Book excerpt: The proposed regulations would reduce the time for claiming Pension Credit and Housing Benefit/Council Tax Benefit for those who have attained the qualifying age for Pension Credit, from 12 to 3 months, and reduce the period for which claims to Housing Benefit and Council Tax Benefit (HB/CTB) for customers of working age may be backdated, from 52 weeks to 3 months. The regulations also proposed to extend the period for which Pension Credit customers may retain entitlement whilst temporarily absent from Great Britain from 4 to 13 weeks. The Department for Work and Pensions aims to save £260 million by these changes, and to make the administration of the benefits more efficient. The Committee broadly welcomes the changes to the rules on temporary absence abroad, but is not convinced of the case to generate savings by reducing entitlement to HB and CTB and Pension Credit for some of the Department's most vulnerable and excluded customers. The changes will increase indebtedness and evictions, and the Committee believes the economic cost of increased possession proceedings (including the costs of re-housing and other services) have not been factored into the Department's calculations.

Book excerpt: Considering the importance of legal frameworks in laying down governance and accountability frameworks, clarifying the responsibilities of relevant public and private entities and defining the long term and budgetary commitment of states, the capacity of countries to adopt and enforce laws in pertinent areas is crucial to reducing rural poverty. Countries have signed up to international and regional instruments that are of relevance to rural poverty and have adopted policies and legislation in these areas. However, a number of normative, institutional and operational challenges exist in different countries. These include regulatory gaps in some areas such as social security for agricultural workers; the existence of laws that sustain discriminatory practices, for example, in relation to inheritance of property; and inconsistencies in norms and institutional mandates in the area of natural resource governance. Even with relatively good laws, their practical implementation may be wanting due to limitations of capacity to implement them. These problems would require a range of measures on the part of state and non‐state actors, including the adoption or revision of laws as well as awareness‐raising and legal empowerment. This legal paper explores the significance of legislative frameworks to poverty reduction efforts, with a particular focus on human rights. It highlights sectoral areas for legislative intervention and identifies normative, procedural and institutional challenges that states encounter while implementing poverty reduction programmes. It further refers to examples from state practice and provides recommendations on how relevant actors can make use of legislation to address rural poverty.

Book excerpt: The 2008 Act falls into five main parts, whose main objectives were: to establish the Care Quality Commission; to change arrangements for regulation of health professionals and of the health and social care workforce; to update the Public Health (Control of Disease) Act 1984; to create the Health in Pregnancy Grant; and to make miscellaneous other changes in relation to health and social care. Most of the provisions of the Act are now in force (in some cases with amendments made by later legislation). The main exceptions include part 2 sections 124-126, which dealt with various matters in the remit of the General Social Care Council, and were not commenced. Instead, the Council was abolished, and its functions were transferred to the Health and Care Professions Council, in 2012. Part 3 provisions relating to port health have not yet been commenced, but the intention is that they will come into force at the same time as new port health regulations. The Act achieved its objectives (or in the case of port health, is in the process of doing so), with the exception of the creation of the Office of the Health Professions Adjudicator.
