Book excerpt: The National Strategy for Maritime Security discusses the threats to the United States' maritime security through acts committed by nation-states and terrorist organizations. To enforce maritime security, the nation's strategic objectives include preventing terrorist attacks and hostile criminal acts in protection of maritime industry, ensuring the safety of coastal population centers and infrastructure, instituting measures to safeguard the maritime domain to include territorial seas and internal waterways. The United States must thus act to increase security for seaborne commerce, and create depth of enforcement through the assets of the Department of Homeland Security and the Department of Defense to ensure the nation's maritime transportation system is defended and secure. This paper defines the roles of the Departments of Homeland Security and Defense, as well as the respective missions and means of the Coast Guard and Navy to protect the nation's maritime domain. Coordination and interoperability between the two services is reviewed with an emphasis on seams, gaps, and vulnerabilities identified in counter to Coast Guard and Navy efforts to provide security and defense for the nation's maritime boundaries and commercial ports. The paper concludes with recommendations to mitigate those seams and vulnerabilities detected in this research.

The overarching issues for Congress are providing oversight on current port security programs and making or responding to proposals to improve port security. The US maritime system consists of more than 300 sea and river ports with more than 3,700 cargo and passenger terminals. However, a large fraction of maritime cargo is concentrated at a few major ports. Most ships calling at US ports are foreign owned with foreign crews. Container ships have been the focus of much of the attention on seaport security because they are seen as vulnerable to terrorist infiltration. More than 9 million marine containers enter US ports each year. While the Bureau of Customs and Border Protection (CBP) analyses cargo and other information to target specific shipments for closer inspection, it physically inspects only a small fraction of the containers. The Coast Guard and CBP are the federal agencies with the strongest presence in seaports. In response to September 11, 2001, the Coast Guard created the largest port-security operation since World War II. The Coast Guard has advanced its 24- hour Notice of Arrival (NOA) for ships to a 96-hour NOA. The NOA allows Coast Guard officials to select high risk ships for boarding upon their arrival at the entrance to a harbor. CBP has also advanced the timing of cargo information it receives from ocean carriers. Through the Container Security Initiative (CSI) program, CBP inspectors pre-screen U.S.-bound marine containers at foreign ports of loading. The Customs Trade Partnership Against Terrorism (C-TPAT) offers importers expedited processing of their cargo if they comply with CBP measures for securing their entire supply chain. To raise port security standards, Congress passed the Maritime Transportation Security Act of 2002 (P.L. 107-295) in November 2002. The focus of debate in Congress has been about whether current efforts to improve port security are adequate in addressing the threat. While many agree that Coast Guard and CBP programs to address the threat are sound, they contend that these programs represent only a framework for building a maritime security regime, and that significant gaps in security still remain.

Efforts to address the small vessel environment have largely been limited to traditional safety and basic law enforcement concerns. Small vessels are, however, readily vulnerable to potential exploitation by terrorists, smugglers of weapons of mass destruction (WMDs), narcotics, aliens, and other contraband, and other criminals. Small vessels have also been successfully employed overseas by terrorists to deliver Waterborne Improvised Explosive Devices (WBIEDs). Law enforcement agencies face the challenge of distinguishing between the vast number of legitimate vessel operators and the relatively few individuals engaged in illicit activities. The challenge is immense, as it involves nearly 13 million registered U.S. recreational vessels, 82,000 fishing vessels, and 100,000 other commercial small vessels. On any given day, a considerable number of these boats share waterways with commercial and military traffic, operating at hundreds of U.S. ports and in the immediate vicinity of critical maritime infrastructure, including bridges and waterfront facilities such as petrochemical plants. More information concerning small vessels is needed to improve the proper assessment of the risk posed by these vessels. The challenge is to balance the collection of requisite information necessary for proper assessment of risk posed by these vessels, with the freedom of the seas expected by the small boating community.

