Such an agreement is intended to open markets to competition between the partners more than ever before in sectors ranging from goods and services to investment, and includes rigorous rules in the fields of intellectual property, labour protection and environmental conservation. The TPP also aims to improve regulatory coherence, enhance production supply chains and help boost small and medium-sized enterprises. It could transform relations with regions such as Latin America, paving the way to an eventual Free Trade Area of the Asia Pacific, or see innovations translated into the global trade regulatory system operating under the WTO. However, given the tensions between strategic and economic concerns, the final deal could still collapse into something closer to a standard, 'twentieth-century' trade agreement.

For most of the advanced countries, trade has raised standards of living, while for most emerging economies, growth did not begin until their integration into the global economy. The economic explanation is simple: international trade facilitates specialization, increased efficiency and improved productivity to an extent impossible in closed economies. However, recent years have seen a significant slowdown in global trade, and the global system has increasingly come under attack from politicians on the right and on the left. The benefits of open markets, the continuation of international co-operation, and the usefulness of multilateral institutions such as the World Trade Organization (WTO), the International Monetary Fund and the World Bank have all been called into question. While globalization has had a broadly positive effect on overall global welfare, it has also been perceived by the public as damaging communities and social classes in the industrialized world, spawning, for example, Brexit and the US exit from the Trans-Pacific Partnership. The purpose of this volume is to examine international and regional preferential trade agreements (PTAs), which offer like-minded countries a possible means to continue receiving the benefits of economic liberalization and expanded trade. Book excerpt: The Trans-Pacific Partnership Agreement ('TPP'), which was signed in November 2015 by the United States, Japan, Canada, Mexico, Peru, Chile, Brunei, Malaysia, Singapore, Australia, New Zealand, and Vietnam, is arguably the most significant trade and international investment protection deal since the creation of the European single market. The TPP was intended to establish a free trade area in the Asia-Pacific that accounts for nearly 40 percent of global GDP and a third of global trade. While the TPP was eventually not ratified following the U.S. administration's announcement in January 2017 that it will not ratify the treaty, the other original TPP signatories concluded the Comprehensive and Progressive Agreement for Trans-Pacific Partnership ('CPTPP'), which adopted the most of the TPP's provisions.The politics of the widespread skepticism towards the TPP and other international investment agreements ('IIAs') is complex and widely debated. This article focuses on one issue that has played an important role in framing the debate on the TPP: the potential impact of the TPP on States' right to regulate for the public welfare under international investment law.The article concludes that the TPP's Investment Chapter is evolutionary in its approach to foreign investment protection, and continues the recent trend in IIA practice to include language intended to safeguard host States' legitimate public welfare objectives. Although the TPP's Investment Chapter may not be radical, its provisions arguably reinforce the legal foundation for States' right to regulate for the public welfare without incurring liability under international investment law. This may not, however, be enough to satisfy increasingly skeptical politicians and citizens of the merits of ratification.

Book excerpt: The Trans-Pacific Partnership is no ordinary free trade deal. Billed as an agreement fit for the 21st century, no-one is sure what that means. The US sells it as the key to jobs and economic recovery, while protecting home markets. Australia hails it as a foundation stone for an APEC-wide free trade agreement. New Zealand sees it as a magic bullet to open the US dairy market. None of these arguments stacks up. Seven of the eight participant countries: the US, Australia, New Zealand, Brunei Darussalam, Chile, Peru, Singapore and Vietnam are heavily liberalised, deregulated and privatised. They already have twelve free trade deals between them. No-one really believes that US dairy markets will be thrown open to New Zealand, or that China, India and Japan will sign onto a treaty they had no role in designing. Experts from Australia, New Zealand, the US and Chile examine the geopolitics and security context of the negotiations and set out the costs of making trade-offs to the US simply to achieve a deal. They argue its obligations will intrude into core areas of government policy and parliamentary responsibilities, including foreign investment, pharmaceutical schemes, food standards and intellectual property laws. Above all, No Ordinary Deal exposes the contradictions of locking our countries even deeper into a neoliberal model of global free markets - when even political leaders admit that this has failed.

It contrasts the main rules of origin provisions of the three free trade agreements, then discusses differences and commonalities in how they were drafted. The study examines the stringency and leniency of RCEP PSRO relative to CPTPP and ATIGA and identifies where PSRO among the three are converging. Initial findings provide the basis for policy recommendations to help leverage RCEP to simplify rules of origin in Asia and the Pacific.
