Book excerpt: On 22 July 1918 a group of Japanese fishermen's wives met in a small village on the coast to discuss what they could do to lower the spiraling cost of rice. This peaceful meeting gave rise to the 1918 race riots, a series of mass demonstrations and armed clashes that spread rapidly throughout the country on a scale unprecedented in modern Japanese history. In this penetrating study, Michael Lewis questions standard historical interpretations of the riots. What political significance did the riots have in the communities where they occurred? How and why did protest change from region to region or when carried out by different groups? How did officials, community leaders, and businessmen cope with the unrest? What effects did the riots have on national and local political relations and economic ties among these various groups? Lewis argues that the 1918 protests defy a single typology--urban and rural protests had different causes, patterns, forms of mediation, and resolutions. In 1918 Meiji leaders had been struggling for fifty years to create a new citizenry, unified ideologically and consistently supportive of national goals. The disunity revealed by the riots does not suggest that Japan had become polarized between the people and the state; rather, in the wake of the riots, new forms of social policy and public political involvement became possible. In analyzing the changing traditions of Japanese popular protest in the transition from a rural to an industrial economy, Rioters and Citizens suggests that the diversity of Japanese protests necessitates a rethinking of the stereotypical images of prewar Japanese society as blandly uniform and rigidly controlled by government ideology. It further suggests that in Japan, as in Europe, the action of the unenfranchised crowd came to influence the course of political and social change. Against the background of the rapid development of capitalism in Japan after the revolution, and the accompanying emergence of the working class, this study shows how early Japanese socialists drew on both Western influences and elements from traditional Japanese culture. In the early 1980s most of the world interested in Japan was fascinated by its educational system, industrial policy or low crime rates – things which explained the economic miracle and made it ‘Number One’. John Crump, however, was searching for the origins of socialist thought there. Historians of the socialist movement before and since the 1980s have described the thought of those who figure in the dramas Crump describes. What sets his study apart is the degree to which the theoretical debates discussed matter to him. Other authors often lack sympathy with, or seem frustrated by, the importance given to apparently trivial differences that consumed endless debate. However, at the time he wrote this book, the author was still an activist, even though his activity manifested itself mainly in his scholarship. His aim was to do more than give an account of the formation of socialist thought in Japan. He wanted his readers to think more deeply about the development of capitalism in Japan. This book made an original contribution to the study of Japan in the 1980s. Its unique perspective shines a bright light on debates still relevant today.

Mitchell makes a major contribution to our knowledge and understanding of Japan's criminal justice system at a most critical juncture in that country's history. Through careful research and sensitive evaluation of the source materials, Mitchell identifies two contrasting themes--a high degree of state repression and a concern for human rights--and shows how a system that clearly involved considerable brutality, torture, and illegal detention also exhibited elements of humanity and fairness. He argues that this contradiction is best understood by viewing prewar Japan as a "paternalistic police state," in which brutality was the other side of benevolence. The scope of inquiry of this study encompasses a broad range of issues. It assays laws for control of political dissent as well as the origins of the movement for human rights of criminal suspects and convicts, giving special attention to the behavior of defense lawyers. It sorts out the actors and their roles in upholding or violating individual rights and does a superb job of conveying the subtle difficulties faced by judges as well as the markedly "un-American" legal context of political trials. It describes and makes critical distinctions between conditions in prisons and facilities for special detention and surveillance, and it challenges a number of common assumptions, including long-cherished views about the differences between the 1920s and 1930s. Numerous cases of alleged police brutality are evaluated and police actions analyzed. Tenko (conversion), a novel method of dealing with political criminal suspects and convicts, is explored together with the little-known Criminal Compensation Law. Throughout, the yardstick by which treatment of accused and convicted criminals is judged is the state's own laws and regulations. In addition to evaluation by these internal standards, Mitchell devotes his final chapter to a very useful comparison with the situation in Europe during the same period. There is no other work in English on precisely this subject and no other related work of this scope. Although Mitchell's focus is on political offenders, there is enough material on the overall system to make this volume easily the best available resource on prewar Japanese criminal justice.
