Vallandigham, 1863: By a Military Commission; And the Proceedings Under His Application for a Writ of Habeas Corpus in the Circuit Court of the United States for the Southern District of Ohio In issuing this Report of the Trial of the Hon. Clement L. Vallandigham, by a Military Commission, convened in Cincinnati by order of Major-General Burnside, for language in violation of General Order No. 38, used at Mount Vernon, Ohio, and of the proceedings before the Hon. H. H. Leavitt, in the Circuit Court of the United States for the Southern District of Ohio, under the application for a writ of Habeas Corpus, the publishers are influenced, in part, by the expressed desire of many members of the bar to have such publication made, but chiefly because the great principles involved in the investigation, and the ability and learning displayed in the arguments of counsel and the opinion of the Court, give the cases sufficient interest and importance to justify their preservation in the substantial form of a book. The military orders and the proceedings of the Military Commission are published with the consent of Major-General Burnside; while, through the courtesy of Brigadier-General Cox, the publishers have been enabled to verify their report by a careful comparison with the original record. The arguments of counsel and the opinion of the Court in the Habeas Corpus case have been prepared for the press by their respective authors. Thus the book obtains that authenticity which makes it perfectly reliable both in its historical and judicial aspects. Book excerpt: The Union army's overwhelming vote for Abraham Lincoln's reelection in 1864 has led many Civil War scholars to conclude that the soldiers supported the Republican Party and its effort to abolish slavery. In Emancipation, the Union Army, and the Reelection of Abraham Lincoln Jonathan W. White challenges this reigning paradigm in Civil War historiography, arguing instead that the soldier vote in the presidential election of 1864 is not a reliable index of the army's ideological motivation or political sentiment. Although 78 percent of the soldiers' votes were cast for Lincoln, White contends that this was not wholly due to a political or social conversion to the Republican Party. Rather, he argues, historians have ignored mitigating factors such as voter turnout, intimidation at the polls, and how soldiers voted in nonpresidential elections in 1864. While recognizing that many soldiers changed their views on slavery and emancipation during the war, White suggests that a considerable number still rejected the Republican platform, and that many who voted for Lincoln disagreed with his views on slavery. He likewise explains that many northerners considered a vote for the Democratic ticket as treasonous and an admission of defeat. Using previously untapped court-martial records from the National Archives, as well as manuscript collections from across the country, White convincingly revises many commonly held assumptions about the Civil War era and provides a deeper understanding of the Union Army.

Constitutional systems aim to regulate government behavior through stable and predictable laws, but when their citizens' freedom, security, and stability are threatened by exigencies, often the government must take extraordinary action regardless of whether it has the legal authority to do so. In Extra-Legal Power and Legitimacy: Perspectives on Prerogative, Clement Fatovic and Benjamin A. Kleinerman examine the costs and benefits associated with different ways that governments have wielded extra-legal powers in times of emergency. They survey distinct models of emergency governments and draw diverse and conflicting approaches by joining influential thinkers into conversation with one another. Chapters by eminent scholars illustrate the earliest frameworks of prerogative, analyze American perspectives on executive discretion and extraordinary power, and explore the implications and importance of deliberating over the limitations and proportionality of prerogative power in contemporary liberal democracy.
