This Agreement having signed in Cotonou, Benin, is known as the Cotonou Agreement. The Cotonou Agreement is the latest in a series of conventions between the two parties that have their genesis in the late 1950s. The primary goal of this work was to find out to what extent, if at all, the newly signed Agreement is likely to contribute to the economic renaissance of the ACP countries. In so doing it traces development of the ACP-EU conventions right from their very beginning. The performance of the relationship to date is examined with a view to determining whether the lessons learnt therefrom have been incorporated in the new Agreement. There is a detailed analysis of the trade and aid provisions of the Cotonou Agreement. Apart from the economic provisions, other major provisions and developments of the ACP-EU Conventions are discussed with a view to providing a wholesome picture. In the late 1950s, these arrangements started to take a multilateral form when members of the European Economic Community established special trade arrangements with their colonies. Since then, several trade arrangements have featured African countries among the preference-receiving countries. Yet it is not always clear how preferential these arrangements are and whether they in fact help African countries or instead lead them to perpetual dependence on specific markets and products. Richard E. Mshomba carefully examines the history of these programs and their salient features. He analyzes negotiations between the EU and African countries to form Economic Partnership Agreements. Nonreciprocal preferential trade arrangements are often unpredictable, since the duration and magnitude of preferences are at the discretion of the preference-giving countries. However, when used in conjunction with other development programs and with laws and regulations that encourage long-term investment and protect employees, they can increase economic opportunities and foster human development. This book recognizes the potential impact of nonreciprocal preferential trade arrangements and provides recommendations to increase their viability.

Book excerpt: Seeking to open paths for reconsidering the trade and development relationship at the WTO, this book takes into account both the heritage of the trade regime and its present dynamics. It argues that the institutional processes for creating and implementing trade rules at the WTO and the actual regulatory outcomes are inseparable. A consideration of the WTO's development dimension must examine both jointly. It shows that the shortcomings of the Doha Development Round are in part due to a failure to assess trade rules as part of the legal processes and institutions that produced them. This book devotes significant analysis to the systemic impact of the WTO as an institution on developing and least developed members. From a pragmatic perspective, it provides a coherent and systematic analysis of the legal meaning, the implementation, and the adjudication of special and differential treatment rules for developing members. It then evaluates the different regulatory approaches to trade and development from a more theoretical perspective. The book finishes by presenting a range of proposals for a better balance between trade liberalization and the development needs of many WTO members.
