Book excerpt: The Society of Jesus was founded by Ignatius Loyola on a principal of strict obedience to papal and superiors’ authorities, yet the nature of the Jesuits's work and the turbulent political circumstances in which they operated, inevitably brought them into conflict with the Catholic hierarchy. In order to better understand and contextualise the debates concerning obedience, this book examines the Jesuits of south-western Europe during the generalate of Claudio Acquaviva. Acquaviva’s thirty year generalate (1581-1615) marked a challenging time for the Jesuits, during which their very system of government was called into doubt. The need for obedience and the limits of that obedience posed a question of fundamental importance both to debates taking place within the Society, and to the definition of a collective Jesuit identity. At the same time, struggles for jurisdiction between political states and the papacy, as well as the difficulties raised by the Protestant Reformation, all called for matters to be rethought. Divided into four chapters, the book begins with an analysis of the texts and contexts in which Jesuits reflected on obedience at the turn of the seventeenth century. The three following chapters then explore the various Ignatian sources that discussed obedience, placing them within their specific contexts. In so doing the book provides fascinating insights into how the Jesuits under Acquaviva approached the concept of obedience from theological and practical standpoints.

During this time of expanding empires, religious upheaval, and social change, new ideas about the organisation and purpose of human communities began to be debated. In particular, there was a concern to understand the political or civil community as bounded, limited in geographical terms and with its own particular structures, characteristics and history. There was also a growing focus, in the wake of the Reformation, on civil or political authority as distinct from the church or religious authority. The concept of sovereignty began to be used, alongside a new language of reason of state—in response, political theories based upon religion gained traction, especially arguments for the divine right of kings. Yet the equation between the state and the nation does not go back far in history, despite the prevailing tendency to view the state as closely linked to ethnicity. To challenge the latter this book attempts to examine statehood separately from the concept of ethnicity; it asks what is non-ethnic about statehood by looking at 'statehood before and beyond ethnicity'. A non-ethnic statehood is analysed in two forms: as a historical phenomenon at the time of the emergence of the early modern state (Part One) and as a historical tradition which had been pursued by the nation-builders in the nineteenth and twentieth centuries (Part Two). Instead of looking at great powers as traditional models of statehood, individual chapters focus on minor and less familiar states in Northern and Eastern Europe from the period c. 1600-2000, including Belgium, Bohemia, Greece, the Netherlands, Romania, Poland-Lithuania, Serbia and Montenegro, Sweden, Scotland and Transylvania.

The Charter of the United Nations clearly prohibits the use of force, with the only exceptions being self-defence and enforcement actions authorized by the Security Council. There are, however, long-standing arguments that a right of unilateral intervention pre-existed the Charter. This book, which won the ASIL Certificate of Merit in 2002, begins with an examination of the genealogy of that right, and arguments that it might have survived the passage of the Charter, either through a loophole in Article 2(4) or as part of customary international law. It has also been argued that certain `illegitimate' regimes lose the attributes of sovereignty and thereby the protection given by the prohibition of the use of force. None of these arguments is found to have merit, either in principle or in the practice of states. A common justification for a right of unilateral humanitarian intervention concerns the failure of the collective security mechanism created after the Second World War. Chapters 4 and 5, therefore, examine Security Council activism in the 1990s, notable for the plasticity of the circumstances in which the Council was prepared to assert its primary responsibility for international peace and security, and the contingency of its actions on the willingness of states to carry them out. This reduction of the Council's role from substantive to formal partly explains the recourse to unilateralism in that decade, most spectacularly in relation to the situation in Kosovo. Crucially, the book argues that such unilateral enforcement is not a substitute for but the opposite of collective action. Though often presented as the only alternative to inaction, incorporating a `right' of intervention would lead to more such interventions being undertaken in bad faith, it would be incoherent as a principle, and it would be inimical to the emergence of an international rule of law.
