Book The Territorial Sea

Download or read book The Territorial Sea written by Richard K. Littleton and published by . This book was released on 1984 with total page 96 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study of the territorial sea examines the history of the territorial sea, and then explores the effects on domestic federal law, on federal-state relations, and on state-state relations if the recent international trend toward a 12-mile limit is followed by the United States. In the first, section, the paper examines practices by various sea-faring peoples and nations which contributed to the evolution of the territorial sea zone. The uncoordinated evolution of this zone in traditional international law is briefly contrasted with the more planned and uniform Convention on the Law of the Sea. The U.N. Convention is not, however, explored in depth. The first section ends with a discussion of the United States' approach to the territorial sea.The second section reviews the change in the status of the United States territorial sea from a state-managed to a federally regulated area. The discussion covers the congressional reaction to a 1947 Supreme Court decision declaring the territorial zone a federally dominated zone; the return of ownership of the territorial sea to the states; and the evolution of federal control beyond and within the territorial sea. Assuming the likelihood that the United States will adopt a 12-mile limit in the future, the paper offers 2 scenarios. In one scenario, only the national territorial limit is extended out to 12 miles. This causes almost no changes in coastal law or in federal-state relations. In the second, both the national and the state boundaries are broadened to 12 miles. It is this second scenario which creates the greatest challenge to federal and state relations because this scenario affects control over mineral and fishery resources. This part of the paper includes a discussion of the inland states' unexpected stake in the mineral resources of a 12-mile territorial sea. The paper concludes with a glimpse of the operation of a 50-state revenue-sharing plan focused on the expanded territorial sea.

Book excerpt: The system of public international law has reached a major turning point in its history and is confronting serious challenges generated by a variety of developments unfolding in the structure of the international society. This Dictionary acquaints legal and other professionals, students, and interested general readers with the basic tenets of public international law, combining the features of both a brief encyclopedic dictionary and a textbook in clear, understandable language. A list of acronyms and abbreviations; a glossary of Latin phrases; a chronology that offers a historical perspective by listing major developments relating to international law throughout the centuries; a table of cases with references to entries; and a list of the 373 entries precede the main text. The survey of international law is organized into nine chapters. Chapter I contains the usual introductory topics found in international law textbooks: the nature of this law, its sources, the relationship between international and national ("municipal") law, and some other general problems. Chapters II-VIII deal with matters coming within the scope of the "law of peace," organized according to the framework consisting of: states, individuals, spatial context, and interaction. Chapter IX, whose subject unfortunately becomes ever more relevant, describes the rules governing the conduct of warfare, that is, international humanitarian law. Numerous cross-references in bold lead the reader to appropriate entries, and the abundant references to primary sources, mostly treaties and court cases, enable the reader to locate the materials needed for research. The selective bibliography includes books, research aids, textbooks, and casebooks, as well as recent books on special international law topics. This Dictionary is a useful addition to both public and academic libraries, including, in particular, libraries of law schools. The format of the book allows it to be used as a reference guide for legal professionals, scholars inter

Book The Sovereignty of the Sea

Download or read book The Sovereignty of the Sea written by Thomas Wemyss Fulton and published by DigiCat. This book was released on 2022-06-02 with total page 564 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is an attempt to bring together all the available information regarding the sovereignty of the British Seas. The author aimed to trace the development of territorial waters during his time, i.e., the early 1900s. The book is split into two sections, the first containing a historical account of the claims made to the authority of the sea; the second dealing with the relic of such claims. Thomas Wemyss Fulton originally undertook this work to deal only with the subjects related to the sea fisheries. It soon became apparent that restricting the scope would lead to multiple disadvantages and present only a partial picture. This brilliant work laid the foundation on which all future research concerning the history of the British Sea Fisheries is based.
