This study is the first to compile and analyze China's refusals of imported food in order to assess regulatory compliance problems identified by inspectors at the Chinese border. China rejected less than 1 percent of imported food shipments from all countries and regions during 2006-19. The rate of refusal varies from year to year. Some potential exporters may be deterred from selling to China due to risks of heightened scrutiny at certain times, strict requirements for documentation and labeling, and standards that may require reformulation of products. The European Union (EU) had the largest number of refusals of any exporter, mainly because its food exports to China are predominantly processed and packaged products, which China refuses more frequently. China's refusal rate of U.S. foods was slightly less than the average for all countries and regions.

Book excerpt: Outsourcing regulatory power through a bilateral agreement with China is unlikely to ensure the safety of imported food for two primary reasons: (1) shifting the regulatory burden does not present a feasible alternative to the traditional enforcement tools of outcome-based and production-based inspections and sanctions; and (2) China's burgeoning food safety regime, based on an entirely different culture and legal system, provides little incentive for Chinese food manufacturers to increase production costs to comply with U.S. standards. There are three approaches for securing food safety in the U.S.: (1) increase inspections at the borders by utilizing traditional outcome-based enforcement tools; (2) certify and inspect foreign food facilities, utilizing production-based enforcement tools on exports to the U.S.; and (3) reduce imports by increasing domestic production. The most sensible approach to ensuring food safety in the United States is to increase domestic production. This approach, however, is difficult to implement, because it largely hinges on consumer demand.U.S. food safety problems pale in comparison to those in China. There is no shortcut to food safety. Utilizing traditional outcome and production-based enforcement tools for imported foods is the only way to ensure food safety. Regulatory costs are inevitable. When the Food and Drug Administration implements direct supervision over imported foods, the rising regulatory costs will force importers to be vigilant about selecting supply sources, resulting in increased food safety. Greater regulatory expenditures will also put domestic foods on an equal footing with imported foods in terms of market competition. The simple truth is that with lax governmental regulation, producers under-invest in food safety. Consequently, regulatory power over food safety cannot be delegated.

Book excerpt: The role of China as one source of U.S. food imports is becoming more and more important, but in recent years there have been several serious incidents about safety issues of food imported from China. This dissertation aims at finding solution for this problem from two different approaches: scientific and behavioral. In the scientific approach, surface enhanced Raman spectroscopy (SERS) coupled with two types of nanosubstrates was used to detect various chemical contaminants in real food matrices. The results showed that SERS has great potential in first-line food safety defense as a rapid, reliable, and accurate method. In the behavioral approach, we modeled food safety practices among Chinese in the United States and surveyed effects of technology advancement on Chinese food exporters' beliefs of business ethics. Among the various findings, the most important one was that the compliance with business ethics standards cannot be improved by technology advancement solely. This dissertation highlights the importance of connecting scientific research with behavioral intervention programs.

We saw a vivid example of this in 2006 and 2007 when adulterated Chinese pet treats killed almost 2,000 U.S. cats and 2,220 U.S. dogs. More recently in 2017 more than 600 Canadians contracted norovirus from frozen Chinese raspberries, including many children and senior citizens who are more sensitive to the virus's effect. The United States can learn from outbreaks like these as the U.S. and Canada import similar products from China and U.S. citizens were similarly affected by Chinese imports in 2016. Chinese food imports carry several risks that must be adequately managed. First, China's industrial development has left much of its air, soil, and water heavily polluted and this contamination has found its way into Chinese crops. Second, China has thousands of small-scale food producers who don't often follow proper food safety procedures. Finally, while China has made progress in reforming the legal framework behind its food safety regime, implementation of this framework has been frustrated by a dearth of qualified Chinese inspectors.

Book excerpt: The United States has a high stake in China's serious food safety problem, as food products of Chinese origin have dominated the US food market in numerous areas and continued to grow. The conclusion of the US-China Food Safety Agreement has allowed the FDA to strengthen regulatory cooperation with its Chinese counterpart in various aspects. The Agreement also paves the way for the implementation of the new regulatory tools incorporated in FSMA, especially in the cross-border context. However, both the Agreement and FSMA have certain crucial limitations that may create future hurdles to effective implementation in the US China cooperation. This paper therefore endeavors to first examine China's governance challenges over food safety, with a focus on the 2009 Food Safety Law, the 2015 Amendment, and the fundamental problem of “thin” rule of law. This paper moves to analyze the US-China Food Safety Agreement, reviewing the agreement's strengths and weaknesses. It further assesses FSMA's innovative institutional design to regulate imported food products and its limitations. However, both the US-China Food Safety Agreement and FSMA arguably create a regulatory dilemma for the FDA when addressing imported food safety, due to structural mismatch between the broad scope of power granted to the FDA and the long chain of power outsourcing to governments or private companies as primary “regulators.” Neither the Agreement nor FSMA give the FDA adequate capacity to closely oversee such “agents” along the chain of power outsourcing. Framing the US-China food safety cooperation as a multilayer structure that “outsources power” in order to “import safety,” this paper concludes by stressing the need for a robust accountability and effective mechanism for US-China food safety cooperation.
