Book Political Foundations of Judicial Supremacy

Download or read book Political Foundations of Judicial Supremacy written by Keith E. Whittington and published by Princeton University Press. This book was released on 2009-03-09 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Should the Supreme Court have the last word when it comes to interpreting the Constitution? The justices on the Supreme Court certainly seem to think so--and their critics say that this position threatens democracy. But Keith Whittington argues that the Court's justices have not simply seized power and circumvented politics. The justices have had power thrust upon them--by politicians, for the benefit of politicians. In this sweeping political history of judicial supremacy in America, Whittington shows that presidents and political leaders of all stripes have worked to put the Court on a pedestal and have encouraged its justices to accept the role of ultimate interpreters of the Constitution. Whittington examines why presidents have often found judicial supremacy to be in their best interest, why they have rarely assumed responsibility for interpreting the Constitution, and why constitutional leadership has often been passed to the courts. The unprecedented assertiveness of the Rehnquist Court in striking down acts of Congress is only the most recent example of a development that began with the founding generation itself. Presidential bids for constitutional leadership have been rare, but reflect the temporary political advantage in doing so. Far more often, presidents have cooperated in increasing the Court's power and encouraging its activism. Challenging the conventional wisdom that judges have usurped democracy, Whittington shows that judicial supremacy is the product of democratic politics.

Book Packing the Court

Download or read book Packing the Court written by James Macgregor Burns and published by Penguin. This book was released on 2009-06-25 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: From renowned political theorist James MacGregor Burns, an incisive critique of the overreaching power of an ideological Supreme Court For decades, Pulitzer Prize-winner James MacGregor Burns has been one of the great masters of the study of power and leadership in America. In Packing the Court, he turns his eye to the U.S. Supreme Court, an institution that he believes has become more powerful, and more partisan, than the founding fathers ever intended. In a compelling and provocative narrative, Burns reveals how the Supreme Court has served as a reactionary force in American politics at critical moments throughout the nation's history, and concludes with a bold proposal to rein in the court's power.

Download or read book Dumbing Down the Courts written by John R. Lott, Jr. and published by Hillcrest Publishing Group. This book was released on 2013-09-17 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judges have enormous power. They determine whom we can marry, whether we can own firearms, whether the government can mandate that we buy certain products, and how we define "personhood." But who gets to occupy these powerful positions? Up until now, there has been little systematic study of what type of judges get confirmed. In his rigorous yet readable style, John Lott analyzes both historical accounts and large amounts of data to see how the confirmation process has changed over time. Most importantly, Dumbing Down the Courts shows that intelligence has now become a liability for judicial nominees. With courts taking on an ever greater role in our lives, smarter judges are feared by the opposition. Although presidents want brilliant judges who support their positions, senators of the opposing party increasingly "Bork" those nominees who would be the most influential judges, subjecting them to humiliating and long confirmations. The conclusion? The brightest nominees will not end

Book Stolen Sovereignty

Download or read book Stolen Sovereignty written by Daniel Horowitz and published by Post Hill Press. This book was released on 2021-03-19 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: We are confronted with a jarring reality that the Left has succeeded in growing the power of the courts. Obama has replaced roughly 30 percent of the district and appellate judges on the federal benches. We are now facing a judicial time bomb, the likes of which we’ve never seen before. With the Obergefell v. Hodges ruling the courts have usurped the will of the people and set a precedent that has become a de facto law of the land. In STOLEN SOVEREIGNTY Horowitz reveals just how disenfranchised voters have become. On issue after issue we are witnessing a transformation of our society before our very eyes, all without the ability to stop it through the political process. We are becoming a government not of the people, by the people, for the people, but of the elites by the justices and for the few. First the courts went after your income. Then they went after the right to abortion. Then the right for men to marry men and women to marry women. Next they will go after the right to our sovereign borders. Where will it end? It is the legislative branch that gives the people their voice. With a weak congress, the people will suffer at the hands of a tyrannical few. By ceding the power of the purse, willfully ignoring executive overreach, blindly confirming judicial nominees, and writing statutes so broadly they transfer full legislative power to the president, the past few generations of congressmen have helped the executive branch and the courts crush their own power. STOLEN SOVEREIGNTY is a book defending sovereignty and society from the courts. Horowitz masterfully explains the legal foundations of this great nation and how the three branches of government are designed to keep the people free. He outlines how the recent overreach of the judicial branch has led to the extinguishing of the voice of the people. And most important, he provides solutions as the looming immigration crisis overshadows the political landscape. “It is no longer sufficient to sneer, scorn, or warn against the judicial tyranny; it’s time to fight back and implement immediate reforms or we will cease to exist as a democratic society and a sovereign nation,” says Horowitz. As we hunger for leaders who will steer the country back on the track of liberty and justice for all, we must ensure we are never one court decision or one executive order away from losing our society, sovereignty, and government. The courts have spoken. Now, it’s time for the American people to reclaim their sovereignty.

Book Restoring the Constitution

Download or read book Restoring the Constitution written by Carrol D. Kilgore and published by . This book was released on 2012-09-19 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Numerous groups and leaders have voiced complaints that the Federal Government has exceeded its authority, usurping powers that can only be legally exercised by the states (if at all). These comments seldom mention any details about how it is believed the Government has usurped those powers-how it has become dictatorial in the sense that it is enforcing laws which the people have never given it the power to enact, indeed as to which this power has been withheld by the people.A new book, Restoring the Constitution, details precisely how this happened and the major areas in which this illegal governing has occurred. It is written in accurate language understandable by any literate reader, and is based on the terms of the Constitution, which is itself written in simple, understandable language. It details how one thing and only one thing made this usurpation possible: The service rendered by the federal courts to politicians eager to expand their powers without limit. Those courts devised and published dishonest "reasoning" that made the seizure of these usurped powers appear lawful to the casual unthinking observer. It is an outgrowth of an earlier work, Judical Tyranny, An Inquiry Into the Integrity of the Federal Judiciary (Thomas Nelson Publishers, 1977). An expanded 21st Century Edition should be available from Amazon in late September, 2012. No one has declared the proofs in Judicial Tyranny to be inaccurate. Indeed, the Supreme Court Historical Society acknowledged that it was accurate, but called its author biased. The author responds: My bias is my insistence that as every sworn witness should testify truthfully in court, the identical obligation rests upon every judge who has sworn to uphold the Constitution-that he should honestly carry out the promise of that oath. In fact, few judges pay any attention to the Constitution. Their loyalty is instead thoughtlessly given to the body of decisions by the Supreme Court, many of which are patently dishonest.Any patriotic American who believes that the U. S. Constitution should be supreme in fact, as the people declared it to be when it was adopted, will find this short book enlightening.
