The purpose of the paper is to determine the history which results in present Navy/Coast Guard guidance and to provide a succinct, general set of guidelines for the conduct of direct Navy involvement in law enforcement activities. An examination of the establishment of the Posse Comitatus Act, its reasons for existence, the changes made to it, and the subsequent directives implementing present policy is conducted. Both domestic and international legal considerations involving the use of the Navy in maritime law enforcement are examined. Finally present Coast Guard and Navy policy are summarized, including the use of force and concluding with a set of five basic premises to be followed by a Navy commanding officer involved in a law enforcement situation. For the Navy, the challenges have centered on developing maritime capabilities to prosecute the GWOT as far forward as possible. To assist the Navy's planning in this area, the former Chief of Naval Operations requested the NRC to conduct an assessment of the adequacy of and prospects for improving the role of Naval Forces in the GWOT. The study developed a defense-in-depth framework as the organizing principle for the report. The report contains information as described in 5 U.S.C. 552(b) and therefore could not be released to the public in its entirety. The public version consists of an executive summary that presents an assessment of the transformation of naval forces for addressing the GWOT; a brief description of the defense-in-depth framework; and a list of findings and major recommendations.

Book excerpt: Posse Comitatus law and/or service policies have prohibited DoD forces from becoming involved in domestic/civil law enforcement since the late 1870s. Focus upon the "war on drugs" during the 1980s generated new laws that significantly changed DoD's role in this long-term battle. Current National Security Strategy (NSS) and National Drug Control Strategy (NDCS) indicate ongoing involvement by DoD forces in the strategy to decrease demand, reduce availability of drugs, and reduce the number of young people who experiment with drugs. Posse Comitatus law does not apply outside of the United States, and the law only applies to the U.S. Army and U.S. Air Force; however, Department of Navy officials have crafted their service policy to mirror Posse Comitatus restraints. 10 USC 375 (1988) provided clarification and restricted all DoD forces from becoming directly involved in law enforcement (search, seizure and arrest). It's time for another look at partially increasing DoD involvement in counterdrug operations (CD OPS). This paper presents a case for authorizing U.S. Navy combatants to board foreign vessels upon the high seas. Appendix A includes a detailed summary of Posse Comitatus law and its changes over the past century.

It will help law enforcement agencies develop or enhance their intelligence capacity and enable them to fight terrorism and other crimes while preserving community policing relationships. The world of law enforcement intelligence has changed dramatically since September 11, 2001. State, local, and tribal law enforcement agencies have been tasked with a variety of new responsibilities; intelligence is just one. In addition, the intelligence discipline has evolved significantly in recent years. As these various trends have merged, increasing numbers of American law enforcement agencies have begun to explore, and sometimes embrace, the intelligence function. This guide is intended to help them in this process. The guide is directed primarily toward state, local, and tribal law enforcement agencies of all sizes that need to develop or reinvigorate their intelligence function. Rather than being a manual to teach a person how to be an intelligence analyst, it is directed toward that manager, supervisor, or officer who is assigned to create an intelligence function. It is intended to provide ideas, definitions, concepts, policies, and resources. It is a primera place to start on a new managerial journey. Every law enforcement agency in the United States, regardless of agency size, must have the capacity to understand the implications of information collection, analysis, and intelligence sharing. Each agency must have an organized mechanism to receive and manage intelligence as well as a mechanism to report and share critical information with other law enforcement agencies. In addition, it is essential that law enforcement agencies develop lines of communication and information-sharing protocols with the private sector, particularly those related to the critical infrastructure, as well as with those private entities that are potential targets of terrorists and criminal enterprises. Not every agency has the staff or resources to create a formal intelligence unit, nor is it necessary in smaller agencies. This document will provide common language and processes to develop and employ an intelligence capacity in SLTLE agencies across the United States as well as articulate a uniform understanding of concepts, issues, and terminology for law enforcement intelligence (LEI). While terrorism issues are currently most pervasive in the current discussion of LEI, the principles of intelligence discussed in this document apply beyond terrorism and include organized crime and entrepreneurial crime of all forms. Drug trafficking and the associated crime of money laundering, for example, continue to be a significant challenge for law enforcement. Transnational computer crime, particularly Internet fraud, identity theft cartels, and global black marketeering of stolen and counterfeit goods, are entrepreneurial crime problems that are increasingly being relegated to SLTLE agencies to investigate simply because of the volume of criminal incidents. Similarly, local law enforcement is being increasingly drawn into human trafficking and illegal immigration enterprises and the often associated crimes related to counterfeiting of official documents, such as passports, visas, driver's licenses, Social Security cards, and credit cards. All require an intelligence capacity for SLTLE, as does the continuation of historical organized crime activities such as auto theft, cargo theft, and virtually any other scheme that can produce profit for an organized criminal entity. To be effective, the law enforcement community must interpret intelligence-related language in a consistent manner. In addition, common standards, policies, and practices will help expedite intelligence sharing while at the same time protecting the privacy of citizens and preserving hard-won community policing relationships.~

Book excerpt: The United States has enduring national and strategic interests in the polar regions, including citizens living above the Arctic circle and three year-round scientific stations in the Antarctic. Polar icebreaking ships are needed to access both regions. Over the past several decades, the U.S. government has supported a fleet of four icebreakersâ€"three multi-mission U.S. Coast Guard ships (the POLAR SEA, POLAR STAR, and HEALY) and the National Science Foundation's PALMER, which is dedicated solely to scientific research. Today, the POLAR STAR and the POLAR SEA are at the end of their service lives, and a lack of funds and no plans for an extension of the program has put U.S. icebreaking capability at risk. This report concludes that the United States should continue to support its interests in the Arctic and Antarctic for multiple missions, including maintaining leadership in polar science. The report recommends that the United States immediately program, budget, design, and construct two new polar icebreakers to be operated by the U.S. Coast Guard. The POLAR SEA should remain mission capable and the POLAR STAR should remain available for reactivation until the new polar icebreakers enter service. The U.S. Coast Guard should be provided sufficient operations and maintenance budget to support an increased, regular, and influential presence in the Arctic, with support from other agencies. The report also calls for a Presidential Decision Directive to clearly align agency responsibilities and budgetary authorities.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. Book excerpt: Under long-standing law, the so-called Posse Comitatus Act of 1878 (18 U.S.C. 1385) prohibits the use of the Departments of the Army or the Air Force to enforce the nation's civilian laws except where specifically authorized by the Constitution or Congress. While the language of section 1385 lists only the Army and the Air Force, DOD has made the provisions of section 1385 applicable to the Department of the Navy and the U.S. Marine Corps through a DOD directive (DOD Directive 5525.5, Jan. 15, 1986). Congress has enacted various pieces of legislation authorizing a military role in supporting civilian law enforcement agencies. For example, in the Department of Defense Authorization Act for Fiscal Ye & 1982 (P.L. 97-86), Congress authorizes the Secretary of Defense to provide certain assistance-type activities for civilian law enforcement activities. This legislation also provided, however, that such U.S. military assistance does not include or permit participation in a search, seizure, arrest, or other similar activity, unless participation in such activity is otherwise authorized by law.