Book excerpt: The failed attempt by Dubai Ports World (DP World) to operate marine terminals at some U.S. ports raises the issue of whether foreign marine terminal operators pose a threat to U.S. homeland security. Notwithstanding the proposed sale of U.S. terminal operations by DP World to a U.S. entity, the underlying issue remains because many U.S. marine terminals are operated by foreign-based companies and a similar transaction could occur in the future, given the global nature of the shipping industry. Evaluating the potential security ramifications of foreign-based terminal operators requires first understanding how ports work and who is in charge of their security. Most major U.S. ports are publicly owned by a "port authority," which is a public organization associated with a city, county, regional, or state government. A port typically contains many terminals that are each designed to handle different types of cargo. Some port authorities operate all or some of their marine terminals, but most ports lease their facilities to several different terminal operating companies. All of the cargo handling that takes place on a marine terminal is performed by members of a longshoremen's union. The Coast Guard is in charge of the security of port facilities and vessels, and Customs and Border Protection (CBP) is in charge of the security of cargo. Coast Guard regulations and CBP security guidelines require terminal operators to provide basic security infrastructure, such as fences, gates, and surveillance cameras, and follow certain security practices when handling cargo. The Transportation Security Administration (TSA) is developing a credentialing process for screening port workers. However, port security involves much more than the measures put in place within the immediate vicinity of a U.S. port complex. Not finding a terrorist-placed weapon until after it reaches a U.S. port could be too late to prevent a potentially catastrophic event. Thus, securing the cargo and ships in transit to U.S. ports is critical and consequently the bulk of federal security activity takes place before cargo is unloaded at U.S. ports. Key layers of security are CBP's scrutiny of U.S.-bound cargo at the overseas port of loading and the Coast Guard's scrutiny of ships before they enter U.S. harbors. The necessity of pushing the border out to counter the terrorist threat requires the cooperation of shippers, carriers, ports, and border agencies in the country of origin to take security precautions with U.S.-bound cargo. Global terminal operators like DP World may handle U.S. cargo at the overseas loading port, even if they do not handle it at a U.S. port. Thus, a key issue for policymakers is deciding under what conditions the United States should trust foreign cargo-handling entities and whether they should be treated as partners in securing U.S. supply lines. The DP World controversy refueled debate about whether the nation is doing enough, with sufficient urgency, to secure U.S. ports. In its oversight role, Congress is assessing the effectiveness of Coast Guard and CBP maritime security initiatives and faces pressing questions about the overall security of ports and maritime commerce. This report will not be updated.

Book excerpt: The purpose of this study was to explore the modern threats to the maritime homeland security environment and the effectiveness of Area Maritime Security Committees (AMSCs) in preventing and responding to transportation security incidents. AMSCs are deliberately designed to encompass senior representatives of numerous stakeholders in the maritime homeland security enterprise, such as law enforcement, fire, industry, and labor. There were two research questions used in this project: What are the strengths, weaknesses, opportunities, and threats to the effectiveness of AMSCs, and how can AMSCs improve their interagency collaboration to enhance the homeland security enterprise? Two rounds of Delphi surveys were conducted to evaluate the effectiveness of AMSCs. These were issued to 24 people from five Captain of the Port Zones across the West Coast of the United States. The survey answers were then evaluated against open-source reports produced by AMSCs. Between these research sources, AMSCs were shown to be positive collaboration and information-sharing mechanisms, but geography creates barriers to participation and effectiveness. In order to improve, AMSCs must increase funding, change policy to fund the travel and training of AMSC members, recruit and provide engaging training for new personnel, and establish metrics of performance. Book excerpt: The United States has enduring national and strategic interests in the polar regions, including citizens living above the Arctic circle and three year-round scientific stations in the Antarctic. Polar icebreaking ships are needed to access both regions. Over the past several decades, the U.S. government has supported a fleet of four icebreakersâ€"three multi-mission U.S. Coast Guard ships (the POLAR SEA, POLAR STAR, and HEALY) and the National Science Foundation's PALMER, which is dedicated solely to scientific research. Today, the POLAR STAR and the POLAR SEA are at the end of their service lives, and a lack of funds and no plans for an extension of the program has put U.S. icebreaking capability at risk. This report concludes that the United States should continue to support its interests in the Arctic and Antarctic for multiple missions, including maintaining leadership in polar science. The report recommends that the United States immediately program, budget, design, and construct two new polar icebreakers to be operated by the U.S. Coast Guard. The POLAR SEA should remain mission capable and the POLAR STAR should remain available for reactivation until the new polar icebreakers enter service. The U.S. Coast Guard should be provided sufficient operations and maintenance budget to support an increased, regular, and influential presence in the Arctic, with support from other agencies. The report also calls for a Presidential Decision Directive to clearly align agency responsibilities and budgetary authorities.
