Book Transatlantic Defence Procurement

Download or read book Transatlantic Defence Procurement written by Luke R. A. Butler and published by Cambridge University Press. This book was released on 2017-03-02 with total page 563 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume constitutes the first ever attempt to establish a basis for comparative research on defence procurement regulation. For decades there has been repeated emphasis on the extent to which barriers to trade in Europe and the US prevent a more competitive defence market. Transatlantic Defence Procurement offers the first analysis of the potential impact of defence procurement regulation itself as a barrier to trade between the US and the EU. Part I examines the external dimension of a new EU Defence Procurement Directive, focusing on its implications for third countries, in particular the US. Part II examines foreign access and treatment under US law. Part III maps a future research agenda that is essential for a more systematic understanding of legal barriers to transatlantic defence trade. The book provides context for future initiatives, ranging from reformed market access arrangements to a Defence Transatlantic Trade and Investment Partnership and beyond.

Book European Commission Proposes Expanding the European Defence Fund A Major Potential Barrier to Transatlantic Defense Procurement

Download or read book European Commission Proposes Expanding the European Defence Fund A Major Potential Barrier to Transatlantic Defense Procurement written by Christopher R. Yukins and published by . This book was released on 2018 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Commission (EC) has proposed expanding the European Defence Fund, an initiative to fund defense technology developed in Europe. As a general matter, only European firms would have access to the fund for development, and participating European nations would need to commit themselves to purchasing the defense materiel developed under the fund. In effect, this could lock U.S. firms out of billions of euros worth of European defense procurement over the coming years--despite long-standing reciprocal agreements under which the U.S. and its European allies agreed to open their defense markets. The fund was announced quietly last year and now, in the shadow of a trade war launched by the Trump administration, has evolved into a substantial potential barrier in the transatlantic defense market, and potentially another brick in a rising wall of protectionism between the U.S. and Europe.

Book Differing Perspectives on Defence Procurement

Download or read book Differing Perspectives on Defence Procurement written by Daniel Schoeni and published by . This book was released on 2020 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Freer trade in transatlantic public procurement will be possible only if greater understanding of the two systems is achieved. One of the fundamental differences between the two is their composition of purchases: whereas in U.S. federal procurement 70-80% of purchases are military, defense composes less than .3% of the purchases of Members States' purchases covered under any of the EU's procurement directives. This disparity explains the two systems' distinct procurement procedures. Each is designed to purchase different types of goods and services -- the former defense equipment, and the latter products that can be distinguished on the basis of price. This has ramifications beyond defense, and a better understanding of this question would enable more liberal procurement trade between the U.S. government and the European Union.

Available in PDF, EPUB and Kindle. Book excerpt: Buying Defence and Security in Europe is the first critical evaluation of the EU Defence and Security Procurement Directive 2009/81/EC, which is now the basis for public and private entities buying armaments and sensitive goods and services in the EU. This instrument aims to ensure non-discrimination, competition and transparency in the security sectors. Part one provides a critical analysis of the economical, historical, political, military-strategic and legal contexts of the new EU Defence and Security Procurement Directive. Part two covers the main aspects of the Directive: its scope, procedures, security of supply and information, offsets and subcontracting, and finally its review and remedies system. This book is an essential overview of a legislative milestone in the field.

Book Towards a European Defence Market

Download or read book Towards a European Defence Market written by Erkki Aalto and published by . This book was released on 2008 with total page 132 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU governments are gradually coming around to the idea that they need to open up their defence markets, especialy at a time when growing budgetary constraints clash with the increasing need for sophisticated equipment. Governments have alreadyi agreed to the Code of Conduct on Defence Procurement introduced by the European Defence Agency in July 2006, but the EDA cannot force governments to comply with the code. Also, the protectionist attitude of Member States derives from the fact that they regard defence procurement as an area that overlaps with national sovereignty. The European Commission is currently proposing new procurement and trade directives aimed at streamlining defence market legislation, and it is to be hoped that Member States will respond positively to this initiative. The proposed directives would open up the defence market, improve European cooperation on armaments and lead to a more competitive European defence industry. Plus, in the ongoing debate about the European defence market, the transatlantic defence market should not be forgotten, especially given the increasingly important role that American and European companies play in this arena on both sides of the pond--P. Book The European Defense Procurement Directive

Download or read book The European Defense Procurement Directive written by Christopher R. Yukins and published by . This book was released on 2009 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: On August 21, the new European directive on defense and security procurement, Directive 2009/81/EC, entered into force. See, e.g.,EU Adopts New Defense and Security Procurement Directive, 6 IGC ¶ 65. Previously, most European defense procurement was considered exempt from the European procurement directives that have harmonized procurement, with greater transparency and competition, across Europe. Under the new defense directive, all but the most sensitive defense and security procurements in Europe will have to be conducted under rules consistent with the new directive. From an American vantage point, however, it is not yet clear how the new directive will be implemented. If the defense directive merely brings new competition and transparency to the European procurement markets, the directive will be a welcome improvement in what was traditionally a closed and uncompetitive market. But if, in practice, the directive is used as an excuse to discriminate against U.S. exporters - or if it is perceived as a tool of discrimination - the directive threatens to trigger serious trade frictions in the transatlantic defense markets.

