It will be remembered by many that, during the year 1862, a number of soldiers belonging to the army of the North-west deserted, and, returning to 'their homes, were concealed by disaffected partisans. The hero of this story has been selected from a score of these, personally known to the author. The idea of the work was suggested by a friend, who conceived that such a production, showing, as it necessarily must, the influence, for evil, exerted upon susceptible young men in the army by certain political malcontents, might be productive of good. The statement that the majority of the characters who figure here are real, their names only being fictitious, is scarcely necessary, as many of them will be readily recognized. The principal scene has been laid in and about the Hoosier capital, for two reasons: first, because the author is Hoosier, and is partial to Hoosierdom; second, because it is mete that the most gallant of the North-western States should figure in the romance of the present period. She certainly has as much claim to such notoriety as those rebellious States, which have hung so conspicuously hitherto, in the gallery of fiction. But this was not the focus for the Republican members of the Thirty-Ninth Congress. Their interest was instead in Sections 2, 3, and 4. Today we tend to think the purpose of the Fourteenth Amendment was to protect persons of color. But the Republicans engaged in Reconstruction saw its purpose as preventing “rebel rule” by punishing treason and rewarding loyalty, particularly the loyalty of white men who remained faithful to the Union during the Civil War. In this first of three planned volumes for the University Press of Kansas’s Constitutional Thinking series, Mark A. Graber aims to restore to contemporary memory the Fourteenth Amendment drafted by those Republican and Unionist members of Congress who supported congressional reconstruction. In Punish Treason, Reward Loyalty, Graber breaks new ground researching Reconstruction, the Fourteenth Amendment, and constitutionalism by highlighting the importance of Sections 2, 3, and 4 to the representatives in the Thirty-Ninth Congress and their relative indifference to Section 1. This book explores the interrelated work of three thinkers influenced by the pragmatist tradition: Josiah Royce, Wilfrid Sellars, and Richard Rorty. These thinkers’ work spanned the range of twentieth-century philosophy, both historically and conceptually, but all had common concerns about how morality functions and what we can hope for in our interactions with others. Steven Miller argues that Royce, Sellars, and Rorty form a traditional line of inheritance, with the thought of each developing upon the best insights of the ones prior. Furthermore, he shows how three divergent views about the function, possibilities, and limits of moral community coalesce into a key narrative about how best we can work with and for other people, as we strive to come to think of widely different others as somehow being morally considerable as "one of us."
