Book Trade Unions and Collective Bargaining in the Netherlands

Download or read book Trade Unions and Collective Bargaining in the Netherlands written by Rob van de Wijngaert and published by Purdue University Press. This book was released on 1994 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: Only twenty years ago economists believed that the problem of modelling trade union behavior was almost intractable. Recently the economic theory of trade unions has experienced a remarkable revival. This study focuses on modern theories of collective bargaining. It addresses the problem whether these theories constitute useful and appropriate tools for analyzing the impact of trade unions on the wage formation process in The Netherlands. The Dutch industrial relations and labor market institutions may impose certain restriction on the applicability of collective bargaining theory. The study analyzes the way in which the outcome of bargaining is affected by the linking mechanism between private sector wages and unemployment benefits. It also discusses the relatively long duration of wage negotations. Furthermore, it couples the typical consensus attitude of the labor market p parties to wage bargaining and the low record of industrial disputes in The Netherlands.

Book Collective Bargaining Through the Magnifying Glass

Download or read book Collective Bargaining Through the Magnifying Glass written by Alexander Hijzen and published by International Monetary Fund. This book was released on 2017-12-14 with total page 42 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the global financial crisis, sector-level bargaining has come under renewed scrutiny. While in Southern Europe, the crisis raised concerns about the role of collective bargaining as an obstacle to labor market adjustment, in Northern Europe it was perceived more favourably and, according to some, may even have helped to weather the fallout of the crisis more easily. This paper seeks to contribute to a deeper understanding of sector-level bargaining systems and their role for labor market performance. We compare two countries with seemingly similar collective bargaining systems, the Netherlands and Portugal, and document a number of features that may affect labor market outcomes, including: i) the scope for flexibility at the firm or worker level within sector-level agreements; ii) the emphasis on representativeness as a criterion for extensions; iii) the effectiveness of coordination across bargaining units; and iv) pro-active government policies to enhance trust and cooperation between the social partners.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph on the Netherlands not only describes and analyses the legal aspects of labour relations, but also examines labour relations practices and developing trends. It provides a survey of the subject that is both usefully brief and sufficiently detailed to answer most questions likely to arise in any pertinent legal setting Both individual and collective labour relations are covered in ample detail, with attention to such underlying and pervasive factors as employment contracts, suspension of the contracts, dismissal laws and covenant of non-competition, as well as international private law. The author describes all important details of the law governing hours and wages, benefits, intellectual property implications, trade union activity, employers’ associations, workers’ participation, collective bargaining, industrial disputes, and much more. Building on a clear overview of labour law and labour relations, the book offers practical guidance on which sound preliminary decisions may be based. It will find a ready readership among lawyers representing parties with interests in the Netherlands, and academics and researchers will appreciate its value in the study of comparative trends in laws affecting labour and labour relations.

Book Collective Bargaining and Wages in Comparative Perspective

Download or read book Collective Bargaining and Wages in Comparative Perspective written by Roger Blanpain and published by Kluwer Law International B.V.. This book was released on 2005-01-01 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: Remarkably, the core element of labour relations?wage determination?has been excluded from the European social dialogue about harmonisation of working conditions and national systems of social security. The present study responds by analysing the prospects of building up structures of wage formation in Europe through a reevaluation of collective bargaining and collective agreements as they exist under the law of the most industrialized Member States. The impetus for the study is the widely debated crisis of the system of concluding regional collective agreements on wages. Social partners seem to have been trapped in fruitless conflicts on how the system must be reformed. It has become obvious that no party concerned employers, trade unions, the state has the capacity to resolve the growing difficulties of collective wage formation. In an introductory essay by the distinguished editors, this important study takes the situation in Germany, the most prominent manifestation of this European crisis, as its starting point. Then, academic experts from France, the United Kingdom, the Netherlands, and Sweden describe comparable problems in their own countries, detail approaches to dealing with them, and provide a critical commentary, including judgements and suggestions in relation to the German case. Then follows a reexamination of the situation in Germany in the light of the experience of the other countries. A final chapter outlines some preliminary interpretations of European prospects. Salient issues investigated include the following: the erosion of such ideological and legal categories and concepts as `dependent work, `solidarity', `subsidiarity' and `social self-regulation' as preconditions of traditional collective bargaining structures at national level; the decreasing membership of the bargaining partners on both sides; the shrinking rate of employees covered by collective agreements; attempts to establish a national social pact; increasing competition on global markets; decentralizing management strategies, including the abandonment of collective bargaining; and, individualized employees. The authors examine the various state structures to determine if the legal and institutional developments of the different national systems of collective bargaining constitute starting points for mutual learning in order to meet the new challenges. This leads to a discussion of which practices are successful in their original environment, and how these practices might adapt to other systems in other countries.

