Book Deeds Titles and Changing Concepts of Land Rights

Download or read book Deeds Titles and Changing Concepts of Land Rights written by David Ress and published by Springer Nature. This book was released on 2020-12-09 with total page 115 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the history of public land tenure records, which first began in colonial Massachusetts as English settlers and Native Americans tried to resolve differing ideas about rights to land in the seventeenth century. In South Australia, a similar method of state certification of land ownership arose in the nineteenth century, through Torrens system title registration – a process that would be widely adopted in British and American colonies as a particularly effective way of guaranteeing absolute ('fee simple') ownership over indigenous peoples’ land. This book explores the similarities between these two record systems, highlighting how similar settlement patterns and religious beliefs in both places focused attention on recording land tenure, and illustrating how these record systems encouraged new ways of thinking about rights to and on land.

Book Private Property and Environmental Responsibility

Download or read book Private Property and Environmental Responsibility written by Murray J. Raff and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: This remarkable new book is not a radical text, but seeks to find a principle of responsible proprietorship in our existing legal systems. And in fact it presents an excellent case for the international recognition of a principle of responsible proprietorship in the title registration systems derived from the German model, rooted in the historical Hanseatic model; primarily the Australian Torrens system that spread throughout the British Empire from the mid-nineteenth century on. In great detail, the author demonstrates that this system offers a firm foundation on which a truly responsible environmental law of property can be established.

This book was released on 2016-09-22 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Boundaries of Australian Property Law offers a unique perspective on real property law in Australia. As the overwhelming majority of land interests in Australia now fall under the Torrens title system, this book's particular focus on the development and operation of the Torrens system in Australia is both timely and welcome. Addressing the prescribed Priestly 11 requirements for a property law subject in Australia, this informative and academically rigorous book includes carefully selected statutory material and case law from all Australian jurisdictions, as well as the United Kingdom. The general law system is also discussed and referred to where necessary, to give context and depth to the analysis of real property law. Written by prominent real property law academics from law schools around Australia, and edited by Hossein Esmaeili and Brendan Grigg, this text is a modern and much-needed addition to real property law literature.

  • Author : Austin Sarat
  • Publisher : University of Michigan Press

Download or read book The Place of Law written by Austin Sarat and published by University of Michigan Press. This book was released on 2009-04-21 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: It has long been standard practice in legal studies to identify the place of law within the social order. And yet, as The Place of Law suggests, the meaning of the concept of "the place of law" is not self-evident. This book helps us see how the law defines territory and attempts to keep things in place; it shows how law can be, and is, used to create particular kinds of places -- differentiating, for example, individual property from public land. And it looks at place as a metaphor that organizes the way we see the world. This important new book urges us to ask about the usefulness of metaphors of place in the design of legal regulation.
