Book excerpt: Fragmentation of products' regulatory framework in the European Union (EU) hinders environmental protection. Based on the principle of integration contained in Article 11 of the Treaty on the Functioning of the EU (TFEU), the Union put forward the need to adopt an approach encompassing the whole life cycle of a product in its EU Integrated Product Policy (IPP). An effective preservation of the environment against the harmful effects of products requires adopting such a comprehensive approach. The focus of this chapter is how an integrated or holistic approach may limit the inconsistencies arising from a fragmented EU product regulatory framework. Article 11 TFEU has the potential of playing a key role in responding to the negative effects of fragmentation on environmental protection and, in this chapter, it is argued that it forms the basis of a more integrated approach for the EU product regulatory framework. This chapter begins with a general introduction of the principle of integration and evolution from its first appearance in the European Treaties. With regards to products, the need for more integration set out in Article 11 led to the development of the IPP, which embraced the thriving concept of Life-Cycle Thinking (LCT). The first section continues with an analysis of how the IPP and LCT may contribute to enhancing the coherence of the regulatory framework (section II). In the following section, three specific examples representing different life cycle stages - i.e. EU ecodesign, public procurement and waste law - are used to show the influence (or lack thereof) that the integration principle, with a specific focus on LCT, has had on the EU regulatory framework for products and its fragmentation (section III). A final section contains recommendations on how LCT could contribute to reducing the fragmentation of the regulatory framework, thereby limiting environmental damages caused by products (section IV).

All products cause environmental degradation in some way, whether from their manufacturing, use or disposal. The life-cycle of a product is often long and complicated. It covers all the areas from the extraction of natural resources, through their design, manufacture, assembly, marketing, distribution, sale and use to their eventual disposal as waste. At the same time it also involves many different actors such as designers, manufacturers, marketers, retailers and consumers. IPP attempts to systematically stimulate each phase of this complicated chain to improve its environmental performance. With the involvement of so many different products and actors there cannot be one simple policy measure for everything. Instead, IPP employs a whole variety of tools – both voluntary and mandatory – which are used to achieve identified objectives. These include economic instruments, the phase-out of dangerous materials, voluntary agreements, eco-labelling and product design guidelines. IPP is still in relative infancy and can be seen as an ongoing process hugely dependent on effective governance measures to ensure its continued success. This book presents a plethora of perspectives from policy-makers, researchers and consultancies, representatives from business, environmental and consumer associations on how to effectively conceptualise, institutionalise and implement IPP. The book is divided into four parts. First, the approach to the governance of IPP is examined in relation to other approaches to sustainable production and consumption. Second, the widely differing approaches to environmental product policy in practice at national, supranational and global level are analysed. Third, the book explores the challenge of designing a coherent policy mix to support the integration of sustainable consumption and production patterns by sector and theme. The demand for greener products has increased while competition has shortened product realization processes. Product Lifecycle Management (PLM) provides solutions in accelerating the development process and time to market by managing the information through a full life cycle of a product line. Life Cycle Assessment (LCA) provides a way to predict the environmental impacts that should be expected over the complete life cycle of a given product, but LCA methods are not well suited to efficient comparison of product alternatives during early design stages. Customers and other stakeholders demand products that not only comply with regulations and minimize environmental impacts, but also minimize costs and maximize certain performance objectives of a product. Thus, an approach is needed to unify validation of new products compliance with holistic consideration of environmental impacts along with other objectives over a complete life cycle for the selection of the optimal design concept in an efficient manner. This research addresses these matters by proposing the approach of integrating LCA software with a PLM system. A conceptual LCA framework- LCAatPLM (Life Cycle Assessment of assembly tree in PLM) is proposed that allows environmental assessment of assembly tree directly extracted from PLM. Firstly, relevant existing solutions are reviewed and several challenges are identified that prevent integration. By decomposing the structure of both PLM and LCA, a common foundation is identified for the integration. Then, a design methodology is developed to show the use of LCAatPLM within PLM environment. A charcoal grill design case study is detailed to show how evaluations can be made based on achievement of strategic goals, along with verification of compliance and the visibility of LCA and other results. Our findings show that design executions through LCA integrated with PLM reveal environmental criterion at early stages. It can be considered with other design criteria to identify and select optimal alternatives. This research transforms LCA as an evaluation tool used after a design is already completed to one that can guide designs earlier within the PLM environment.

In addition to the environmental integration principle, which has been part of the EU legal framework for some time, the Lisbon Treaty introduced the principles of gender equality integration, social policy integration, non-discrimination integration, consumer protection integration as well as animal welfare integration. Furthermore, a general principle of integration policy objectives is contained in Article 7 TFEU, requiring that the Union must ensure consistency between its policies and activities, taking all relevant policy requirements listed under the TFEU into account in the adoption of any legislative measure. These integration principles must be pursued, or at least taken into account, when decisions are being taken in almost any area of EU policy-making. However, there is considerable uncertainty regarding the normative implications of the various integration principles as well as their legal value and practical relevance for EU policymaking. This book addresses the implications of the proliferation of sectorial integration principles and the introduction of a universal requirement of policy consistency in terms of the division of competences between the Union and the Member States as well as the scope for judicial review of the EU legislative process. In particular, it explores whether the introduction of various integration principles has led to an extension of Union competences and whether it has limited the scope for judicial review by extending the discretionary power of the Union institutions.

Concepts such as concurrent design, total quality management, cross- disciplinary teams, and multi-attribute decision making are essential elements of life cycle design that help meet these goals. The framework for life cycle design was developed to be applicable for all product domains. It was written to assist not only design professionals but all other constituents who have an important role in life cycle design including corporate executives, product managers, production workers, distributors, environmental health and safety staff, purchasers, accountants, marketers, salespersons, legal staff, consumers, and government regulators. A coordinated effort is required to institute changes needed for successful implementation of life cycle design. Part I seeks to promote the reduction of environmental imparts and health risks through a systems approach to design. The approach is based on the product life cycle, which includes raw materials acquisition and processing, manufacturing, use/service, resource recovery, and disposal. A life cycle design framework was developed to provide guidance for more effectively conserving resources and energy, preventing pollution, and reducing the aggregate environmental impacts and health risks associated with a product system. This framework addresses the product, process, distribution, and management/information components of each product system. Part II describes the three components of a life cycle assessment (inventory analysis, impact analysis, and improvement analysis) as well as scoping activities, presents a brief overview of the development of the life cycle assessment process, and develops guidelines and principles for implementation of a product life cycle assessment. The major states in a life cycle are raw materials acquisition, manufacturing, consumer use/reuse/maintenance, and recycle/waste management. The basic steps of performing a life cycle inventory (defining the goals and system boundaries, including scoping; gathering and developing data; presenting and reviewing data; and interpreting and communicating results) are presented along with the general issues to be addressed. The system boundaries, assumptions, and conventions to be addressed in each stage of the inventory are presented.
