Book Affirmative Action

Download or read book Affirmative Action written by Richard F. Tomasson and published by Rowman & Littlefield. This book was released on 2001 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: Hailed at the time of its original publication as a thorough and balanced debate of one of America's most vexing political issues, Affirmative Action employs a pro and con format to provide a concise introduction to this divisive debate. In a new, substantive introduction, Richard F. Tomasson offers a short history of the affirmative action debate and addresses new developments since the book's original appearance. In Part One, authors Crosby and Herzberger draw on state and federal court decisions, federal decrees, and university practices to support affirmative action to counter racial and gender bias. In Part Two, Tomasson cites the same kinds of evidence to argue against affirmative action programs.

(1) Each facility or part of a facility constructed by, on behalf of, or for the use of a public entity shall be designed and constructed in such manner that the facility or part of the facility is readily accessible to and usable by individuals with disabilities, if the construction was commenced after January 26, 1992. (2) Exception for structural impracticability. (i) Full compliance with the requirements of this section is not required where a public entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.

Book The Future of Affirmative Action

Download or read book The Future of Affirmative Action written by Richard D. Kahlenberg and published by . This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the United States experiences dramatic demographic change--and as our society's income inequality continues to rise--promoting racial, ethnic, and economic inclusion at selective colleges has become more important than ever. At the same time, however, many Americans--including several members of the U.S. Supreme Court--are uneasy with explicitly using race as a factor in college admissions. The Court's decision in Fisher v. University of Texas emphasized that universities can use race in admissions only when "necessary," and that universities bear "the ultimate burden of demonstrating, before turning to racial classifications, that available, workable race-neutral alternatives do not suffice." With race-based admission programs increasingly curtailed, The Future of Affirmative Action explores race-neutral approaches as a method of promoting college diversity after Fisher decision. The volume suggests that Fisher might on the one hand be a further challenge to the use of racial criteria in admissions, but on the other presents a new opportunity to tackle, at long last, the burgeoning economic divisions in our system of higher education, and in society as a whole.
