It offers a new perspective on the sustainable governance of common resources, grounded in contemporary and archival research on the common lands of England and Wales - an important common resource with multiple, and often conflicting, uses. It encompasses ecologically sensitive environments and landscapes, is an important agricultural resource and provides public access to the countryside for recreation. Contested Common Land brings together historical and contemporary legal scholarship to examine the environmental governance of common land from c.1600 to the present day. It uses four case studies to illustrate the challenges presented by the sustainable management of common property from an interdisciplinary perspective - from the Lake District, Yorkshire Dales, North Norfolk coast and the Cambrian Mountains. These demonstrate that cultural assumptions concerning the value of common land have changed across the centuries, with profound consequences for the law, land management, the legal expression of concepts of common 'property' rights and their exercise. The 'stakeholders' of today are the inheritors of this complex cultural legacy, and must negotiate diverse and sometimes conflicting objectives in their pursuit of a potentially unifying goal: a secure and sustainable future for the commons. The book also has considerable contemporary relevance, providing a timely contribution to discussion of strategies for the implementation of the Commons Act of 2006. The case studies position the new legislation in England and Wales within the wider context of institutional scholarship on the governance principles for successful common pool resource management, and the rejection of the 'tragedy of the commons'.

Nevertheless, whilst there have been a number of valuable contributions looking at issues such as charity as a key welfare provider, charity and medicine, and charity and power in the community, there has been no book length exploration of the role and position of the recipient. By focusing on the recipients of charity, rather than the donors or institutions, this volume tackles searching questions of social control and cohesion, and the relationship between providers and recipients in a new and revealing manner. It is shown how these issues changed over the course of the nineteenth century, as the frontier between the state and the voluntary sector shifted away from charity towards greater reliance on public finance, workers' contributions, and mutual aid. In turn, these new sources of assistance enriched civil society, encouraging democratization, empowerment and social inclusion for previously marginalized members of the community. The book opens with an introduction that locates medicine, charity and mutual aid within their broad historiographical and urban contexts. Twelve archive-based, inter-related chapters follow. Their main chronological focus is the nineteenth and early twentieth centuries, which witnessed such momentous changes in the attitudes to, and allocation of, charity and poor relief. However, individual chapters on the early modern period, the eighteenth century and the aftermath of the Second World War provide illuminating context and help ensure that the volume provides a systematic overview of the subject that will be of interest to social, urban, and medical historians.

Invariably the indigenous elites drew upon British constitutional ideas and institutions regardless of the political conditions that prevailed in their very different lands. Many Asian nations called upon the services of Englishman and Law Professor Sir Ivor Jennings to advise or assist their own constitution making. Although he was one of the twentieth century’s most prominent constitutional scholars, his opinion and influence were often controversial and remain so due to his advocating British norms in Asian form. This book examines the process of constitutional formation in the era of decolonisation and state building in Asia. It sheds light upon the influence and participation of Jennings in particular and British ideas in general on democracy and institutions across the Asian continent. Critical cases studies on India, Pakistan, Sri Lanka, Malaysia and Nepal – all linked by Britain and Jennings – assess the distinctive methods and outcomes of constitution making and how British ideas fared in these major states. In terms of proprietary interests the fundamentals are seen as rights to transfer, beneficial interests under trusts which are overreachable, burdens which are endurable, leases, money charges such as mortgages which are redeemable, and the obligations enforcible within the neighbour principle -- easements, covenants and positive covenants being treated as a semi-coherent whole. An attempt has been made to assist students by moving some of the more arcane learning later into the book or into separate chapters where these matters might be more readily ignored by a candidate concerned primarily to prepare for an examination.
