Book excerpt: IP owners decry that their copyrights and trademarks are routinely infringed in the Russian market, with little possibility for relief. Russia's recent accession to the WTO means that its laws must conform to the Agreement on Trade-Related Aspects of Intellectual Property, in theory helping to safeguard foreign intellectual property. However, skeptics note that China, another recent accession, continues to overlook much IP infringement despite the TRIPS Agreement and WTO Dispute Settlement Body actions against it. This paper analyzes similarities and differences between attitudes towards IP, economic goals, and state economic involvement in Russia and China to predict whether the World Trade Organization will actually improve IP enforcement in Russia.

Book excerpt: The Trade-Related Aspects of Intellectual Property Rights (TRIPs) is one of the multilateral treaties adopted at the end of the Uruguay Round in 1994. The Agreement establishes the requirements that the laws of the member states must meet in order to protect intellectual property in all its forms: copyright, patents, trademarks, geographical indications, industrial design. The agreement represents an attempt to overcome the differences in the way member states protect IPRs, in order to bring them under common international rules. Chinese Government adopted Patent, Copyright and Trademark Laws, and joined the main intellectual property international conventions. None of these, though, can be compared, as far as completeness, orderliness and far-reaching consequences are concerned, to the TRIPS agreement, which China has now to deal with, after its accession to the WTO.

Book excerpt: The Chinese government's inability to enforce international laws on Intellectual Property Rights (IPR) is a growing concern for United States (US) policy makers. Our government's policy on IPR with respect to China must be modified to ensure our national strategy objective of growing free and fair intentional trade is achieved without undue harm to either the Chinese or US economies. After a brief overview of the relevant background, three policy options are presented and analyzed leading to a recommended policy called Hard industry Enlightenment. Intellectual property refers to the creations of the human mind. Intellectual Property Rights (IPR) are the rights given to individuals over those creations. Those rights are typically defined into two main areas: Industrial property, which includes inventions (patents), trademarks, industrial designs, and geographic indications of source; and Copyright, which includes literary and artistic works such as novels, poems and plays, films, musical works, artistic works such as drawings, paintings, photographs and sculptures, and architectural designs. The concept of IPR is a strictly a modern product of European thought which began to coalesce during the 18th century. As the industrial revolution created the need to protect this new form of wealth generation, especially from one's economic rivals, the European nation states began to enter into an evolving series of IPR treaties starting in 1870. That evolution has culminated in the current World Trade Organization (WTO) Trade Related Aspects of Intellectual Property Rights (TRIPS) agreement. TRIPS is the standard by which all WTO countries define, enforce, and resolve disputes on IPR.

China's engagement with the western construct of intellectual property rights is strongly aligned with China's international trade relations. In particular, this article will consider the influence of the inquiries into transparency that followed China's first review after accession to the WTO and then the dispute resolution process initiated by the United States specifically on issues of intellectual property enforcement. Despite the numerous international treaties and agreements on intellectual property rights that exist and to which China acceded in the early days of the Open Door Policy period, it was the need to become a member of the WTO and with that the expectation of compliance with the prescriptive requirements found in the WTO Agreement on Trade Related Aspects of Intellectual Property Rights ('the TRIPS Agreement') that provided the greatest influence on the shaping of China's intellectual property regime today. Recent developments highlight a counterpoint in China's engagement with the TRIPS Agreement. This is indicated in China's willingness to align itself with the views of developing nations in the way that the TRIPS Agreement is interpreted and this is most evident in the recent Patent Law amendments which demonstrate China's desire to be an innovator, not a copier.

Book excerpt: This paper builds China's intellectual property protection strength from the aspects of intellectual property legislation protection strength and law enforcement protection strength, and calculates by using the actual data from 1985 to 2010. The results show that China's intellectual property protection strength has always been enhanced, and Chow test shows that the structural breakpoints appeared in China's intellectual property protection strength in 2001(when China joined TRIPS Agreement). The further Granger causality test shows that the economic development level and technological innovation ability are the factors promoting China's intellectual property protection strength, which, however, has not effectively promoted economic development and technological innovation ability due to the impact of the overall economic development level.

Despite internal and external pressure on Beijing to improve its standard of IPR protection, it remains the target of Western criticism for lax enforcement. Questioning the contemporary mainstream concept of intellectual property (IP), this study identifies alternative approaches to knowledge sharing that could address the needs of a developing country such as China. It argues that open IP initiatives could address some IPR problems within the Chinese context. They also could help to bridge the gap between developed countries like the U.S. and developing countries like China which have different perspectives on intellectual property.
