Book excerpt: Traces the genealogy of the Western philosophic concept of the civil state, how that concept was assimilated into Egyptian political thought, and how it affected the 2013 coup against President Mursi. How is the concept of the civil state understood in Arab countries? In The Battle over a Civil State, Limor Lavie examines how this important concept, which originated in Western philosophy, became incorporated into Arab discourse. The civil state as understood in Arab political discourse, Lavie argues, attempts to bridge Islamic history and culture with modernity. It is an attempt to forge a middle ground between a purely theocratic rule and a purely secular rule, and a solution for the tensions between a desire to catch up with global modernization and democratization processes and the desire to reject those same processes. In the political discourse of most of the Arab Spring countries, the concept of the civil state played a pivotal role. In the public debate over the character of Egypt, in particular, following the January 25, 2011 uprising, the demand to establish a civil state was shared by all the political currents. However, when these currents sought to set out basic guidelines for Egypt’s future, it soon became clear that they were far from reaching a consensus, and that the concept of the civil state was at the heart of the controversy between them. The struggle over Egypt's civil character in the post-Mubarak era was the main reason for the turbulence the country experienced on June 30, 2013—leading to the ouster of President Muhammad Mursi. Limor Lavie teaches at Bar Ilan University.

Book excerpt: This book addresses two important matters of current concern to Middle East scholars: firstly, the nature of the Egyptian state and society and the interactive process between them and secondly, how change, which would finally lead to development, can be initiated. The book argues that the Egyptian case represents a weak authoritarian state, which through its coercive and repressive policies towards various societal forces, political parties, professional associations and organisations and individuals, creates a weak society. Individual behaviour in urban and rural communities, sometimes viewed as signs of the strength of societal forces, is seen here as a symptom of a weak and fragmented society. The existence of a weak society in turn impedes government objectives and hinders the implementation of developmental policies and programmes, further weakening the state. This being the case, change has to be initiated externally in both the political and economic spheres.

To achieve this aim, the regime has issued a number of laws and decisions targeting different actors. To fully describe the on-going campaign to restrict Egypt's public space, this paper focus on three main actors involved in the struggle: civil society, universities, and religious organisations. Altogether, it shows the new legal framework that grants the courts and security services power to restrict civil society's activity.

How realistic are these expectations, and in what political contexts can judicial reforms deliver their expected benefits? This book addresses these issues through an examination of the politics of the Egyptian Supreme Constitutional Court, the most important experiment in constitutionalism in the Arab world. The Egyptian regime established a surprisingly independent constitutional court to address a series of economic and administrative pathologies that lie at the heart of authoritarian political systems. Although the Court helped the regime to institutionalize state functions and attract investment, it simultaneously opened new avenues through which rights advocates and opposition parties could challenge the regime. The book challenges conventional wisdom and provides insights into perennial questions concerning the barriers to institutional development, economic growth, and democracy in the developing world.
