Book excerpt: This report is one of a series issued by the Special Inspector General for Iraq Reconstruction (SIGIR) that addresses transferring completed projects funded by the Iraq Relief and Reconstruction Fund (IRRF) to the Government of Iraq (GOI). It focuses on the formal transfer of IRRF-funded capital assets and follows up on prior SIGIR recommendations relating to capital asset transfer. As of May 31, 2007, the Iraq Reconstruction Management Office (IRMO), the U.S. Agency for International Development (USAID), the Multi-National Security Transition Command-Iraq (MNSTC-I), and the U.S. Army Corps of Engineers-Gulf Region Division (GRD) have managed the completion of 2,797 IRRF-funded capital construction projects valued at approximately $5.8 billion. The overall objective was to determine whether IRMO, USAID, MNSTC-I, and GRD have developed and implemented plans for the transition of IRRF-funded projects to the GOI. To meet the objective, the audit addressed these questions: (1) Have U.S. agencies involved in IRRF-funded construction projects developed adequate procedures for transitioning completed projects to the Government of Iraq?; (2) Have there been delays in transitioning projects to the Government of Iraq, and if so, what have been the cause and impact of those delays?; and (3) What is the status of actions taken in responding to prior SIGIR recommendations on transition and sustainment? The transition process comprises three steps: (1) asset recognition and transfer, (2) sustainment, and (3) capacity development. This audit focused on asset recognition and transfer. SIGIR is reporting on sustainment and capacity development in separate reviews and assessments.

In January 2006, the Special Inspector General for Iraq Reconstruction (SIGIR) reported that 2006 would be a year of transition for the U.S. reconstruction program in Iraq. This focus on transition followed SIGIR's October 2005 Report on the issue of sustainment programs for IRRF assets. SIGIR noted that progress had been hampered by the absence of a centralized sustainment office with the authority and responsibility to manage the effort across the jurisdictional boundaries of the operating agencies. In response, the Iraq Reconstruction Management Office (IRMO) established a coordinating sustainment office. By September 30, 2006, all IRRF funds will either be obligated to a contract or they will no longer be available to support relief and reconstruction projects in Iraq. As more projects are completed, the U.S. agencies and organizations that currently manage and implement the U.S. reconstruction effort should prepare to implement strategies for transitioning assets, projects and programs to the Iraqi government. A critical element of attaining end-state objectives for U.S. funded projects is a strategic plan to ensure that (1) completed projects and related assets are turned over to the appropriate Iraqi officials and (2) the Iraqi government has the capacity and resources necessary to sustain them. IRMO and the Project and Contracting Office (PCO) are the two principal organizations that are managing, overseeing and implementing the IRRF. Established as temporary organizations under National Security Presidential Directive No. 36 (May 11, 2004), IRMO's principal responsibility was "to facilitate the transition in Iraq," while PCO was established to provide acquisition and project management support. Both organizations are scheduled to sunset on May 10, 2007.

Book excerpt: A large-scale assistance program has been undertaken by the United States in Iraq since mid-2003. To date, about $49 billion has been appropriated for Iraq reconstruction. Most recently, in June 2008, Congress approved over $4 billion for Iraq reconstruction in a FY2008/2009 supplemental appropriations bill, H.R. 2642 (P.L. 110-252). The FY2009 regular foreign operations appropriations (P.L. 111-8, Division H, H.R. 1105, signed by the President on March 11, 2009) provides no economic aid to Iraq with the exception of demining assistance. Security aid and most economic aid are provided in supplemental appropriations bills. On June 28, 2004, the entity implementing assistance programs, the Coalition Provisional Authority (CPA), dissolved, and sovereignty was returned to Iraq. U.N. Security Council Resolution 1546 of June 8, 2004, returned control of assets held in the Development Fund for Iraq to the government of Iraq. U.S. economic assistance is now provided through the U.S. embassy, while security aid is chiefly managed by the Pentagon. A significant number of reconstruction activities, especially those involving construction of road, sanitation, electric power, oil production, and other infrastructure, are completed or near completion. Security concerns slowed progress and added considerable expense to these efforts. Reconstruction priorities and funding mechanisms have changed over time. The Iraq Relief and Reconstruction Fund (IRRF), the main U.S. assistance account in the first few years, is no longer available, and most large-scale infrastructure programs are no longer funded. However, many small-scale, targeted community-level infrastructure efforts are funded under the Commander's Emergency Response Program (CERP) and the Economic Support Fund (ESF). The key emphases of the aid program are the training of Iraqi forces and programs assisting the development of Iraqi governing capacities and supporting the work of the Provincial Reconstruction Teams (PRTs).

Book excerpt: After more than four years of reconstruction activity, U.S. reconstruction agencies continue to experience difficulties transferring completed projects to the Government of Iraq (GOI). GOI recognition of projects is important to ensure ongoing support for the projects, to inform its own reconstruction planning, and to leverage completed projects to obtain financing for future initiatives from world markets. This review follows up on SIGIR's earlier work to determine the following: (1) the extent to which U.S. reconstruction agencies working in Iraq have made progress in establishing a uniform policy and procedure for transferring projects to the GOI, and (2) whether the Embassy has made progress in obtaining GOI support for a formal asset-transfer agreement. SIGIR previously recommended that the Ambassador and the Commanding General, Multi-National Force-Iraq (MNF-I) take these actions: (1) Direct that a single set of policies, processes, and procedures for transferring assets be developed for use by all involved agencies and for all U.S. projects, regardless of funding source (this recommendation remains open); (2) Enter into high-level discussions with the GOI on developing a memorandum of understanding (MOU) for the transfer of assets. SIGIR is modifying this recommendation to clarify its intent that the discussions result in an MOU and it is reopening the recommendation. The U.S. Embassy-Iraq, and the U.S. Army Corps of Engineers-Gulf Region Division (GRD) provided written comments on this report. The Embassy did not concur with SIGIR's recommendations. GRD generally agreed with the facts as presented in the draft report. SIGIR continues to believe its recommendations have merit and the report details the basis for SIGIR's position.
