Book excerpt: In this chapter, I describe attempts to improve groundwater management in California in a context about which serious people have concluded [with language I once considered inappropriate but am now convinced is accurate] the law has been “a mess”.I summarize new legislation that is attempting to employ some of the principles that leading policy scholars have identified to make the management of California's ground water more equitable. I lay out the challenges to developing new governance mechanisms in the context of radically different interests, a wide range of understandings of groundwater rights, and a changing physical environment. I then speculate on the prospects for success of the new governance regime including with reference to alternative regulatory and market strategies that are being used (or considered) to provide for better management. My analysis addresses legal issues that arise and need to be analyzed or confronted in consideration of new law. The challenges may be several. Among coverage: I attempt to respond to the chilling effect of threatened takings challenges to changes in groundwater rights. And I address how notions of equity and sustainability science may affect legal analysis in an era of scarcity.

The extremely rapid rise in groundwater use in many Indian states has led to a growing groundwater crisis that they must address. The existing regulatory framework has not adapted to the challenges and fails to address any environmental concerns. On climate change, India has adopted a policy framework that makes the link with water, but no legislation has followed up to make the link operational. The subject matter of this book has been widely debated with regard to each of its main two components separately. Bringing these two domains together is what makes this book unique. The link between climate change and groundwater has been acknowledged to some extent, and there is growing interest in studying the impacts of climate change on (ground)water. Similarly, in water and environmental law and policy, increasing attention has been given to the study of climate change and groundwater legal and policy frameworks but generally separately. This book contributes to filling this knowledge gap by drawing on contributions from leading experts in the field of environmental and water law and policy who have been involved in climate change and/or groundwater research. This is done through the comparative and contrasting investigation of six case studies from countries from the Global North and Global South. It offers a different perspective of literature given that it explains how groundwater governance and law are in practice rather than what they should be. Additionally, the research presented in this book provides ideas on how to rethink the design and implementation of groundwater law grounded on empirically based descriptions and the understanding of groundwater problems.
