The authors cover the major institutions, actors, and processes that comprise the U.S. legal system, viewed from a political science perspective. Some of the contributors are philosophers of language who are interested in applying advances in philosophy of language to legal issues, and some of the participants are philosophers of law who are interested in applying insights and theories from philosophy of language to their work on the nature of law and legal interpretation. By making this body of recent work available in a single volume, readers will gain both a general overview of the various interactions between language and law, and also detailed analyses of particular areas in which this interaction is manifest. The contributions to this volume are grouped under three main general areas: The first area concerns a critical assessment, in light of recent advances in philosophy of language, of the foundational role of language in understanding the nature of law itself. The second main area concerns a number of ways in which an understanding of language can resolve some of the issues prevalent in legal interpretation, such as the various ways in which semantic content can differ from law's assertive content; the contribution of presuppositions and pragmatic implicatures in understanding what the law conveys; the role of vagueness in legal language, for example. The third general topic concerns the role of language in the context of particular legal doctrines and legal solutions to practical problems, such as the legal definitions of inchoate crimes, the legal definition of torture, or the contractual doctrines concerning default rules. Together, these three key issues cover a wide range of philosophical interests in law that can be elucidated by a better understanding of language and linguistic communication.

Book excerpt: However, it became apparent shortly after the establishing of the Center that not only were all methods of legal semiotics not Peircean in origin, but were in their respective foundational assumptions not likely to be compatible with Peirce's semiotics without some radical, transforming development of the idea, 'legal semiotics'. It was clear that if one would intend to be faithful to Peircean semiotics then holding a fixed notion of what an idea of Peircean semiotics of law means would be a violation of the spirit of Peirce's thought; this above all emphasizes the growth and development of initiative ideas and also the stricture that all leading principles must be subject to revision. Even the idea of Peircean semiotics, as leading principle, must itself be an open idea, the meaning of which must be transformable through the process of defining it. A metasemiotics view of a semiotics of law must leave open the possibility for revision of the leading principle of the term, "legal semiotics. " Therefore, if legal semiotics is an idea which accumulates and evolves its meaning in the very process of self-examination, then a process of investigating law investigates itself as well in any semiotic process of inquiry. It became apparent that the most appropriate contribution the Center could make to the area of a Peirce an semiotics would be to act as a sponsor, an inclusive rather than exclusive agent for inquiry of all kinds into the general topic of law and semiotics.

Miller was awarded a Nobel Prize in 1990 for his work in the theory of finance and financial economics. Selected Works of Merton H. In other words, a corporation's value depends on its investments in people, ideas, and physical capital goods and not on the mix of bonds, stocks, and other securities used to finance the investments. Four of these papers are reprinted here, together with important later work by Miller in macroeconomics, corporate capital structure, management science, asset pricing, and the economic and regulatory problems of the financial services industry. Book excerpt: Looking at a heretofore overlooked set of archival records of London in the late 17th and early 18th centuries, Hurl-Eamon reassesses the impact of gender on petty crime and its prosecution during the period. This book offers a new approach to the growing body of work on the history of violence in past societies. By focusing upon low-cost prosecutions in minor courts, Hurl-Eamon uncovers thousands of assaults on the streets of early modern London. Previous histories stressing the masculine nature of past violence are questioned here: women perpetrated one-third of all assaults. In looking at more mundane altercations rather than the homicidal attacks studied in previous histories, the book investigates violence as a physical language, with some forms that were subject to gender constraints, but many of which were available to both men and women. Quantitative analyses of various circumstances surrounding the assaults--including initial causes, weapons used, and injuries sustained--outline the patterns of violence as a language. Hurl-Eamon also stresses the importance of focusing on the prosecutorial voice. In bringing the court's attention to petty attacks, thousands of early modern men and women should be seen as agents rather than victims. This view is especially interesting in the context of domestic violence, where hundreds of wives and servants prosecuted patriarchs for assault, and in the Mohock Scare of 1712, where London's populace rose up in opposition to aristocratic violence. The discussion is informed by a detailed knowledge of assault laws and the rules governing justices of the peace.
