Available in PDF, EPUB and Kindle. Book excerpt: For decades, Indonesia's 1945 Constitution, the second shortest in the modern world, was used as an apologia by successive authoritarian regimes. A bare-bones text originally intended as a temporary measure, it did little beyond establish basic state organs, including a powerful presidency. It did not offer citizens real guarantees or protections. These weaknesses were ruthlessly exploited by the military-backed regime that President Soeharto headed from 1966 until his fall in 1998. The (first ever) amendments to the Constitution, which began the following year and were completed in 2002, changed all this. Enlarging and rethinking the Constitution, they ushered in a liberal democratic system based around human rights, an open society and separation of powers. These reforms also created a Constitutional Court that has provided Indonesia's first judicial forum for serious debate on the interpretation and application of the Constitution, as well as its first significant and easily-accessible body of detailed and reasoned judgments. Today, Indonesian constitutional law is rich, sophisticated and complex. This book surveys this remarkable constitutional transition, assessing the implementation of Indonesia's new constitutional model and identifying its weaknesses. After covering key institutions exercising executive, legislative and judicial powers, the book focuses on current constitutional debates, ranging from human rights to decentralisation, religious freedom and control of the economy.

Even the replacement of Dutch by Indonesian as the official language of the law, surely a major event for the work of Indonesian jurists, has not been closely examined. Yet, since the early 1970s, legal usage and terminology have been the topic of a steady stream of highly critical publications by linguists and, remarkably, by jurists as well. Their criticism is focused on the heterogeneity of law language and terminology, and the deviation of legal usage from the official standard language. Government measures (language courses, law dictionaries) have not allayed this criticism. This study exposes two fundamental defects in the government measures and in the criticism itself. Firstly, they are grounded in an instrumental approach to language, an approach that sees language as a mere tool of the jurist, and as secondary in importance to the conceptual world that is considered law’s core business. Secondly, they greatly underestimate the impact of the declining knowledge of Dutch upon the development of Indonesian law language. Massier argues that the law must be viewed as inextricably bound up with the language in which it is formulated. Consequently, legal training and practice are examined in this study in terms of language behaviour and conventions, of learning, writing and speaking the languages of the law. The voice of the law in transition provides a language history of Indonesian law and its practitioners.

Book excerpt: This historiographic study of K'tut Tantri - alias Vannen Walker, the journalist from the Isle of Man; Muriel Pearson, the unhappy wife; and Surabaya Sue, the notorious revolutionary - compares her romantic and colorful autobiography, Revolt in Paradise, with other versions of her past, including those of her fellow Bali colonists and her revolutionary comrades, as well as her foes, the Dutch, and various intelligence organizations. These alternatives accounts of her past question the image of K'tut Tantri as hero, portraying her instead as dishonest, unstable, egotistical, and immoral. Such criticisms have overshadowed proper recognition of her role in the development of modern Indonesia, both as a bohemian hotelier in between-wars Bali and later as propaganda broadcaster and adviser to Indonesian revolutionary leaders including Soekarno, Sutomo, and Syarifuddin. Focusing on the nature of biography and autobiography, this book analyses K'tut Tantri's self-defeating battle to use history - in text and film script - to define her identity and reappropriate her past. An examination of the use of ideas of "truth" and "fiction" in understanding the past leads to broader consideration of the nature of history and its uses. Finally, an attempt is made to reconcile the deconstruction of K'tut Tantri's autobiography with both an acceptance of the validity of "alternative" historical genres and an acceptance of the problems inherent in writing a history of a living person. In some regions, local languages are still political rallying points, but their significance has diminished, and the rapid spread of Indonesian as the national language of political and religious authority has been described as the 'miracle of the developing world'. Among the Weyewa, on the island of Sumba, this shift has displaced a once vibrant tradition of ritual poetic speech, which until recently was an important source of authority, tradition, and identity. But it has also given rise to new and hybrid forms of poetic expression. This first study to analyse language change in relation to political marginality argues that political coercion or cognitive process of 'style reduction' may partially explain what has happened, but equally important in language shift is the role of linguistic ideologies.

Book excerpt: In Resource Nationalism in Indonesia, Eve Warburton traces nationalist policy trajectories in Indonesia back to the preferences of big local business interests. Commodity booms often prompt more nationalist policy styles in resource-rich countries. Usually, this nationalist push weakens once a boom is over. But in Indonesia, a major global exporter of coal, palm oil, nickel, and other minerals, the intensity of nationalist policy interventions increased after the early twenty-first-century commodity boom came to an end. Equally puzzling, the state applied nationalist policies unevenly across the land and resource sectors. Resource Nationalism in Indonesia explains these trends by examining the economic and political benefits that accrue to domestic business actors when commodity prices soar. Warburton shows how the centrality of patronage to Indonesia's democratic political economy, and the growing importance of mining and palm oil as drivers of export earnings, enhanced both the instrumental and structural power of major domestic companies, giving them new influence over the direction of nationalist change.

Book excerpt: Based on a decade of research in Indonesia, this book provides an in-depth account of the military's struggle to adapt to the new democratic system after the downfall of Suharto's authoritarian regime in 1998. Unlike other studies of the Indonesian armed forces, which focus exclusively on internal military developments, Mietzner's study emphasizes the importance of conflicts among civilians in determining the extent of military involvement in political affairs. Analysing disputes between Indonesia's main Muslim groups, Mietzner argues that their intense rivalry between 1998 and 2004 allowed the military to extend its engagement in politics and protect its institutional interests. The stabilization of the civilian polity after 2004, in contrast, has led to an increasing marginalization of the armed forces from the power centre. Drawing broader conclusions from these events for Indonesia's ongoing process of democratic consolidation, the book shows that the future role of the armed forces in politics will largely depend on the ability of civilian leaders to maintain functioning democratic institutions and procedures.
