Updated as of May 29, 2018 On May 5, 2009, the Economic Development Administration ('EDA') published a notice of proposed rulemaking to reflect the amendments made to the Trade Act of 1974, as amended, by the Trade and Globalization Adjustment Assistance Act of 2009 ('TGAAA'), which was included as subtitle I within the American Recovery and Reinvestment Act of 2009. The notice of proposed rulemaking provided a public comment period from May 5, 2009 through June 4, 2009. The TGAAA provides that the Secretary of Commerce must establish the Community Trade Adjustment Assistance Program by August 1, 2009, under which EDA would provide technical assistance under section 274 of the Trade Act to communities impacted by trade to facilitate the economic adjustment of those communities. The TGAAA amendments to the Trade Act took effect on May 17, 2009, 90 days after enactment. As a result of the enactment of the TGAAA, EDA promulgates this final rule to provide regulations to implement the Community Trade Adjustment Assistance Program and makes specific changes to the Trade Adjustment Assistance for Firms Program regulations. Book excerpt: "Why GAO Did This StudyThe Trade and Globalization Adjustment Assistance Act of 2009 (TGAAA), part of the American Recovery and Reinvestment Act of 2009, authorized assistance to communities, workers, farmers, and firms affected by trade. One such program, the Trade Adjustment Assistance Community College and Career Training grant program, is administered by Labor and authorizes grants to eligible institutions of higher education for educational or career training programs suitable for trade-affected workers. Total grant funding is $2 billion for 4 years and the first round of grants was awarded in September 2011. The TGAAA requires GAO to examine the operation and effectiveness of the changes made by the act to this program. GAO examined how Labor (1) designed and awarded the grants and to what extent it complied with applicable requirements; (2) monitors the grants and what is known about implementation to date; and (3) plans to evaluate the program. GAO reviewed a nongeneralizable sample of 32 grant applications based on funding status, total scores, and total grant amounts; grantees' quarterly reports; and relevant federal laws, regulations, policy and guidance; and interviewed federal and state officials.What GAO RecommendsGAO recommends that Labor take steps to more effectively manage its process when states must designate grantees by, for example, building in additional lead time or providing states"

Book excerpt: " Over the past decade, U.S. imports of goods and services have almost doubled, reaching $2.7 trillion in 2011. Although trade expansion can enhance economic welfare, many firms and workers experience difficulties adjusting to import competition. The TAA for Firms program assists tradeimpacted, economically distressed U.S. firms in making adjustments that may enable them to remain competitive in the global economy. The Department of Commerce's EDA administers the $15.8 million program through 11 TAA Centers throughout the United States. In 2009, the Trade and Globalization Adjustment Assistance Act, as part of American Recovery and Reinvestment Act, amended the TAA for Firms program and mandated that GAO review its operation and effectiveness. GAO examined (1) the results of the legislative changes on program operations and participation, (2) the performance measures and data EDA uses to evaluate the program and what these tell us about the program's effectiveness, and (3) how program funding is allocated and spent. GAO reviewed pertinent legislation, program documentation, and data; conducted an economic analysis and a survey of participant firms; and met with EDA officials, representatives of the 11 TAA Centers, and others. "

The department's TAA for Farmers program provides technical and financial assistance to producers of commodities certified by USDA as eligible for assistance. The Trade and Globalization Adjustment Assistance Act of 2009 reauthorized and amended the program and directed GAO to prepare and submit a report on the operation and effectiveness of the amendments. In particular, GAO examined (1) the commodities and producers USDA approved for assistance and the type and amount of assistance it provided, and (2) the approach USDA is taking to evaluate the program's effectiveness and limitations, if any, in this approach. GAO analyzed USDA data and documents; interviewed USDA officials, their academic partners, producer groups, and commodity experts; and conducted fieldwork in two states to meet with producer groups for certified commodities."

[...] In the case of firm that shifts production to a foreign country, certification requires: • A significant number of workers6 are laid off or threatened with layoffs; • Either (1) a shift by the workers' firm to a foreign country of the production of articles or services like or directly competitive with those produced by the workers' firm, or (2) the workers' firm has acquired the articles or servi [...] In the case of a firm that does not shift production to a foreign country, certification requires • A significant number of workers are laid off or threatened with layoffs; • The sales or production of the firm decreased; and • Increased imports of (1) articles or services competitive with the firm's articles or service or (2) articles which are competitive with the articles in which the firm's pr [...] In the case of adversely affected secondary workers, certification requires • A significant number of workers are laid off or threatened with layoffs; • The workers' firm is a supplier or downstream producer to a TAA-certified firm; and • Either (1) the sales or production to the TAA-certified firm accounted for at least 20% of the sales or production of the supplier firm or (2) the loss of sales.
