Canada's Species at Risk Act (SARA) presents new requirements for identifying critical habitat-and new measures for protecting it. Whether you're installing a new culvert, starting a new dredging operation, or developing a hydroelectric power dam, here's what you should know about SARA. The Species at Risk Act (SARA) was created to prevent wildlife species from becoming extinct. It requires Canada to provide for the recovery of species at risk due to human activity, and to manage species of special concern, making sure they don't become endangered or threatened. SARA not only prohibits the killing, harming, harassing, capturing or taking of species at risk, but also makes it illegal to destroy their critical habitats. The Act became law in June 2003, and becomes enforceable in June 2004.

Book excerpt: The US Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS) are responsible for protecting species that are listed as endangered or threatened under the Endangered Species Act (ESA) and for protecting habitats that are critical for their survival. The US Environmental Protection Agency (EPA) is responsible for registering or reregistering pesticides under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and must ensure that pesticide use does not cause any unreasonable adverse effects on the environment, which is interpreted to include listed species and their critical habitats. The agencies have developed their own approaches to evaluating environmental risk, and their approaches differ because their legal mandates, responsibilities, institutional cultures, and expertise differ. Over the years, the agencies have tried to resolve their differences but have been unsuccessful in reaching a consensus regarding their assessment approaches. As a result, FWS, NMFS, EPA, and the US Department of Agriculture asked the National Research Council (NRC) to examine scientific and technical issues related to determining risks posed to listed species by pesticides. Specifically, the NRC was asked to evaluate methods for identifying the best scientific data available; to evaluate approaches for developing modeling assumptions; to identify authoritative geospatial information that might be used in risk assessments; to review approaches for characterizing sublethal, indirect, and cumulative effects; to assess the scientific information available for estimating effects of mixtures and inert ingredients; and to consider the use of uncertainty factors to account for gaps in data. Assessing Risks to Endangered and Threatened Species from Pesticides, which was prepared by the NRC Committee on Ecological Risk Assessment under FIFRA and ESA, is the response to that request.

Specific occupied areas designated as critical habitat for the Carolina DPS of Atlantic sturgeon contain approximately 1,939 km (1,205 miles) of aquatic habitat in the following rivers of North Carolina and South Carolina: Roanoke, Tar-Pamlico, Neuse, Cape Fear, Northeast Cape Fear, Waccamaw, Pee Dee, Black, Santee, North Santee, South Santee, and Cooper, and the following other water body: Bull Creek. Book excerpt: The tension between wildlife protection under the Endangered Species Act and water management in the Platte River Basin has existed for more than 25 years. The Platte River provides important habitat for migratory and breeding birds, including three endangered or threatened species: the whooping crane, the northern Great Plains population of the piping plover, and the interior least tern. The leading factors attributed to the decline of the cranes are historical overhunting and widespread habitat destruction and, for the plovers and terns, human interference during nesting and the loss of riverine nesting sites in open sandy areas that have been replaced with woodlands, sand and gravel mines, housing, and roadways. Extensive damming has disrupted passage of the endangered pallid sturgeon and resulted in less suitable habitat conditions such as cooler stream flows, less turbid waters, and inconsistent flow regimes. Commercial harvesting, now illegal, also contributed to the decline of the sturgeon. Endangered and Threatened Species of the Platte River addresses the habitat requirements for these federally protected species. The book further examines the scientific aspects of the U.S. Fish and Wildlife Service's instream-flow recommendations and habitat suitability guidelines and assesses the science concerning the connections among the physical systems of the river as they relate to species' habitats.