Book On the Non Tariff Barriers Obstructing Free Trade in the Transatlantic Defense Procurement Market

Download or read book On the Non Tariff Barriers Obstructing Free Trade in the Transatlantic Defense Procurement Market written by Daniel Schoeni and published by . This book was released on 2020 with total page 51 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Transatlantic Trade and Investment Partnership (TTIP) promises to liberalize trade between the European Union and the United States. Although the negotiations have so far excluded defense, this essay considers what would happen if a TTIP removed overt restrictions. What barriers would remain? Sue Arrowsmith has observed that the unfamiliarity of a foreign government's public procurement regimes can create "structural restrictions" and Steve Schooner and Chris Yukins have in turn observed that such structural restrictions can "raise practical barriers to entry as foreign vendors run headlong into dense and alien procurement regimes." This essay diagnoses some of these subtle barriers and prescribes remedies to foster greater cross-border competition in transatlantic defense procurement.

Book The transatlantic defense industrial base

Download or read book The transatlantic defense industrial base written by Terrence R. Guay and published by . This book was released on 2005 with total page 34 pages. Available in PDF, EPUB and Kindle. Book excerpt: Opportunities for the construction of a transatlantic defense sector are tangible, but significant obstacles may accelerate the formation of a bipolar industrial base. While market forces played a key role in the transformation and consolidation of these sectors in recent years, political considerations are largely responsible for a restructuring process that has been almost entirely among U.S. firms in the United States and among European Union companies in Europe. In this monograph, Dr. Terrence Guay examines the forces that have shaped the restructuring of the U.S. and European defense industries since the end of the Cold War, and presents factors that will influence further restructuring and consolidation in the short- and medium-terms. He contends that a transatlantic defense industrial base is preferable to a bipolar one, and recommends that the U.S. Government open its defense equipment market to more European firms, and that European governments reciprocate. Additionally, military forces should put greater effort into coordinating procurement requirements and needs, and firms should explore expanding transatlantic links.

Book The European Security and Defense Policy

Download or read book The European Security and Defense Policy written by Robert E. Hunter and published by Rand Corporation. This book was released on 2002-04-29 with total page 207 pages. Available in PDF, EPUB and Kindle. Book excerpt: The emergence of the European Security and Defense Policy (ESDP) in the last two-thirds of the 1990s and continuing into the new century, has been a complex process intertwining politics, economics, national cultures, and numerous institutions. This book provides an essential background for understanding how security issues as between NATO and the European Union are being posed for the early part of the 21st century, including the new circumstances following the terrorist attacks in New York and Washington on September 11, 2001. This study should be of interest to those interested in the evolution of U.S.-European relations, especially in, but not limited to, the security field; the development of institutional relationships; and key choices that lie ahead in regard to these critical arrangements.

Book No TTIP ing Point for European Defence

Download or read book No TTIP ing Point for European Defence written by Daniel Fiott and published by . This book was released on 2014 with total page 2 pages. Available in PDF, EPUB and Kindle. Book excerpt: The EU-US Summit on 26 March will mark eight months since the partners decided to formally launch negotiations on a Transatlantic Trade and Investment Partnership (TTIP). The aim of the TTIP - if finalised - is to remove tariffs, align regulatory standards and open up government procurement. Born out of the need to boost economic growth on both sides of the Atlantic and to respond to the rise of emerging markets, the Partnership will add an extra €120 billion to the EU economy annually, according to estimates by the European Commission. While President Obama's first visit to Brussels will likely be dominated by an agenda focusing on Ukraine and economic recovery, it is also worth thinking about some of the more sensitive areas involved in the TTIP discussions. One such area relates to defence industry and markets. Back in June 2013, public procurement of defence and security goods was included in the Commission's negotiating mandate. Given the sensitive nature of defence procurement, however, both sides have, for the time being, agreed to drop a 'defence TTIP'. This situation is indicative of a broader negotiating environment that has seen a moratorium on including an investment chapter in the Partnership and other sectoral exclusions. Therefore, at first glance, the TTIP's overarching aims of abolishing tariffs, enhancing the compatibility of the EU and US regulatory environment and ensuring a greater flow of goods, services and investments in the transatlantic space will not apply to the defence sector. But is this necessarily the end of the story?

Book Joint Public Procurement and Innovation

Download or read book Joint Public Procurement and Innovation written by Gabriella Margherita Racca and published by Bruylant. This book was released on 2020-02-12 with total page 534 pages. Available in PDF, EPUB and Kindle. Book excerpt: Innovation in public procurement is essential for sustainable and inclusive growth in an increasingly globalized economy. To achieve that potential, both the promises and the perils of innovation must be investigated, including the risks and opportunities of joint procurement across borders in the European Union and the United States. This in-depth research investigates innovation in public procurement from three different perspectives. First, leading academics and practitioners assess the purchase of innovation, with a particular focus on urban public contracting in smart cities involving meta-infrastructures, public-private partnership arrangements and smart contracts. A second line of inquiry looks for ways to encourage innovative suppliers. Here, the collected authors draw on emerging lessons from the US and Europe, to explore both the costs and the benefits of spurring innovation through procurement. A third perspective looks to various innovations in the procurement process itself, with a focus on the effects of joint and cross-border procurement in the EU and US landscapes. The chapters review new technologies and platforms, the increasingly automated means of selecting suppliers, and the related efficiencies that “big data” can bring to public procurement. Expanding on research in the editors’ prior volume, Integrity and Efficiency in Sustainable Public Contracts: Balancing Corruption Concerns in Public Procurement Internationally (Bruylant 2014), this volume builds on a series of academic conferences and exchanges to address these issues from sophisticated academic, institutional and practical perspectives, and to point the way to future research on the contractual models that are emerging from new procurement technologies.
