Book excerpt: Third party payments represent blank-form financial instruments that government employees use to pay for expenses when traditional payments are not feasible or possible. GAO surveyed government entities on their use of third party payments. Forty of the 86 entities that responded to GAO's survey reported that they had used third party payment instruments at some time during fiscal years 1997 through 1999. Although the number of reported payment transactions declined 3.7 percent for these 40 entities during this period, the reported total dollar amount associated with these transactions rose 13.4 percent. On the basis of the transaction data reported, the average dollar value of each payment rose 17.6 percent. Among the 40 entities, the most common reasons cited for using third party payment instruments were (1) to pay for small purchases of supplies and services; (2) to pay contractors that either could not or would not accept government checks, electronic funds transfers, or credit card payments; (3) to make emergency payments; (4) to provide immediate reimbursement for out-of-pocket expenses; or (5) as an alternative to disbursing a cash advance. In response to questions about whether entities used internal controls, all 40 entities reported restricting the number of employees authorized to use third party payments and monitoring third party payment activities; slightly more than half said that the monitoring occurred at least annually.

Book excerpt: Although the third-party payment system is a matter of heated debate among academics and policymakers, and empirical studies of it are commonplace, this paper is believed to be the first to theoretically model its macroeconomic impact on a small open economy. The outcomes indicate that increases in the use of third-party payments will have a positive effect on national income in such an economy, but an ambiguous effect on domestic interest rates if the Marshall-Lerner condition holds. However, if the Marshall-Lerner condition does not hold, then increases in third-party payments could lead to higher domestic interest rates in an economy of this type. Additionally, third-party payments will ambiguous effects on such an economy's foreign-exchange rate.

Book excerpt: Hospitals and physicians have begun encouraging their high-cost patients to switch from Medicare or Medicaid to government-subsidized Qualified Health Plans by offering to pay their insurance premiums. Providers make these third-party payments because insurance payouts are much higher under Qualified Health Plans than under Medicare or Medicaid. However, this practice is not always in the best interests of patients, issuers, and the health-care Marketplace. This Note delineates the regulatory responses to this issue, as well as the various advantages and disadvantages that stem from the practice in different contexts. This Note argues that a federal criminal statute is needed to eliminate the harmful effects of third-party payments and preserve the positive effects they can have in certain contexts. Finally, this Note proposes a model federal criminal statute that can serve as a mechanism to combat improper uses of third-party payments. In brief, this Note argues that the harms caused by third-party payments are too significant to be ignored and urges that a narrow federal criminal statute is the best way to address the third-party-payment problem.
