Book excerpt: This report summarizes findings of a comprehensive national survey that covers authorizer adoption of Essential Practices, as well as important context about the evolution of the authorizing profession itself. There are some gratifying results, with near-unanimous adoption of such key practices as requiring financial audits of schools and performance contracts between authorizers and schools. The National Association of Charter School Authorizers (NACSA) extensive evaluation work discloses, for example, that there can be wide variation in the quality of contracts executed by one authorizer versus another. It's clear, though, that this report presents a strong argument for capacity and scale: NACSA's survey sample includes nearly all large authorizers active during the 2012-2013 school year. Large authorizers, who oversee approximately 66% of the charter school student population, have increasingly implemented more of NACSA's Essential Practices, whether considered cross-sectionally for each year or longitudinally for authorizers that responded both years. Conversely, the 2013 results indicate that it is more difficult for small authorizers to establish a full range of professional practices. Authorizers located within traditional education systems (local and state education agencies) seem to have a harder time adopting strong authorizer practices than those located in other types of organizations. Independent chartering boards, the statewide agencies created solely to approve and oversee charter schools, score highest among all types of authorizers across a number of categories, suggesting that their tight focus on charter school quality provides a strong incentive for honing their own skills. That is one reason NACSA has fought to establish such agencies and has helped defend them when threatened by legal and political attacks.

Chubb and Moe argue that these reforms are destined to fail because they do not get to the root of the problem. The fundamental causes of poor academic performance, they claim, are not to be found in the schools, but rather in the institutions of direct democratic control by which the schools have traditionally been governed. Reformers fail to solve the problem-when the institutions ARE the problem. The authors recommend a new system of public education, built around parent-student choice and school competition, that would promote school autonomy—thus providing a firm foundation for genuine school improvement and superior student achievement.

The academic and policy debate on charter schools largely focuses on the effect of a state's charter school statutes, specifically the degree of statutory discretion for charter schools, on charter school growth and student achievement. However, we rarely consider the politics in the state capitals that account for the content of a state's charter school statutes in the first place. I argue that a state's legislative institutional capacity affects charter school growth by the degree of statutory and regulatory discretion that state lawmakers grant to local school boards of education. In order to verify this argument, I create new quantitative measures of statutory and regulatory discretion to compare the contents of charter school authorization, renewal, and revocation statutes and regulations within and across forty-one U.S. states with charter school laws from 1991 to 2013. The first chapter argues that legislative term limits has a negative effect on statutory discretion. The second chapter demonstrates the interaction of a state's teacher union strength and the legislative regulatory veto has a positive effect on regulatory discretion. The third chapter argues that statutory discretion has a negative effect on the percent of operating charter schools. Overall, this dissertation demonstrates the effect of legislative institutions on the percent of operating charter schools, the percent of public school students enrolled in charter schools, and the percent of black and Hispanic public school students enrolled in charter schools in a given state.

The authors researched one hundred-fifty schools and sixty authorizing agencies in Arizona, California, Colorado, Georgia, Massachusetts, and Michigan. These states contain the majority of charter schools that have been operating for three years or more and represent the major differences in state charter school legislation. The authors include interviews from a range of participants in the field©¡from state legislators and administrators to principals, teachers, and parents. In assessing the structure of accountability as it works internally to bolster external confidence, Hill and Lake suggest the struggle of charter schools actually complements those of standards based reform. Both seek to transform public education to make schools responsible for performance, not compliance.

Book excerpt: Drawing on interview data from charter school policy actors in New York State, this study applied Kingdon's (1984, 1995/2002) multiple streams model to explain how the system of multiple statewide charter authorizers was created as part of the New York State Charter Schools Act of 1998. A combination of factors influenced the emergence of the law and resulted in an authorizing system that included an effective set of policy entrepreneurs, a strong executive, and a key political opportunity. Ultimately Governor Pataki promoted charter school policy to high agenda prominence by deciding to use the issue as his desired policy in exchange for a legislative pay raise (agenda setting). The findings of the study suggest that the applicability of Kingdon's national-level model to the state level is valid and features a strong participation of the state executive branch.
