Book excerpt: The International Commission Against Impunity in Guatemala (CICIG) represents an innovative effort to curb criminal threats to democratic rule and to strengthen state capacity that diverged from the dominant mode of technical assistance. Working through treaty-based international authority, this “hybrid” U.N.-backed mission combined international and national capacities working through Guatemalan laws and courts. The Commission successfully investigated and helped prosecute multiple high-ranking Guatemalan officials, ex-military officers and business elites. Those investigations precipitated anti-corruption protests that ousted the sitting president and vice president in the “Guatemalan Spring” of 2015. CICIG investigations led to 1,540 indictments in 120 cases involving over 70 illicit networks. The mission showed Guatemalans that the rule of law can be applied even to the most powerful, had far-reaching political impact, and contributed to the effectiveness of the Attorney-General's office.Yet by the time the mission closed in 2019 after twelve years of operation, a cloud hung over its legacy. As CICIG's cases ensnared an expanding array of top businessmen, officials and political parties, economic and political elites launched an anti-CICIG media campaign and hired lobbyists to undermine what had been strong bipartisan support for the mission's biggest financial backer, the United States. President Jimmy Morales, elected on an anti-corruption platform in 2015, turned against the Commission after his brother and son were indicted. Morales and his allies won some support from the Trump administration in decrying the Commission as a violation of national sovereignty. Yet during its final years, CICIG's support in public opinion polls never fell below 70%.Leaving behind a complex legacy, CICIG both inspired a jaded Guatemalan citizenry to stand up to corrupt officials and galvanized former political enemies around the common perceived threat of the Commission. This report evaluates the history of CICIG to analyze its impact on Guatemalan political life and to draw lessons for future hybrid anti-impunity missions.

Sin embargo, cuando la misión cerró en 2019 después de doce años de funcionamiento, su legado estuvo cuestionado. Mientras los casos de la CICIG implicaron a un creciente número de empresarios, funcionarios, y partidos políticos, las élites económicas y políticas lanzaron una campaña mediática en contra la Cicig en Guatemala y en los Estados Unidos que sirvió para socavar lo que había sido un fuerte apoyo bipartidista del mayor financiador de la misión. El presidente Jimmy Morales, electo con una plataforma anticorrupción en 2015, se volvió en contra de la Comisión después del arresto de su hermano y su hijo. Ganando algún apoyo de la administración Trump, Morales y sus aliados condenaron a la Cicig como una violación de la soberanía nacional. Sin embargo, durante sus últimos años, el apoyo a la Cicig en las encuestas de opinión pública nunca cayó por debajo del 70%.La Cicig deja un legado complejo; la Comisión inspiró a la ciudadanía harta de enfrentarse a la corrupción y galvanizó a diversos sectores en contra de lo que percibieron como una amenaza común. Este informe evalúa la historia de la CICIG para analizar su impacto en la vida política guatemalteca y sacar lecciones para futuras misiones híbridas contra la impunidad.

One prominent pledge he had made during the campaign was the formation of an international commission that would assist in the fight against corruption, linked to the United Nations (UN) and/or the Organization of American States (OAS). The inspiration for this commission was the International Commission against Impunity in Guatemala (CICIG), which has helped the Guatemalan Attorney General's office identify 60 criminal networks and prosecute over 100 cases resulting in more than 300 convictions since its creation in 2007. It was celebrated as a success after its investigations led to corruption-related indictments of the then-President Otto Pérez Molina and the then-vice president. Bukele did not release many details of the proposal before the election, and had designated his vice-presidential candidate, Félix Ulloa, to oversee the initiative. Campaign staff indicated they were seeking to adapt the CICIG model, and also perhaps draw on the Organization of American States Mission in Support of the Fight Against Corruption in Honduras (MACCIH). Both these institutions were innovative attempts to reduce exclusionary governance by a restricted group of elites, to enhance democratic governance, and to model holding even the well-connected and powerful to account.The purpose of this document is to highlight lessons from these two Central American experiences for those interested in establishing a comparable hybrid institution that combines an international mission with national capacities in combatting corruption and/or impunity.

Building permits and infrastructure contracts are examples of state-issued goods. Traffic tickets and tax liabilities are examples of costs levied by the state. These and other corruption vulnerabilities turn to actual threats when officials calculate that the benefits of abusing their power are greater than the penalties associated with getting caught. By a similar logic, the formula for corruption control requires increasing the probability of detecting corruption (that is, of activating the eye) through enhanced monitoring and then credibly threatening to apply the appropriate penalty in response to wrongdoing (cracking the whip). Notably, the common policy response to corruption often emphasizes only the first of the two mechanisms. Governments prioritize transparency measures but avoid the risks associated with confronting corruption. Therefore, as a means to improve on the current state of affairs, this book examines distinct approaches to promoting accountability, especially accountability among the set of unelected officials responsible for regulating the built environment. It analyzes the results of field experiments on corruption control conducted in the City of Querétaro in central Mexico, urban and peri-urban districts in Peru, and two of New York City's boroughs. The book articulates a typology for assessing the threats of CPS and for implementing appropriate strategies to achieve sustainable peace effectively and efficiently. The international case studies address interventions undertaken either to support the implementation of a peace agreement (i.e., a peace operation) or to stabilize a country entangled in an internal conflict in the context of a power-sharing agreement among key protagonists (i.e., a stability operation). In each of these cases, at least one of the parties to the agreement was a criminalized power structure that was a leading spoiler. The final chapter identifies strategies that are most effective for each type of CPS, including the ways and means (or tools) required for effective conflict transformation. A companion volume, Combating Criminalized Power Structures: A Toolkit, provides practitioners with the means of coping with the challenges posed by CPS.
