The appropriation of water must be for irrigation, mining, milling, manufacturing, the development of power, the construction and Operation of waterworks for cities and towns, or for stock raising. Provided, that so far as practicable and within the limits of the public welfare, the water engineering board hereafter created shall subordinate the appropriation of water power to the appropriation of water for irrigation. Sec. 5. As between appropriators, the first in time is the first in right. Sec. 6. For the purpose of this Act, an appropriator is any person, association of persons, corporation or irrigation district, who has here tofore made beneficial use of any water, in a lawful manner, under the provisions of any act of the Legislature of the State of Texas, prior to the passage of Chapter 171 of the General Laws of the Thirty-third Legislature of Texas, and who has filed with the State Board of Water Engineers a record of his appropriation, as required by said Act of the Thirty-third Legislature, or who has heretofore or may hereafter make beneficial use of any water within the limitations of a permit lawfully issued by the Board of Water Engineers, and no appropriation of any water shall be considered as having been beneficially used for one or more of the purposes named in this act, and for the purpose or pur poses stated in the original declaration of intention to appropriate such water, or stated in the permit issued by the Board of Water Engineers. Book excerpt: Excerpt from Irrigation Works: Constructed by the United States Government Agriculture by irrigation is one of the oldest occupations of civilized man. Various parts of the world show evidences that irrigation was practised long before any historical record was kept. The remains of prehistoric irrigation works have been identified and extensively traced in southern Arizona along the Salt River and in parts of New Mexico and California. American Irrigation was left entirely to private and corporate. enterprise until the passage, in 1902, of the National Reclamation Act, which has been amended and modified from time to time by subsequent acts. The original reclamation act provided for the segregation of the receipts from the sales of public lands in the sixteen Western States and Territories into a special fund to be known as the Reclamation Fund and to be available for the survey, construction, and operation of reclamation projects in those States. It provided that the cost of those projects should be returned to the Reclamation Fund by the owners of private land or entry-men on public land in ten annual installments, no requirement of interest being made. A subsequent act in 1914 extended this time to twenty years. The original act required the expenditure of the major portion of the funds in the States in which it had been received. Under this act about one hundred million dollars have been expended in construction, and twenty-five projects are now in operation and prepared to deliver water to about one million five hundred thousand acres of land, about two-thirds of which was actually irrigated in 1916. The projects undertaken, unlike the early simple diversions upon valleys adjacent to the head works, involved, on the contrary, expensive storage works, high diversion dams, difficult tunnels, or long, expensive canal work upon side hills, where large investment was necessary before any water was brought to the land. It was of great value to the city, from a sanitary point of View, that there was during all these years a private water company, whose plant was operated by steam, supplying water and lights to the citizens. The history of this dam is unique in one respect, and that is in the number of engineers connected with it. Early in 1892 Mr. Joseph P. Frizell resigned, it is asserted, by reason of the fact that he was ham pered in his work by the city authorities. Other engineers resigned for similar causes, and at one time a contractor in charge was ordered to follow the instructions of a city official who was not an engineer. This peculiar method of conducting a great public work called forth severe criticisms from engineering journals. This report shows that for market gardens and for meadows irrigation in humid sections has proven profitable, but it has not yet been practiced in the raising of general farm crops. The cost of securing water supplies in the East far exceeds that in the arid regions, although water is much more plentiful. This suggests that it may be possible to so reduce the cost of water as to render irrigation profitable for many crops which will not repay the expense now incurred. The descriptions of irrigation practice contained in this report should be suggestive to many who are now raising truck without the aid of irrigation, and it is therefore rec ommended that the report be published as a bulletin of this Office. But the principles on which Irrigation Engineering is based can be collected in small compass, and be illustrated by examples of actual practice to the extent that space allows. What, therefore, this work attempts to do is to set forth the guiding principles that should govern the practice of irrigation, and to furnish illustrations of their application in existing canal systems. The majority of the illustrations have been selected from the wealth of material that the irrigation experience of India and Egypt supplies, for the following reasons. In the first place, I have been personally connected with irrigation in both countries, and can therefore handle the facts, relating to them, as one having authority on the subject, and not as the scribes, Whose methods I might be imitating were I to draw my illustrations from the records of other countries. In the second place, it is India that furnishes examples of irrigation on the largest scale, and that has been the school in which all British irrigation engineers, previously to England's occupa tion of Egypt, have undergone their training. Moreover, the excellent standard work on the subject, The Irrigation Works of India, by R. B. Buckley, provides in a convenient form more than enough material for copious illustrations, and I have made much use of it, with Mr. Buckley's kind permission. But it will be found that Egypt has been the favourite source of my borrowing. There are two good (so it appears to me) reasons for this. The first is that I am intimately acquainted with Egypt as an irrigating country. The second is that Egypt is par excellence the country of irrigation, as it is wholly depen dent for its existence on its mother, the Nile, from which it has never been weaned. In attempting to give this broad survey, the presentation has been made as simple and concise as possible.
