Book excerpt: Transitional Justice in Rwanda: Accountability for Atrocity comprehensively analyzes the full range of the transitional justice processes undertaken for the Rwandan genocide. Drawing on the author’s extensive professional experience as the principal justice policy maker and the leading law enforcement officer in Rwanda from 1996-2003, the book provides an in-depth analysis of the social, political and legal challenges faced by Rwanda in the aftermath of the genocide and the aspirations and legacy of transitional justice. The book explores the role played by the accountability processes not just in pursuing accountability but also in shaping the reconstruction of Rwanda’s institutions of democratic governance and political reconciliation. Central to this exploration will be the examination of whether or not transitional justice in Rwanda has contributed to a foundational rule of law reform process. While recognizing the necessity of pursuing accountability for mass atrocity, the book argues that a maximal approach to accountability for genocide may undermine the promotion of core objectives of transitional justice. Taking on one of the key questions facing practitioners and scholars of transitional justice today, the book suggests that the pursuit of mass accountability, particularly where socio-economic resources and legal capacity is limited, may destabilize the process of rule of law reform, endangering core human rights norms. Moreover, the book suggests that pursuing a strategy of mass accountability may undermine the process of democratic transition, particularly in a context where impunity for crimes committed by the victors of armed conflicts persists. Highlighting the ongoing democratic deficit in Rwanda and resulting political instability in the Great Lakes region, the book argues that the effectiveness of transitional justice ultimately hinges on the nature and success of political transition.

Building a sustainable peace after violent conflict is a process that entails competing ideas, political contestation and transformation of power relations. This volume develops the concept of ‘friction’ to better analyse the interplay between global ideas, actors, and practices, and their local counterparts. The chapters examine efforts undertaken to promote sustainable peace in a variety of locations, such as Cambodia, Sri Lanka, Afghanistan, and Sierra Leone. These case analyses provide a nuanced understanding not simply of local processes, or of the hybrid or mixed agencies, ideas, and processes that are generated, but of the complex interactions that unfold between all of these elements in the context of peacebuilding intervention. The analyses demonstrate how the ambivalent relationship between global and local actors leads to unintended and sometimes counterproductive results of peacebuilding interventions. The approach of this book, with its focus on friction as a conceptual tool, advances the peacebuilding research agenda and adds to two ongoing debates in the peacebuilding field; the debate on hybridity, and the debate on local agency and local ownership. In analysing frictional encounters this volume prepares the ground for a better understanding of the mixed impact peace initiatives have on post-conflict societies. Book excerpt: This volume is driven by the conviction that the key to the establishment of stable liberal democracy anywhere in the world and, in this case, in Kosovo lies in the completion of three interrelated tasks: first, the creation of effective political institutions, based on the principle of the separation of powers (including the independence of the judiciary); second, the promotion of the rule of law; and, third, the promotion of civic values, including tolerance or ethnic/religious/sexual minorities, trust, and respect for the harm principle. In fact, there are problems across all three measures, including with judicial independence, with the rule of law, and with civic values. On the last of these, research findings show that the citizens of Kosovo rank extremely low on trust of other citizens, low on engagement in social organizations, and tolerance of gays, lesbians, and atheists, but high on trust in the political institutions of their country and in pride of their newly independent state.
