric grid has faltered. The effects of underinvestment in the grid has limited the proper function of competitive energy markets, and stifled investment in renewable energy sources. The Federal Energy Regulatory Commission (the “FERC”) has allowed states belonging to planning regions that coordinate transmission development to create multiple methods for allocating the costs of new facilities crossing state lines. Many of these methods use models to forecast which customers in each state benefit from the facility, and then assign costs based on those determinations. This Note argues that the fluid nature of the modern grid defies attempts to assign costs so specifically, and that instead the only cost allocation method the FERC can allow that also complies with the 16 U.S.C. § 824d(a) requirement that rate determinations be “just and reasonable” is if it requires the costs of high-voltage interstate transmission facilities to be spread among all customers in a planning region.
