Such lawsuits often have their greatest impact outside the courtroom—in the court of public opinion. Brand names that took years and millions of dollars to build have been trashed in days. The companies often seem surprised to be sued, and even more surprised at the public’s interest and apparent acceptance of the allegations. Attacked publicly, these companies often respond aggressively and ineffectively, making the situation even worse. Expensive settlements usually ensue, without any actual proof that the company had discriminated.
