Book excerpt: The Trade Act of 2002 significantly amended the Trade Adjustment Assistance (TAA) program which provides extensive training and benefits to dislocated workers certified as trade-affected. The Act created a single program (repealing the North American Free Trade Agreement-TAA program), mandated that certification of workers' petitions occur in 40 (down from 60) days by the U.S. Department of Labor, and instituted new deadlines for enrolling in training by 8 weeks after certification or 16 weeks after job separation. Among other changes, the law also opened eligibility to secondary workers, offered a tax credit to partially cover health insurance, created the Alternative TAA (ATAA) program to provide compensation to older participants who obtain lower-paid work but no training. To understand the issues and challenges in implementing the Trade Act of 2002, site visits were conducted in May and June of 2004 in 12 state agencies (selected randomly proportionate to size of states' TAA activity) and in 12 local offices. This report is part of a longer-term project to conduct a national net-impact evaluation of the Trade Adjustment Assistance (TAA) program.

Book excerpt: One of the major trade issues in the 107th Congress was whether or not Congress would approve trade promotion authority (formerly called fast-track authority) for the President to negotiate trade agreements with expedited procedures for implementing legislation. Under this authority, Congress agrees to consider legislation to implement the trade agreements (usually nontariff trade agreements) under a procedure with mandatory deadlines, no amendment, and limited debate. The President is required to consult with congressional committees during negotiation and notify Congress at major stages. The President was granted this authority almost continuously from 1974 to 1994. After that, the authority lapsed. On December 6, 2001, the House passed trade promotion authority (TPA) bill H.R. 3005 by a vote of 215-214. An important issue was the designation of labor and the environment as negotiating objectives. On May 23, 2002, the Senate wrapped TPA into a comprehensive trade bill, H.R. 3009, "the Trade Act of 2002." The bill included TPA (in title XXI), reauthorization of Andean trade preferences, extension of the Generalized System of Preferences, and trade adjustment assistance (TAA). Book excerpt: Implementing legislation for a U.S.-Colombia Free Trade Agreement (CFTA) (H.R. 5724/S. 2830) was introduced in the 110th Congress on April 8, 2008 under Title XXI (Bipartisan Trade Promotion Authority Act of 2002) of the Trade Act of 2002 (P.L. 107-210). The House leadership considered that the President had submitted the implementing legislation without sufficient coordination with the Congress, and on April 10 the House voted 224-195 to make certain provisions in i 1/2 151 of the Trade Act of 1974 (P.L. 93-618), the provisions establishing expedited procedures, inapplicable to the CFTA implementing legislation (H.Res 1092). The CFTA is highly controversial and it is currently unclear whether or how Congress will consider implementing legislation in the future. The agreement would immediately eliminate duties on 80% of U.S. exports of consumer and industrial products to Colombia. An additional 7% of U.S. exports would receive duty-free treatment within five years of implementation and all remaining tariffs would be eliminated within ten years after implementation. The agreement also contains provisions for market access to U.S. firms in most services sectors; protection of U.S. foreign direct investment in Colombia; intellectual property rights protections for U.S. companies; and enforceable labor and environmental provisions.
