Book A Practical Guide to Criminal and Regulatory Proceedings in Consumer Protection Matters

Download or read book A Practical Guide to Criminal and Regulatory Proceedings in Consumer Protection Matters written by Richard Gibbs and published by . This book was released on 2021-02-18 with total page 110 pages. Available in PDF, EPUB and Kindle. Book excerpt: The legal profession is going through a period of unparalleled change necessitated, in part, by the growth in criminalisation of matters which in a previous era may have been dealt with in the civil courts or even by way of commercial resolution. In part this has been fueled by the growth of the consumer movement and its reinforcement by the law, originally stemming from Europe but now very much enshrined in English domestic law. A Practical Guide to Criminal & Regulatory Proceedings in Consumer Protection Matters explains how the law has developed to the point it is now at and sets out how this is now enforced in English courts. Both sides of the civil and criminal landscape are examined as is the way in which the regulations are applied to traders and consumers. The book addresses the powers of investigation which are created by the various pieces of Consumer focused legislation now in force as well as the criminal offences which can arise. It also explores the steps in case preparation which lawyers may be advised to follow especially given some of the legal presumptions which apply in these type of cases. ABOUT THE AUTHOR Richard Gibbs gained his original degree in Political Science and History at University College Dublin; he converted to law at Birmingham University before reading for the BPTC at the University of Law and then being called to the Bar by The Honourable Society of the Inner Temple where he won the Lawson moot. He is a practicing barrister prosecuting and defending in regulatory and criminal cases across England & Wales. He has a strong interest in non-CPS prosecutions and has extensive experience of defending individuals and companies in matters relating to Trading Standards and Health and Safety offences. In addition to his practice at the Bar, he is a Visiting Lecturer at the University of Law lecturing aspiring barristers and solicitors in law and the fundamentals of legal practice. He has been a regular contributor to legal journals since becoming a barrister in 2012. He has appeared on the BBC as a commentator on criminal sentencing and regularly delivers training to police in criminal justice matters. Richard lives with his wife and daughter in Worcestershire.

Book Consumer Law

Download or read book Consumer Law written by M. J. Leder and published by . This book was released on 1991 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a sense there is no such creature as consumer law. English law has never developed a fully coherent body of law designed to protect the consumer. The consumer and his advisers have instead been obliged to utilize a hotchpotch of common law concepts and doctrines designed primarily for other purposes. Even the recent statutory consumer protection developments have been piecemeal, and do not amount to a comprehensive code. that consumer law is a hybrid creation. The student accordingly needs to study a number of disparate categories of law, but at the same time needs to be constantly aware of their interrelationships from the consumer viewpoint. This book draws attention to the interrelationships in its discussion of the law. private (or civil) law. The text deals not only with the law of sale of goods as it relates to consumers, but also with analogous contracts and with contracts involving the supply of a service. After a review of product liability, attention is directed at the consumer credit dimension. themselves afford adequate consumer protection. Part two of this book therefore deals with intervention in the consumer interest by administrative remedies, backed by criminal law sanctions. It may well be that administrative remedies and criminal law sanctions now play a more significant role in consumer protection as a whole than does private law. Nevertheless, the individual consumer with a particularized complaint lives, so to speak, in a mixed legal economy; private law is not obsolete and the consumer's adviser must master its details.

Book The Law and Economics of Enforcing European Consumer Law

Download or read book The Law and Economics of Enforcing European Consumer Law written by Dr Franziska Weber and published by Ashgate Publishing, Ltd.. This book was released on 2014-05-28 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the internet age, the need for effective consumer law enforcement has arguably never been greater. This timely book is a comparative law and economic analysis of the changing landscape of EU consumer law enforcement policy. EU member states are moving away from purely public or private law enforcement and now appear to be moving towards a more mixed approach, not least due to European legislation. This book reflects on the need for and creation of efficient enforcement designs. It examines the various economic factors according to which the efficiency of different enforcement mechanisms can be assessed. Hypothetical case scenarios within package travel and misleading advertising, dealing with substantial individual harm and trifling and widespread harm are used to illustrate various consumer law problems. Design suggestions on how to optimally mix enforcement mechanisms for these case scenarios are developed. The findings are then used as a benchmark to assess real life situations in countries with different enforcement traditions - the Netherlands, Sweden and England. The book is of value to both researchers and policy-makers working in the area of consumer protection.

Book Criminal Enforcement of Intellectual Property

Download or read book Criminal Enforcement of Intellectual Property written by Christophe Geiger and published by Edward Elgar Publishing. This book was released on 2012 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: This wide-ranging Research Handbook is the first to offer a stimulating and systematic review of the framework for criminal enforcement of intellectual property rights. If counterfeiting constitutes an ever-growing international phenomenon with major economic and social repercussions, potentially affecting consumer safety and public health, the question of which are the appropriate instruments to enforce IP rights is a complex and sensitive one. Although criminal penalties can constitute strong and effective means of enforcement, serious doubts exist as to whether criminal sanctions are appropriate in every infringement situation. Drawing on legal, economic, historical and judicial perspectives, this book provides a differentiated sector-by-sector approach to the question of enforcement, and draws useful conclusions for future legislative initiatives at European, international and national levels.Offering a broad survey of the field, and a sound platform for further research, this legal and cross-disciplinary study by leading scholars will prove insightful for professors, researchers and students in intellectual property, criminal, competition, consumer protection and health law.
