In the context of transatlantic cooperation in the war on terrorism, divergences in privacy law and policy have become ever more apparent. As has always been the case, the same technologies that pose new and vital privacy issues with regard to personal information and private data are those that are important sources for government actors, including law enforcement and intelligence agencies. Despite the increasing reliance by national agencies on information flowing from other nations, regulation of information transfer, processing and sharing has been achieved largely outside of the international sphere.This Note argues that the use of personal information in the national security setting offers a new and important look at the functions and limitations of global governance in the information age. Exploring the Terrorist Finance Tracking Program (TFTP), a joint initiative among European states and the United States, within the framework of Global Administrative Law (GAL), I argue that common accounts of differences between U.S. and European law on privacy issues do not explain the very real tensions at stake in the TFTP. I show that the TFTP is a real effort at constituting a soft-law mechanism to manage privacy and security in the information age, and argue that it fails to embody those values of transparency, participation, legality, and accountability to which we generally hold GAL mechanisms.

At the time, al Qaeda was operating on an annual budget of between $30 and $50 million. However, despite the obvious fact that terrorists need money to terrorize, preventing the financing of terrorism was not a priority for the United States or the international community prior to 9/11. Jimmy Gurulé, former Under Secretary for Enforcement in the US Department of the Treasury, provides the first book-length, comprehensive analysis of the legal regime that evolved following the terrorist attacks. The book begins with a discussion of how shutting down the pipelines of funding is as important as dismantling the terrorist cells themselves. Next, the book covers the various means and methods used by terrorist groups to raise money, and examines how money is transferred globally to finance their lethal activities. The principal components of the legal strategy to disrupt the financing of terrorism are then discussed and evaluated. Unfortunately, the author concludes that the legal regime has met with mixed results, and finds that the sense of urgency to deprive terrorists of funding that existed following 9/11 has since dissipated. As a result, international efforts to freeze terrorist assets have dramatically declined. Moreover, the US Department of Justice has suffered several embarrassing and disappointing legal defeats in prosecuting major terrorist financiers. The author provides numerous recommendations to Congress, the Executive Branch, and the UN Security Council for strengthening the legal regime to deny terrorists the money needed to wage global jihad, acquire weapons of mass destruction, and launch another terrorist attack on the scale of 9/11. Targeting Terrorist Financing argues that it is not the institutions that have failed the war on terrorist financing; rather it is the states that have failed the institutions. The measures contemplated by the world community to interdict terrorists and their financial infrastructures are sufficient to debilitate the terrorists both militarily and financially. However, what has been increasingly lacking is political will among the states, and this has overwhelmed the spirit of cooperation in this very critical front against terrorism. This volume assesses the need for international cooperation and the role of institutions and regimes in targeting terrorist financing. After the 9/11 attacks, there was an expression of global willingness to target terrorism generally, and terrorist financing in particular. The institutional mechanisms that grew out of this are explored in detail here, with a critical examination of the progress made by the international community. The impact of these measures is considered with respect to changes in the nature of the terrorist threat, money confiscated, adoption of international conventions, and global standards by states, and levels of compliance, among others. Of Privacy and Power investigates how the European Union and United States, the two major regulatory systems in world politics, have regulated privacy and security, and how their agreements and disputes have reshaped the transatlantic relationship. The transatlantic struggle over freedom and security has usually been depicted as a clash between a peace-loving European Union and a belligerent United States. Henry Farrell and Abraham Newman demonstrate how this misses the point. The real dispute was between two transnational coalitions—one favoring security, the other liberty—whose struggles have reshaped the politics of surveillance, e-commerce, and privacy rights. Looking at three large security debates in the period since 9/11, involving Passenger Name Record data, the SWIFT financial messaging controversy, and Edward Snowden’s revelations, the authors examine how the powers of border-spanning coalitions have waxed and waned.
