Download or read book The Trial of Hon Clement L Vallandigham 1863 written by Clement L. Vallandigham and published by . This book was released on 2015-07-07 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Trial of Hon. Clement L. Vallandigham, 1863: By a Military Commission; And the Proceedings Under His Application for a Writ of Habeas Corpus in the Circuit Court of the United States for the Southern District of Ohio In issuing this Report of the Trial of the Hon. Clement L. Vallandigham, by a Military Commission, convened in Cincinnati by order of Major-General Burnside, for language in violation of General Order No. 38, used at Mount Vernon, Ohio, and of the proceedings before the Hon. H. H. Leavitt, in the Circuit Court of the United States for the Southern District of Ohio, under the application for a writ of Habeas Corpus, the publishers are influenced, in part, by the expressed desire of many members of the bar to have such publication made, but chiefly because the great principles involved in the investigation, and the ability and learning displayed in the arguments of counsel and the opinion of the Court, give the cases sufficient interest and importance to justify their preservation in the substantial form of a book. The military orders and the proceedings of the Military Commission are published with the consent of Major-General Burnside; while, through the courtesy of Brigadier-General Cox, the publishers have been enabled to verify their report by a careful comparison with the original record. The arguments of counsel and the opinion of the Court in the Habeas Corpus case have been prepared for the press by their respective authors. Thus the book obtains that authenticity which makes it perfectly reliable both in its historical and judicial aspects. Available in PDF, EPUB and Kindle. Book excerpt: The horrendous events of September 11, 2001, heightened awareness of terrorism unlike all but a handful of major catastrophes in American history. Like the Japanese attack on Pearl Harbor on December 7, 1941, and President Kennedy’s assassination on November 22, 1963, 9/11 is a date forever enshrined in our national memory. But 9/11 once again raised the question: What should government do to eliminate or reduce the likelihood of a future attack? How should national leadership balance its responsibility to protect the civil liberties of U.S. citizens with its sworn duty to protect their lives? In The Safety of the Kingdom, J. Michael Martinez takes up the question of how the United States government has responded to terrorist attacks and, in the absence of an attack, the fear of foreign and subversive elements that may harm the nation. In some cases, the government “overreaction” led to a series of abuses that amplified the severity of the original threat. Rather than selecting every instance of government reaction to threats, Martinez examines representative cases, from the alien and sedition acts in the eighteenth century to the post-9/11 “war on terror.” Edward Snowden’s disclosure of classified information related to the NSA’s surveillance program brought to the fore an important debate about government scrutiny of its citizens. As J. Michael Martinez makes clear in this book, it is a debate that has been ongoing for centuries. Book If This Be Treason

Available in PDF, EPUB and Kindle. Book excerpt: Treason is the only crime explicitly defined in America’s Constitution. Relatively few Americans have been convicted of it. Far more have had the poisonous word thrown at them. Through the cases of Americans who—whether acting in defense of their country, for personal gain, or simply when society had redefined treasonous activity—were accused of betraying their country, though not charged with the ultimate crime against one’s nation, If This Be Treason tackles the complicated question of where dissent ends and betrayal begins. Jeremy Duda covers the gamut of American history, from the earliest days of the republic, when George Logan’s act of unauthorized diplomacy kept his fledgling country out of war with France but so outraged his enemies that Congress passed a law to prevent it from ever happening again, to today as Edward Snowden remains an international fugitive for exposing the government’s spying on its own citizens. Among other examples are diplomatic envoy Nicholas Trist, who betrayed his president’s order to return home so he could negotiate a just treaty with a vanquished foe; former congressman Clement Vallandigham, who was exiled from his own country for speaking out against Lincoln’s prosecution of the Civil War; and Richard Nixon, who scuttled a peace deal to end the war in Vietnam. “If this be treason, make the most of it!” So proudly declared Patrick Henry, accused of treason for opposing the Stamp Act imposed by Great Britain on its American colonies. Throughout history, Americans have toed the line between treason and dissent. Exactly where that line is has remained difficult to ascertain. But these cases serve as a fascinating way to explore and interpret where dissent ends and betrayal begins..

Book Lincoln s Northern Nemesis

Download or read book Lincoln s Northern Nemesis written by Martin Gottlieb and published by McFarland. This book was released on 2021-09-08 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: Clement Vallandigham, an Ohio opponent of the Civil War and of abolition, was thrown out of the country by Abraham Lincoln because of his political views. As a result of his banishment, Vallandigham became a martyr to his cause and was nominated for governor by the Democratic Party in 1863. He ran the race from exile. The stakes in this colorful campaign were enormous, and Lincoln was highly involved, worrying that a Vallandigham victory would be seen as a rejection of the war by voters. That could have been devastating to the Union cause. It also would likely have made Vallandigham--a former congressman from Dayton--a presidential prospect. This book tells the story of a unique event in American history: a president--significantly, Lincoln--banishing a leading opponent, with that opponent then being nominated by a major party for high office in an important state.

Book excerpt: Only hours into the new year of 1863, Abraham Lincoln performed perhaps his most famous action as president by signing the Emancipation Proclamation. Rather than remaining the highlight of the coming months, however, this monumental act marked only the beginning of the most pivotal year of Lincoln’s presidency and the most revolutionary twelve months of the entire Civil War. In recognition of the sesquicentennial of this tumultuous time, prominent Civil War scholars explore the events and personalities that dominated 1863 in this enlightening volume, providing a unique historical perspective on a critical period in American history. Several defining moments of Lincoln’s presidency took place in 1863, including the most titanic battle ever to shake the American continent, which soon inspired the most famous presidential speech in American history. The ten essays in this book explore the year’s important events and developments, including the response to the signing of the Emancipation Proclamation; the battles of Gettysburg and Vicksburg, and other less-well-known confrontations; the New York City draft riots; several constitutional issues involving the war powers of President Lincoln; and the Gettysburg Address and its continued impact on American thought. Other topics include the adaptation of photography for war coverage; the critical use of images; the military role of the navy; and Lincoln’s family life during this fiery trial. With an informative introduction by noted Lincoln scholar Harold Holzer and a chronology that places the high-profile events of 1863 in context with cultural and domestic policy advances of the day, this remarkable compendium opens a window into a year that proved decisive not only for the Civil War and Lincoln’s presidency but also for the entire course of American history.

Available in PDF, EPUB and Kindle. Book excerpt: When crisis requires American troops to deploy on American soil, the country depends on a rich and evolving body of law to establish clear lines of authority, safeguard civil liberties, and protect its democratic institutions and traditions. Since the attacks of 9/11, the governing law has changed rapidly even as domestic threats—from terror attacks, extreme weather, and pandemics—mount. Soldiers on the Home Front is the first book to systematically analyze the domestic role of the military as it is shaped by law, surveying America’s history of judicial decisions, constitutional provisions, statutes, regulations, military orders, and martial law to ask what we must learn and do before the next crisis. America’s military is uniquely able to save lives and restore order in situations that overwhelm civilian institutions. Yet the U.S. military has also been called in for more coercive duties at home: breaking strikes, quelling riots, and enforcing federal laws in the face of state resistance. It has spied on and overseen the imprisonment of American citizens during wars, Red scares, and other emergencies. And while the fears of the Republic’s founders that a strong army could undermine democracy have not been realized, history is replete with reasons for concern. At a time when the military’s domestic footprint is expanding, Banks and Dycus offer a thorough analysis of the relevant law and history to challenge all the stakeholders—within and outside the military—to critically assess the past in order to establish best practices for the crises to come.