Book The Evolving Structure of Collective Bargaining in the Netherlands

Download or read book The Evolving Structure of Collective Bargaining in the Netherlands written by Evert Verhulp and published by . This book was released on 2011 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: In the Netherlands collective bargaining between employers and employees is stimulated by legislation. Agreements reached through consultation between employers or employers' associations and one or more trade unions are explicitly favoured by the legislator. An arrangement based on a collective labour agreement (CLA) can emerge without the cooperation of a trade union. This may be the case if a works council is involved. Such arrangements are valued differently to CLAs, and will not automatically be incorporated in an employment contract.

Book Trade Unions in Western Europe

Download or read book Trade Unions in Western Europe written by Rebecca Gumbrell-McCormick and published by Oxford University Press, USA. This book was released on 2013-09 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: « The book presents the findings of a four-year study of the challenges facing trade unions and their responses in ten west European countries. The project involved a substantial number of interviews with key union representatives and academic experts in each country, together with the collection of a large amount of union documentation and background material. The book gives an account of trade unionism in each country, the main recent challenges that unions have faced, and responses in terms of recruitment and mobilisation; organizational restructuring; new approaches to collective bargaining; changing political strategies; and international activities. The analytical starting point is that trade unions are conservative institutions containing significant veto points to organizational change, but at the same time can display dynamism and innovation, and that external challenges can therefore stimulate important internal adaptation. The book engages with the debates of the past two decades on union modernization and revitalization, and more generally with theories of institutional change and with the literature on varieties of capitalism. The central theme is that while trade unions do not easily change identities and core practices, they are not locked into inertia. Trade unions are not unitary actors but are internally contested organizations, and internal conflict is itself a potential source of dynamism. The literature on "revitalization" has tended to divide between the over-optimistic and the over-pessimistic; this study presents a more nuanced and differentiated account. In particular, it attempts to identify some of the key internal and external conditions for effective strategic innovation. »--

Book Trade Union Rights at the Workplace

Download or read book Trade Union Rights at the Workplace written by Roger Blanpain and published by Kluwer Law International B.V.. This book was released on 2012-01-01 with total page 122 pages. Available in PDF, EPUB and Kindle. Book excerpt: "For employees, collective protection has never been more urgent. Everywhere, pressures resulting from worldwide competition and technical innovation are downgrading and relocating jobs, closing companies, and fuelling workers' fears of less-than-secure working conditions, de-qualification, and job loss. More and more, trade unions confront the challenge of asserting their rights across borders. However, in order to establish the necessary preconditions for any transnational solidarity, it is necessary to define and clarify both what is distinctive and what is fundamental in the different legal frameworks affecting trade union activity. That is what this book sets out to do. The essays presented here are an outcome of an international and comparative conference, organised and sponsored by the newly established Hugo Sinzheimer Institute of Labour Law (HSI), Frankfurt am Main, which took place in Frankfurt in January 2011 at the premises of IG Metall, the world's largest trade union. The book offers an overview of trade union rights in each of seven industrial countries: Belgium, Hungary, England, Germany, France, the Netherlands and the United States. A concluding chapter by Manfred Weiss notes the futility of a 'harmonization' approach, stressing rather a strategy of accepting variety which nevertheless embraces close cooperation. Issues covered include the following: direct and indirect recognition of the rights of the unions at the workplace; the right of access of trade union representatives not employed in the establishment; competition from non-unionized firms and low labour cost operations; new styles of management hostile to trade unions; employers' use of the courts to prevent industrial action illegalized by new legislation; relations among trade unions, works councils, workers' representatives, and employers' organizations; the role of the union at a time of change of company ownership; and effects of public resistance to cuts in public services and to job losses. At a time when the protection of the global 'voice' of workers is of the utmost importance, sensitivity to existing cultural differences is crucial to effective international engagement and cooperation among trade unions. As an important contribution in this respect, this book will be of great value to labour and employment lawyers and other professionals involved in law and policy affecting labour and industrial relations."--Publisher's website.
