The purpose of this book, then, is to establish a human rights framework to promote better understanding of the multi-faceted problems inherent in trafficking of human beings, articulate obligations imposed upon States, and facilitate a holistic approach. The book also contains chapters on case studies at the national, regional, and international levels, thereby combining the theory and practice.

Book excerpt: Applying new theories about rights to pressing social issues, A Holistic Approach to Rights suggests major changes are needed in the ways we think about rights and formulating social policy. Part I analyzes rights as networks of warrants--socially recognized sanctions for doing, saying, demanding, believing, feeling, or thinking something as one's due. On this account, rights are more varied and play a more diverse and open-ended role in legal and moral thinking than most theories of rights allow. A new theory of natural rights treats them as claims that every person has upon the state, as a condition of legitimacy, to make adequate provision for those features of human life that require force against persons to be justified. Moral rights, such as the right to the truth, derive from team loyalty due fellow members of the moral community and can be lost by someone who acts in ways that undermine the moral enterprise. Part II provides detailed analyses of affirmative action, group rights, the rights of future generations, reproductive rights, the use of new reproductive technologies, and speech rights. Specific conclusions include an innovative proposal for regulating violence and pornography in the media.

It has been estimated that between 600,000 and 800,000 people, the majority of whom are women and children, are trafficked worldwide each year. The rapid growth in trafficking of human beings and its transnational nature have prompted the international community to take urgent action, and a major step was taken when the United Nations adopted the Protocol to Prevent and Suppress Trafficking in Persons, Especially Women and Children (Trafficking Protocol), attached to the United Nations Convention against Transnational Organised Crime (Organised Crime Convention) in December 2000. Yet addressing the human rights aspects of the phenomenon has proven to be difficult in practice, and so far a holistic approach which addresses wider issues surrounding the phenomenon has not been taken. The purpose of this book is to go further than simply recognising that trafficking is a human rights issue. It attempts to establish a human rights framework to analyse and address the act by identifying applicable human rights norms and principles from the beginning to the end of the trafficking process, such as the rights to life, work, health, as well as freedom from torture and slavery. It then articulates key obligations under international human rights law, including the obligations to prohibit trafficking, punish traffickers, protect victims, and to address the causes and the consequences of the practice.

The UN Guiding Principles acted as a catalyst for hitherto unprecedented regulatory and judicial developments. The monograph by Macchi proposes a functionalist reading of the state’s duty to regulate the transnational activities of corporations in order to protect human rights and adopts a holistic approach to the corporate responsibility to respect, arguing that environmental and climate due diligence are inherent dimensions of human rights due diligence. Our world’s history is best told as an endless series of wars. Recently many people have discovered the word holistic and some even have a good idea of what it means. A holistic approach is based on cooperation and is typifies by seeking balance between ideas that seem to conflict with one another. This approach leads to dialogue and compromises and theoretically ultimately to a peaceful society. The holistic approach has traditionally been depicted by the yin/yang symbol. Peace has been elusive. War and peace are mutually exclusive as are cooperating and competing and materialistic and holistic. There are two separate directions that society can choose but we cannot choose both. A materialistic social dogma uses slavery to create a two-class society of rulers and subjects and the rulers desire central control. A holistic social dogma fosters individual liberty and human rights by decentralizing power with checks and balances. Rarely an opportunity arises where it is not only possible to change course but changing course becomes essential to survival of the human race. If we take the time to understand how a simple choice has led to perpetual war and an insane arms race then we can also understand that the option for peace and prosperity is a viable option. Creating a holistic society will be a challenge and maintaining it will take teamwork. I am attempting to provide a blueprint. Change is inevitable so lets make it a smooth transition!
