Book excerpt: Post-1994, South Africa's traditional leaders have fought for recognition, and positioned themselves as major players in the South African political landscape. Yet their role in a democracy is contested, with leaders often accused of abusing power, disregarding human rights, expropriating resources and promoting tribalism. Some argue that democracy and traditional leadership are irredeemably opposed and cannot co-exist. Meanwhile, shifts in the political economy of the former bantustans − the introduction of platinum mining in particular − have attracted new interests and conflicts to these areas, with chiefs often designated as custodians of community interests. This edited volume explores how chieftancy is practised, experienced and contested in contemporary South Africa. It includes case studies of how those living under the authority of chiefs, in a modern democracy, negotiate or resist this authority in their respective areas. Chapters in this book are organised around three major sites of contest: leadership, land and law.

Set against a backdrop of widespread security threats – including insurgency, land disputes, communal violence, regional independence movements, and widespread criminal activities – perhaps more than ever before, Nigeria’s conventional security infrastructure seems ill-equipped for the job. This book offers a fresh, empirical analysis of the roles of traditional authorities – including kings, Ezes, Obas, and Emirs – who are often hailed as potent alternatives to the state in security governance. It complicates the assumption that these traditional leaders, by virtue of their customary legitimacy and popular roots, are singularly effective in preventing and managing violence. Instead, in exploring their creative adaptation to governance roles after a dramatic postcolonial downturn, this book argues that traditional leaders can augment, but not substitute, the state in addressing insecurity. This book’s in-depth analysis will be of interest to researchers and policy makers across African and security studies, political science, anthropology, and development. David Ehrhardt is an Associate Professor of International Development at Leiden University, The Netherlands. His main research interests are African governance and educational innovation. David has published extensively on Nigeria and co-leads the Learning Mindset project that promotes autonomous learning in higher education. David Oladimeji Alao is a Professor in the Department of Political Science and Public Administration, and Chief of Staff to the President/Vice Chancellor, Babcock University, Ogun State, Nigeria. Professor Alao has authored several articles and 3 edited books. M. Sani Umar is a Professor in the Department of History and Diplomatic Studies, University of Abuja, Nigeria. This discussion paper addresses some fundamental questions pertaining to the 2002 official recognition of traditional leaders as community authorities. After a brief history of the changing role of, and faith in, traditional authorities as a basis for understanding the importance of their recent official recognition, the paper outlines the key objectives of the Decree 15/2000 that officially recognizes community authorities. Some of the key concepts underpinning the Decree are then critically assessed. It is argued that the double role that community authorities are expected to fulfill as both community-representatives and state-assistants is not equally balanced in the Decree: the scale tips heavily towards the state-assistance aspect. The reasons for this are explored in the context of a set of reified notions underpinning the Decree, such as its understanding of "traditional rules" and the concept of "community." The paper concludes by pointing out some unintended consequences of these reified notions for kin-based forms of community authority and especially for the ideal of community participation.

Freely translated, this proverb of the Ovakwanyama of northern Namibia means: "New leaves produce a good shade; the laws of a king are always as good as new". The proverb paints a picture of wisdom to express the dialectical relationship between continuity and change in customary law. Since royal orders are supposed not to change from one king to the next, they are always as good as new, reads the explanatory note to the proverb by the anthropologist Loeb, who recorded the proverb. Traditional authority is like a tree standing on its roots, rooted in the tradition created by the ancestors of the ruler and the community. These roots remain firm, stable and unchanged, not so the concrete manifestation of authority that changes and responds to changes of the environment. This makes that new leaves are produced by the rooted tree. The new leaves are new and old. They are old, because in structure, colour and their capacity to protect by giving shade, they are more or less like the leaves of last year and the year before; they are new because they react to the challenge of seasons. The Shade of New Leaves emerged out of an international conference on the living reality of customary law and traditional governance held in Windhoek in 2004. The conference was organised by the Centre for Applied Social Sciences and the Human Rights and Documentation Centre, both affiliated to the Faculty of Law of the University of Namibia, in co-operation with the Law Departments of the Universities of Bremen, Germany, and the School of Oriental and African Studies, University of London. Book excerpt: When the notion of ‘alternative facts’ and the alleged dawning of a ‘postfactual’ world entered public discourse, social anthropologists found themselves in unexpectedly familiar territory. In theirempirical experience, fact—knowledge accepted as true—derives its salience from social mechanisms of legitimization, thereby demonstrating a deep interconnection with power and authority. In thisperspective, fact is a continually contested and volatile social category. Due to the specific histories of their colonial and post-independence experience, African societies offer a particularly broad array of insights into social processes of juxtaposition, opposition, and even outright competition between different postulated authorities. The contributions to the present volume explore the variety of ways in which authority is contested in Southern and Eastern Africa, investigating localized discourses on which institution, what kind of knowledge, or whose expertise is accepted as authoritative, thus highlighting the specificities and pluralities in ‘modern’ societies. This edited volume engages with larger theoretical questions regarding power and authority in the context of (post)colonial states (neo)traditional authority, claiming space, conflict and (in)justice, and contestations of knowledge. It offers in-depth critical analyses of ethnographic data that put contemporary African phenomena on equal footing with current controversies in North America, Europe, and other global settings.

Book excerpt: The Paradox of Traditional Chiefs in Democratic Africa shows that unelected traditional leaders can facilitate democratic responsiveness. Ironically, chiefs' undemocratic character gives them a capacity to organize responses to rural problems that elected politicians and state institutions lack. Specifically, chiefs' longer time horizons encourage investment in local institutions that enable the provision of local public goods. This is the paradox of traditional chiefs in democratic Africa: elected politicians can only effectively respond to rural constituents through institutions constructed and maintained by local leaders who are not worried about electoral terms. Furthermore, the critical role played by chiefs in brokering local development projects forces us to reassess how we understand the basis of their political influence during elections. The book examines the effects of traditional leaders on the electoral connection in Africa through a multi-method approach that combines qualitative research, surveys, and experiments, with particular attention to the Zambian case.
