If we were at home; if we were each in our own respective circles, amidst the men of business, and min gling with all classes; and if we were hearing, as in that case we should hear, every hour, of more and more trouble, of new individual disasters, and of still increasing fear and alarm; and if we could witness, as we then should witness, the despondency of those heads of families whose occupations and means of hving have been thus suddenly cut off, we should be convinced that it is the imperative and solemn duty of Congress to relieve the country without a moment's delay. Sir, if half the time and the study which are now devoted to the finding out of plausible arguments to justify the Secretary of the Treasury were given to an honest and thorough inquiry into the real state of the country, I fully believe all would see the absolute necessity of immediate redress. Every topic in the wide range of our public affairs, whether past or present, every thing, general or local, whether belonging to national politics or party politics, - seems to have attracted more or less of the honorable mem ber's attention, save only the resolution before the Senate. He has spoken of every thing but the public lands; they have escaped his notice. To that subject, in all his excursions, he has not paid even the cold respect of a passing glance. When this debate, Sir, was to be resumed, on Thursday morning, it so happened that it would have been convenient for me to be elsewhere. The honorable member, however, did not incline to put Off the discussion to another day. He had a shot, he said, to return, and he wished to discharge it. That shot, Sir, which he thus kindly informed us was coming, that we might stand out of the way, or prepare ourselves to fall by it and die with decency, has now been received. Under all advan tages, and with expectation awakened by the tone which pre ceded it, it has been discharged, and has spent its force. It may become me to say no more of its effect, than that, if nobody is found, after all, either killed or wounded, it is not the first time, in the history of human affairs, that the vigor and success of the war have not quite come up to the lofty and sounding phrase of the manifesto. It is fortunately not an inferred or constructive power, but one of the express grants of the Constitution. Congress shall have power to establish uni form laws on the subject of bankruptcies throughout the United States. These are the words of the grant; there may be ques tions about the extent of the power, but there can be none of its existence. The bill which has been reported by the committee provides for voluntary bankruptcies only. It contains no provisions by which creditors, on an alleged act of bankruptcy, may proceed against their debtors, with a View to subject them and their prop erty to the Operation of the law. It looks to no coercion by a creditor to make his debtor a subject of the law against his will. This is the first characteristic of the bill, and in this respect it certainly differs from the former bankrupt laws of the United States, and from the English bankrupt laws. The bill, too, extends its provisions, not only to those who, either in fact or in contemplation of law, are traders, but to all persons who declare themselves insolvent, or unable to pay their debts and meet their engagements, and who desire to assign their property for the benefit of their creditors. By the law of New Jersey, if any citizen of that State shall be restrained, under the New York law, from using steamboats be tween the ancient shores of New Jersey and New York, he shall be entitled to an action for damages, in New Jersey, with treble costs against the party who thus restrains or impedes him under the law of New York! This act of New Jersey is called an act of retortion against the illegal and oppressive legislation of New York; and seems to be defended on those grounds of public law which justify reprisals between independent States. It will hardly be contended, that all these acts are consistent with the laws and Constitution of the United States. If there is no power in the general government to control this extreme belligerent legislation of the States, the powers of the govern ment are essentially deficient in a most important and interest ing particular. The present controversy respects the earliest of these State laws, those of New York. On these, this court is now to pronounce; and if they should be declared to be valid and Operative, I hope somebody will point out where the State right stops, and on what grounds the acts of other States are to be held inoperative and void. It will be necessary to advert more particularly to the laws of New York, as they are stated in the record. The first was passed March lgth, 1787. By this act, a sole and exclusive right was granted to John Fitch, of making and using every kind of boat or vessel impelled by steam, in all cree 's, rivers, bays, and waters within the territory and jurisdiction of New York, for fourteen years. If there have been times and occasions in my life when I might be sup posed anxious to exhibit myself in such a light, that period has passed, and this is not one of the occasions. I come to dictate and prescribe to no man. If my experience, not now short, in the affairs of government, entitle my opinions to any respect, those Opinions are at the service of my fellow-citizens. What I shall state as facts, I hold myself and my character responsible for; what I shall state as opinions, all are alike at liberty to reject or to receive. I ask such consideration for them only as the fair ness and sincerity with which they are uttered may claim.
