Book excerpt: Excerpt from The Supreme Court and Unconstitutional Legislation In the text, though state cases have been discussed, an analysis has been made only of the federal statutes held void by the Supreme Court, but in the appendices an attempt has been made to list all cases in which state enactments were declared unconstitutional, by the same court, because of con ict with the federal con stitution. It has been found very difficult to compile even an approximately correct list. Not only are the cases in question scattered among a large number of others, but additional difficulties were encountered. In some instances the information given in the official re ports is scarcely sufficient to determine with exactness whether a statute has been annulled, or whether only an interpretation of it has been given. In other cases a statute has not been held void in words, but the judgment is in opposition to the statute and the result is to de stroy the force of the act. In a considerable number of cases the act directly complained of and checked was that of an administrative body, but as in the majority of instances the state courts had previously held that such action was authorized by law, the conclusion is that a statute was in whole or in part held void. Also in vari ous of the cases listed statutes were held to be void only as they applied to particular facts or a particular set of facts. In all instances, however, the activities of a state were checked, (which is really the important fact), be cause of con ict with the federal constitution, though in some few cases possibly a statute was not technically annulled. The list given may serve as a basis, and later investigations may correct any errors of omission or commission. The list has, however, been carefully checked, and, within the limits set forth above, an attempt has been made to have it as accurate as possible. I have had the more modest design of bringing together within the com pass of a single volume a sufficient number of the leading decisions of the Supreme Court of the United States on constitutional law to form the basis of a university course in that subject. The se-called case system of study is applied to almost all branches of the law, but its application to constitutional law has been retarded by the obvious impracticability of referring a class to the original reports and by the want of a suitable case book of moderate size. It is to meet sncli requirements that this collection has been formed. A work of this kind is necessarily a compromise between the de sirable and the attainable. The exigencies of space have compelled me to exclude numerous instructive decisions which many persons may expect to find and which I would have been glad to print. For the further economy of space, arguments have been omitted and the notes are few. It seemed that the pages required for these features could be more profitably devoted to decisions which must otherwise be excluded. Diplomacy has been reinforced by a variety of agencies to accomplish this purpose, but between the breakdown of diplomacy with its various adjuncts and the outbreak of war an effective remedy must be interposed if the peace of the world is to be preserved. The framers of the more perfect union of the American States felt the failures of diplomacy and were unwilling to assume the risk of war in the settlement of their controversies. They created as a conscious substitute for each a Court of the States, in which controversies of a justiciable nature between them have been decided for a century and more, thus creating 'an international, as well as a domestic tribunal, ' to quote the impressive language of Chief Justice Fuller in Kansas v. Colorado (185 U.S. 125, 146-7, decided in 1902), in which 'we apply Federal law, state law, and international law, as the exigencies of the particular case may demand.' The experience of the Union of American States shows that a court of justice can be created for the Society of Nations, occupying a like position and rendering equal, if not greater, services, applying to the solution of controversies between its members Federal law, state law, and international law, as the exigencies of the particular case may demand.
